Ther being a petitione presentit to us be Mr Gideon Penman, minister at Crichtoune, and his scholmaster therat, holding forth that the said minister being procest most unjustlie be certaine of the remonstrators befoir the synod of Lowthian, wherof the Lady Humbie, being dochter to the Lord Warstoune, taking occasione of the tymes did most unjustlie deteine fra the petitioner his stipend in sua far as shee as tutrix to Helein Hepburne, hir dochter, and hir deceast husband was lyable for the same for the space of four yeirs and the lyk fra the said scholmaster; and therfor praying shee may be decerned to mak payment of the same. Wherupon citatione being given out be ws and the samen actione being callit and being informed the said lady craved nothing bot in regaird shee was executrix to hir deceast husband and tutrix to hir said dochter and that shee had found cawtione for the rents to be furthcomand to all pairties haveand entress, that shee might have ane decreit for his exoneratioune. It is our humble opinione therfor that the said minister and scholmaster should have ther stipend abovewrittin and that decreit should goe furth against hir accordinglie.
