David McBrair, comissioner for Kirkcudbrigh, tooke the oath of alledgance and oath of parliament.
The comissioner, with advyce of the estats of parliament, appoynts the signet to be opend for engathering the king's rents and bygone excyse; and that ane act be framd therupon and presented to the articles to be considered be thame, and then brought to the hous.
The act condemning the delyverie of the king red, and continowed till Fryday.
The marques of Argyle, being called to the bar to ansr to his dittay, desyrd he might be hard to offer somewhat to the parliament, previous to his tryel, before the dittay were red. The comissioner, with advyce of parliament, finds that according to the forme of processe the dittay should be first red, and then the marques to have a full hearing. And accordinglie the marques being againe called, the dittay wes red, and the marques at lenth hard, who desyrd that in regard he had not yit consulted with his advocats throw ther default in not tymelie accepting the employment, he might have some furder tyme allowed to him to ansr, and that the tryell of this bussines may be tane be way of precognition. The parliament declare they will not grant any precognition, bot will proceed in the ordinarie legall way be a prosecution of the dittay; and allowis to the marques the 26 of this moneth to give in his full ansrs to the hail dittay without farder delay, and the defenss to be given to the lords of the articles, conforme to ther comission.
The marques of Argyle's advocats gave in a paper desyring etc. The parliament finds ther desyr unreasonable, and comands thame freelie to doe ther duetie as advocats for the marques as they wilbe ansrable.†
The petition of the merchands of Monrose remitted to the present comissioners of the borrowis, to heere parties and to report once the nixt weeke.
The comissioner continewis the parliament till Fryday at 2 of the cloke, and continewis all sumonds ut supra etc. The articles to meet to morrow afternoone.†
