Anent the supplication given in to his majestie and estates of parliament be William Murray of Longharmistoun against Ladie Anna Scot, only sister and appeirand air to the deceast Marie, countesse of Buccleuch, Patrick Scot of Langshaw and the tutors and curators of the said Ladie Anna, if she any hes, for their interesses, mentioning that the supplicant, haveing in anno 1648 outreiked fyve horses and three quarters for the deceast earle of Buccleuch to the leavies made that yeer, and haveing latelie sumoned the said deceast Marie, countes of Buccleuch and Walter, earle of Tarras, her husband, for his interesse, to mak payment to the supplicant of the sume of one hundreth and ten pund sterline as the pryce agreed upon betuixt the supplicant and the said deceast earle his freinds, and for the which the said deceast earle did draw ane precept upon the said Patrick Scot whairof he never got payment, the said Patrick haveing been countermanded after the defeat at Prestoun; thairfor, craveing that the said Ladie Anna Scot might be ceited to heare and sie the said Patrick Scot to whom the said precept wes delivered, to be decerned to exhibite and produce the same, to declare anent his receaveing thairof ut constet de debito and being so lawfullie constitute in the supplicant's persone, to have heard and seen it fund and declaired that it should be lawfull to the supplicant to persue the said Ladie Anna Scot, or any other representing the said Marie, countesse of Buccleuch or the said deceast earle of Buccleuch, for payment of the forsaid summe of one hundreth and ten pund sterline to the supplicant, as the said supplication at more lenth beares. The supplicant compeiring be [...], advocat, his procurator, and the said Ladie Anna Scot and Patrick Scot, defenders, compeiring be [...], their procurators, the saids estates of parliament, haveing heard, seen and considered the said supplication and report underwritten, containeing the oath and deposition of the said Patrick Scot and, being therwith well and ryplie advised, his majestie, with advice and consent of the saids estats of parliament, finds and declares the abovewritten sume of one hundreth and ten pund sterline to have been resting and adebted be the said deceast earle of Buccleuch to the said supplicant for the cause forsaid, and that the aires and executors of the said deceast earle of Buccleuch and of the deceast Marie, countesse of Buceleuch ought and should make payment to the supplicant, his aires and assignayes of the samen sume of one hundreth and ten pund sterline, with the interest thairof in tyme comeing from the date of thir presents till the same be payed as aforsaid, because the commissioners appointed for trade and bills, haveing called the said Ladie Anna Scot and her tutors and also the said Patrick Scot befor them, after consideratione of the said supplication, and the said Patrick Scot being examined and sworne in the said mater, deponed that either by precept or missive letter he wes ordered by Francis, earle of Buccleuch, deceast, to pay to the supplicant the said sume of one hundreth and ten pund sterline for fyve troop horse and a halff, and that he never payed any parte of the said summe, being therafter discharged by the said earle to pay the same, the said commissioners for trade and bills, haveing considered the said deposition and that the said Patrick Scot wes entrusted by the said deceast earle in all his affaires, wes left one of the tutors to his childreen and is still entrusted with that estate, conceaved that it should be declared that the said sume of one hundreth and ten pund sterline, due to the said supplicant for the causes forsaids, wes a just debt resting owing be the said deceast earle the tyme of his decease, and that the aires and executers of the said deceast earle and of the said deceast Marie, countes of Buccleuch ought and should make payment of the samen to the supplicant, or his aires or assignayes, and that the samen soume ought to beare annualrent in tyme comeing, ay and whill payment be made thairof to the supplicant or his forsaids; which report, being this day considered be the saids estates of parliament, they approved the same and gave their decreit in maner abovewritten.

