Our soverane lord and estates of parliament, takeing into their consideration a supplication presented unto them by George, lord Bamff, George, master of Bamff, Mr Thomas Mortimer, portioner of Boigtoun, Williame Ogilvie, younger of Bauclaw, Walter Ogilvie, sone to the deceast Johne Ogilvie of Glassauch, Alexander Brokie, servitor to my Lord Bamff, Alexander Brokie, tennent to the said lord, and James Brokie, notter publict in Bamff, shewing that whair his majesties' commissioner and honourable court of parliament, haveing heard and considered the supplication presented to them in relation to the alledged slaughter committed upon the deceast Mr Johne Gordoun of Barrallmad for ane precognition and previous tryall of the circumstances of the same, and that, after deliberation, they haveing appointed the procedor and way of the said slaughter to be tryed be way of precognition by his majesties' privy councill and, in the meane tyme, the saids estates did discharge all criminall procedor against the supplicants till the first day of Junij next to cume, now so neir approaching, and longer as it should be fund convenient be the privy councill, as the act of precognition beares; and seing that apparentlie the said privie councill will not sit doun before the first of Junij be by past, so that the supplicants will lose the benefite of the said act of precognition wnlesse the same be prorogate to such ane compitent tyme after the dounsitting of the privy councill as probation may be deduced in the said mater; and therfor, craveing that the forsaid former act of precognition might be prorogate untill such tyme after his majesties' privy council shall sit doun and be established, as the supplicants may have compitent tyme to get probation led and deduced in the said mater after doun sitting of the secret councill and, in the mean tyme, that all criminall procedor might be discharged in the said mater untill such tyme as the precognition forsaid might be put to ane finall close be the saids lords of privy councill, and als craveing warrand to summon witnesses for tryell of the said mater or otherwayes to remit the same to the saids lords of privy councill for granting of letters for that effect. And haveing also considered the forsaid act of precognition, of the date the tuentie nynth day of January last, with the report of the commissioners of parliament appointed for bills theranent, to whom the said mater wes referred, and being therwith well and ryply advised, his majestie, with advice and consent of the saids estates of parliament, prorogats the forsaid act of precognition formerly granted in the said mater of the date abovewritten untill the last day of July nextocome, and recommends to the lords of his majesties' privy councill to take tryell in the said mater conforme to the tenor of the forsaid act of precognition, and heirby grants power to them to emit precepts for summoning of all parties concerned therin and such witnesses as shall be condescended on for cleiring of the said mater, to compeir before them, at such dayes and places as they shall appoint, to beare witnessing in the said mater, with such certification as is ordinar to be granted by them in the lyk cace and, in the meane tyme, yet as of before, discharges all criminall processe against the saids supplicants untill the said last day of July next, and longer as shall be fund convenient be the saids lords of privy councill to appoint.