Anent the supplication given in to the estates of parliament be Alieson Kellie, lawfull daughter to the deceast James Kellie of Swanfeild, against Patrick Home of The Law, Mr James Scot and George Home in The Law, shewing that the supplicant is creditor to Patrick Home of The Law in great sumes of money, for security whairof, she had obtained decreit of generall and spetiall declarator thairupon, the said Patrick Home for avoiding the saids just and lawfull debts had often heirtofore, by himselff and the saids Mr James Scot and George Home in the Law, his compleices, alledged that he had discharges or bakbands, assignations or other writts for avoiding thairof, and had now, as the supplicant is informed, cause mak up ane false discharge whairin he maks the supplicant to have discharged him of all debts and, inrespect of the cessation of the ordinary course of justice, the direct maner of the improbation of the said false discharge might fall to the supplicant's heavie prejudice, and therfor, craveing ane warrand to summon the saids defenders to compeir befor the commissioners of parliament appointed for bills at ane certane day bygone, to have given their oaths anent the haveing of any discharge, bakband, assignation or other writs true or false granted be the supplicant, and to produce the same in thair presence, with certification if they failyie, they shall never make faith heirafter against the supplicant, and if any shall be produced that the writter and witnesses insert therin may be examined, that the same may remaine in retentis till they be cognosced befor the judge ordinar, as at more lenth is contained in the said supplication. Which supplication, being red in presence of the commissioners of parliament appointed for bills, after lawfull citation of all the saids three defenders be vertew of ane delyverance upon the said supplication, the said Alieson Kellie, supplicant, compeiring personally with Mr Thomas Wallace, her procurator, who for verefieing of the said supplication produced ane compriseing, led and deduced at her instance, against the said Patrick Home of certane husband lands in the Law and others, in payment to her of the sume of sex thousand, eight hundreth and seventie merks Scots of principall expences and byrun annualrents and of the sume of three hundreth [and] fourty three merks, sex shilling[s] [and] eight pennies of shirref fie correspondent thairto, dated the sext day of November 1657 yeers; with ane other appriseing led at the instance of Mr James Cheyne of Hugstoun, writter to the signet, against the said Patrick Home, dated the second day of March 1655 yeers, appriseing the saids husband lands from him in payment to the said Mr James of the sume of tuo thousand, tuo hundreth [and] seventie fyve merks, tuo shillings Scots as for the principall, and of the summe of ane hundreth and threttein merks, ten shillings of shirref fie correspondent thairto, with ane assignation be the said Mr James Cheyne to the said Alisone Kellie in and to the said appriseing and sums of money abovewritten thairincontained, with ane decreit of generall and spetiall declarator obtained at her instance as donator to the gift of the escheit of the said Patrick Home against the said Patrick and his tennents of the Law, and others, for payment of the maills and dewties of his lands in maner therinspecified, dated the tuenty fourt day of July 1658 yeers, which decreit is under the subscription of William Downie, then one of the clerks of the court of justice for the tyme. And the saids Patrick Home and Mr James Scot, defenders, compeirand also personally with Mr Alexander Spotswood, their procurator, all the rights, reasons and allegations of either of the saids parties, together with the writs forsaids produced for the parte of the said persewer, as said is, with the said Patrick Home his oath and declaration at the first taken in the said mater, with ane other declaration made be the said Patrick Home under his subscription of the date the tuenty one day of March 1661 yeers, whairby he declairs that he adheres to ane former disposition given be him in the said mater, and farder declared that he never saw that discharge lybelled, and that if any such wes it wes meerly granted for liberateing him out of prisson; and for further satisfaction to the saids estates of parliament he therby declared that he disclamed all discharges whatsumever written be the said Mr James Scot in his favours relateing to Alieson Kellie preceiding the date forsaid of the said declaration, with all benefite that might accresse therby and obleidged him never to make use thairof in judgement nor outwith and, upon his faith and conscience, declaired that he never saw the said discharge nor knew whither ther be any such thing or not, and utterlie disclamed the same, as said is, as the said declaration extant in processe more fully beares.
[This] with tuo declarations given in be the said Mr James Scot theranent, who wes at tuo severall tymes examined in the said mater, being all heard, sein and considered be the saids estates of parliament and, they therwith being well and ryply advised, his majestie, with advice and consent of the saids estates of parliament, hath reponed and heirby repones the said Alison Kellie, supplicant, against the forsaid pretendit discharge or any assignation, bakband or other write whatsumever forged, counterfit or made up be the said Patrick Home or be the said Mr James Scot, who ever be the writter thairof, which may any wise hurt the said Alison Kellie her tuo decreits of appriseing forsaid, anent the payment of the summs of money principall, annualrents and expences or sherref fie thairincontained, charters and infeftments following thairupon, or gifts of escheit and lyverent aforsaid of the said Patrick Home, decreits of generall and spetiall declarator or any other diligence following therupon or which might have followed upon the same, or which might prejudge her of any other rights of lands, tenements, goods or geir whatsumever perteaneing to her, and decernes and declares the forsaids pretendit discharges, assignations, bakbands or other writs forged and falsified, in maner forsaid, to be voyd and null and never to make faith in judgement nor outwith in tyme comeing. And inrespect of the scandalous cariage of the said Mr James Scot, ordaines him to remaine in prisson till further order, and als, inregaird of the contumacie of the said Patrick Home, decernes and ordaines him fugitive for ever, ay and whill the said Patrick give bak and deliver the forsaid discharge, bakband, assignation or other writs forged and counterfit alledged made be the said Alieson Kellie, in maner forsaid, and she be further secured theranent. Because the tyme of the discussing of the forsaid action, after that the said supplicant and her procurator in her name had past from the said George Home in this action, the saids commissioners of parliament appointed for bills, haveing examined the said Patrick Home and Mr James Scot, writter, upon the mater of fact, the said Master James Scot confessed he had written ane discharge of the tuo appriseings led at the instance of the said Alisan against the said Patrick Home his lands and estate, and of the summs of money thairincontained, and of the escheit and lyverent forsaid of the said Patrick Home, bot knew not if she got any money for the same and, haveing examined him therafter in the tolbuith of Edinburgh, they fand him materially alter and differ from his forsaid deposition. Lykas, the saids commissioners and subcommissioners, haveing examined the said Patrick Home at his lodgeing theranent, he declared that he gave no money for the forsaid discharge, and that it wes only intendit to bring him out of prisson at Berwick wher he then lay, and that he never imployed the said Mr James Scot nor non els, nor knew not who broght the same to him, lykas by the other declaration under the said Patrick his oun hand he had disclamed and altogether disallowed the forsaid discharge in maner abovementioned. [Therefore] with the which petition and writts forsaids produced for the said persewer, as said is, with the declarations forsaids of the saids Patrick Home and Mr James Scot and with the said Patrick Home his contumacie in not appeareing befor the saids commissioners or estates of parliament forsaid, till he wes fund at his lodgeing by the members of parliament who wes commissionat to take his declaration theranent, the saids estates of parliament, being well and ryply advised, they fand therby sufficient ground to infer decreit to be given in the said mater in maner abovewritten, and therfor they gave their decreit in maner abovementioned and ordaines letters etc.

Our soverane lord and estates of parliament, haveing taken to their consideration [a supplication] presented to them by the poore schoollers haveing the Yrish langwage presently mantained at schools and colledges by the synod of Argyll, shewing that the said synod, haveing some yeers agoe pitched upon the supplicants to be mantained at schools and colledges in order to the ministerie for the more speedie planting of the Gospell in the Hielands, upon the vacand stipends of the province of Argyll, conforme to the same acts of parliament empowering them for that effect, many of the supplicants had already come ane considerable lenth in thair learning and studies, and the said synod of Argyll, haveing in November last disposed on certane of the vacances then resting within thair bounds towards the supplicants' mantenance at thair learning for this yeer, whairof the supplicants had as yet gotten bot a verie small portion, they for want of what had been allowed to them are not only in hazard to be imprissoned for their bygone buirdeings yet resting, bot also to quyte their studie for the future except some speedie supplie wer granted to them; and therfor, craveing ane warrand for uplifting and giveing to them als much of the readiest of the saids vacancies as wold satisfie and defray thair intertainment and charges at their learning this yeer. And haveing also considered the commissioners of parliament appointed for bills and tradeing their report given in theranent, to whom the said mater wes referred, with the roll and list of the saids supplicants all particularly afternamed, under the subscription of Mr Robert Duncan, moderator of the said synod, have ordained and ordaines Mr Johne Wilkie, collector of the vacand stipends within this kingdome, to mak payment to each of the supplicants aftermentioned viz. Mr Archibald Beith, Mr Archibald Mcclachlang, Mr Johne Stewart, Archibald Henrie, Archibald Mcilvernock, William Cock, Duncan Arthour, Alexander Cameron, Dougall Campbell, James Duncanson, Duncan Fisher, Donald Mcclachlane, Allane McDougall, Duncan Campbell, Johne Mcroy, Archibald Campbell, Johne Mclachlane, Archibald Mcneill, Johne Darroch, Alexander Campbell, Johne Campbell and William Fisher the sume of one hundreth merks Scots money out of the first and readiest of the vacand stipends within the said synod of Argyle for thair supplie and mantenance, this present yeer, one thousand, sex hundreth [and] threescore one.

Our soverane lord and estates of parliament, takeing to their consideration a supplication presented unto them be Alexander Keith of Ludwharne, shewing that Anthony Rodswell, Englishman [and] merchant in Leith, is adebted to him in the sume of tuelff hundreth merks Scots money, conforme to his band granted to the persewer thairupon, and that the said Anthony is ane stranger and it is not knoune how soone he will remove from Scotland, so that he might losse the forsaid summe inregaird that ther is no open signet for the present wherby he might secure himselff of the forsaid sume by raiseing of horneing, poinding and areistment unles remeid wer provydeit therto; and therfor, craveing ane warrand to messingers at armes to fence and areist the haill goods, geir, cornes, cattell, insight, plenishing, summs of money, debts and others whatsumever adebted and restand awand to the said Anthonie Rodswell, to remaine under areistment ay and whill he be payed of the forsaid summe of tuelve hundreth merks; and haveing also considered the report of the commissioners of parliament appointed for bills, to whom the same wes referred, and finding the desire of the said supplication reasonable, thairfor his majestie, with advice and consent of the saids estates of parliament, doe heirby grant full power and warrand to any messinger at armes within this kingdome to fence and areist the haill goods, geir, cornes, cattell, insight, plenishing, soums of money, debts and others whatsumever adebted and restand awand to the said Anthony Rodswell, in whose hands and wherever the same can be apprehended, to remaine under areistment ay and till the supplicant be compleitlie satisfied and payed of the forsaid summe of tuelve hundreth merks, conforme to the tenor of his band in all points.

and also ratifies and approves the charter and infeftment granted be his majesties' said deceast grandfather, under his majesties' great seall, of the date the seventh of March 1593 yeers, to the deceast Johne, then master of Thirlestane, eldest lawfull sonne to the said deceast Johne, lord Thirlestane, chancellour, therafter designed Johne, earle of Lawderdale, and to his aires therinspecified, off all and haill the said lordship, barronie and regality of Mussilburgh, comprehending the lands, kirks teinds and others aboverehearsed, proceiding upon the resignation of the said deceast Johne, lord Thirlestane, chancellour, containing ane clause de novo damus, with ane act of ratification of the said infeftment made in parliament the eight day of Junij 1594 yeers; and als ratifies and approves the charter and infeftment granted be his majesties' dearest father to and in favours of the said deceast Johne, earle of Lauderdale and his aires therinmentioned, of the date the seventeinth day of November 1641 yeers, of all and haill the said lordship, barronie and regality of Mussilburgh, comprehending the touns and lands of Smeitoun, Inneresk and all the other lands, milnes, kirks, teinds and others respective abovewritten, with the right of superiority of the vassals of the said lordship and right of regality of the same, with the office of heretable baillierie of all and haill the saids lands and lordship of Mussilburgh shire, within the haill bounds of the same (excepting the superiority of the saids lands of Shirreffhall and Pinkie), which charter containes ane new union and erection of the said lordship, barronie and regality† and diverse other clauses therinmentioned, together with the whole grounds of the said charter and infeftment, with the precept of sasine following thairupon and instrument of sasine proceiding upon the same; which charters, infeftments, acts of parliament and others abovespecified, and all other acts of parliament, rights and infeftments of and concerneing the said lordship, barronie and regalitie of Mussilburgh, comprehending the lands and others abovespecified, made and granted be his majesties' father or grandfather† with the precepts of sasine and sasines with all retoures and others writs following thairupon, his majestie, with consent forsaid, ratifies and approves in all and sindrie the heids, articles, clauses and circumstances thairof, and decernes and ordaines that this present ratification shall be in all tyme comeing of als great force, strenth and effect as if the forsaids charters, infeftments, ratifications, acts of parliament, precepts and others abovespeficiet wer verbatim insert heirintill. Moreover, our soverane lord, takeing to consideration the good and faithfull service done to his majestie and his deceast father, of blessed memorie, be Johne, earle of Lauderdale, his majesties' secretary, and to his majesties' royall ancestors be the said earle his predicessours, and the great losses and sufferings susteaned be the said earle for his fidelity and loyaltie and affection to his majesties' service in his persone and estate, being taken at Worcester attending upon his majesties' sacred persone, and being put and keept in closse prisson for the space of [...] yeers, the malice and crueltie of the usurpers for the tyme being so great and implacable against him for his loyaltie, affection and constancy, he wes excepted and declared, be their pretendit acts, incapable of all favour and pardon, and wes robbed and dispossessed of his haill estate, the same being given out in donatives and disponed be them to diverse persones who wes possest of the same so that, dureing his long and miserable imprissonment forsaid, he had no lyvelyhood for himselff and his family, and wes redacted to unsupportable wants and necessities, and in a most lamentable condition under the sense of his oune and (which is more) his majesties' sufferings, and dayly expecting destruction and utter rwine of his oune persone and family, which unavoydablie would have followed iff God, of his mercy, had not prevented the same and wonderfully restored his majestie to his kingdomes and government, and also considering that the said lordship, barronie and regality of Mussilburgh wes not only excepted from the generall act of annexation† of the abbacie of Dumfermling to the croun be the forsaid act in anno 1593, and that it wes declaired be the said act that the said lordship and barronie of Mussilburgh should not be comprehendit in any anexation to follow therafter, for the reasones thairin contained, and that the said lordship wes dissolved be his majesties' royall father and estates of parliament in the said yeer 1641 yeers be the forsaid act of ratification and dissolution abovementioned; thairfor, his majestie, with consent forsaid, hes of new dissolved and, be thir presents, dissolves the said lordship, barronie and regality of Mussilburgh, comprehending the lands, teinds, superiorities of vassalls, kirks, patronages, office of heretable baillierie and others abovementioned (except the superiority of the lands of Shirreffhall and Pinkie abovementioned, maner place and pertinents thairof, which are to hold of his majestie in all tymecomeing) fra all annexations of the said lordship to the croun, and in spetiall from the act of annexation made be his majesties' blessed father and estates of parliament in anno 1633 entituled, the annexation of his majesties' proppertie, being the tent act of the said parliament, wherby the right of the superiority of all lands and barronies perteaning to whatsumever abbacies or other benefices erected in temporall lordships and liveings, is declaired to be annexed to the croun, together with the fewmaills, fewfermes and others dewties of the saids superiorities, to the effect the said lordship, barronie and regality of Mussilburgh, comprehending the lands, teinds, kirks, patronages, office of baillierie and others abovewritten, with the superiority of vassalls of the said lordship (excepting as said is) may be disponed irredeimably without reversion or regres whatsumever, and with the jurisdiction, priveledges and immunities belonging to any frie regality within this kingdome, to and in favours of the said Johne, earle of Lauderdale, and his aires male, which failyeing in favours of his nearest and lawfull aires and assignayes whatsumever, in frie blensh ferme for payment of a pennie and susteaning yeerlie the ministers, ane or mae as shall be neidfull, for the service of the cure of the kirks mentioned in the forsaid charter granted to the said deceast Johne, earle of Lawderdale, be his majesties' umqhile father, of the date the seventeinth of November 1641 yeers. And als his majestie, with consent forsaid, rescinds, cassis and annulls the forsaid act of parliament made in anno 1633 anent the annexing of his majesties' proppertie and the superiority of kirklands to the croun, being the tent act of the said parliament, and als the thretteinth act of the said parliament holden be his majesties' father in the said yeer 1633 entituled, anent the regalities of erection, and the fourteinth act of the said parliament entituled, anent the superiorities of kirklands, and all other acts of parliament whatsumever with all that hes followed therupon, in sua far as the samen concernes or may be extendit to the said lordship, barronie and regality of Mussilburgh, comprehending the lands, kirks, teinds, patronages and others abovementioned, and may prejudge the said Johne, earle of Lauderdale or his predicessours, their rights of the same, and in spetiall his right of the regality and baillierie of the said lordship and right of the superiority of the vassalls of the same (excepting as said is) and in sua far as the vassalls of the said lordship may pretend to hold their proppertie of his majestie or to have any other benefite be the saids acts, without prejudice alwayes of the saids acts. Lykas it is declaired that the saids acts shall stand and be of force in so far as they are or may be the grounds of the said infeftment granted be his majesties' father to the said earle, his father, in anno 1641, and of any infeftments which shall be granted be his majestie to the said Johne, earle of Lauderdale or his forsaids, upon the dissolution contained in this present act or otherwayes, and als his majestie, with consent forsaid, rescinds, cassis and annulls all charters, infeftments, gifts and grants or other rights whatsumever, made be his majestie his royall father or grandfather, with all that hes followed therupon, in sua far as the same may any wayes prejudge the said Johne, earle of Lauderdale his oune infeftments, his fathers or grandfathers infeftments of the said lordship, barronie and regality of Mussilburgh (excepting as is befor excepted). And siclyk his majestie, with consent forsaid, doth declare, statute and ordaine that the said Johne, earle of Lauderdale and his forsaids had, hes and shall have in all tyme heirafter, be vertew of the rights and infeftments forsaid and infeftment to follow heirupon, good and undoubted right to the said lordship, barronie and regality of Mussilburgh, comprehending the lands, kirks, teinds, patronages, office of baillierie and others abovementioned, and the superiorities of the vassalls of the said lordship (excepting as said is) and to the fewdewties, rents and other casualities of the same, notwithstanding the saids acts of parliament and saids rights, now rescindit in maner abovewritten, and als notwithstanding any other acts of parliament or generall lawes anent the disponeing of his majesties' proppertie or annexed temporality of benefices, or any other acts whatsumever made in this present parliament, or any other parliament of before with which his majestie hes dispenced and, be thir presents, with consent forsaid, dispences for ever; as also his majestie, for the reasons and upon the considerations abovementioned, with consent forsaid, of certane knowledge doth statute and ordaine that the forsaid charter and infeftment granted to the deceast Johne, earle of Lawderdale, be his majesties' royall father, upon the dissolution of the said lordship made the yeer forsaid, with all that hes followed therupon, shall be of full force and effect, notwithstanding that the pretendit parliaments in anno 1640 and 1641, and all pretendit parliaments holden therafter, are rescindit be ane act of this present parliament, with all acts of the saids pretendit parliaments. Lykas his majestie, with consent forsaid, hes declaired and, be thir presents, declaires, statutes and ordaines that the said infeftments and any other right and benefite granted and introduced to and in favours of the said deceast Johne, earle of Lawderdale or his said sonne, be any act or acts of any of the saids pretendit parliaments, shall be als valeid and effectuall from the date of the said infeftment, acts and rights, as if the said acts had been made in lawfull parliaments of undoubted and uncontroverted authority; and his majestie, with consent forsaid, ratifies the rights grounded upon the forsaid acts and all right and benefite compitent to the said earle of Lawderdale be the samen, and wills and ordaines thir presents to be effectuall from the dates of the said former pretendit acts, in the same maner as if ther wer severall acts aparte made in favours of the said earle of Lawderdale in the termes and of the tenor of the said former acts, and ordaining the same to be effectuall from the tyme forsaid, and inregaird this present act is made be his majestie and estates of parliament of certane knowledge and for and upon the causes and considerations forsaids, it is declared, statute and ordained, lykas his majestie, with consent forsaid, declares, statuts and ordains that the same doth not fall nor shall be comprehended under the act of salvo jure to be made in this present parliament, bot hes and shall have the force of ane generall law in all tymecomeing.
The which day Sir James Fouls of Colintoun, knight, and ane of the commissioners of this present parliament, protested that the act past this day in parliament in favours of Johne, earle of Lawderdale, his majesties' secretary, ratifieing his rights and infeftments of the lordship of Mussilburgh and of new dissolveing the same fra the croun, should nowayes be prejudiciall to the said Sir James Fouls, his airs and successours, anent the rights and securitys made and granted to him, his authors and predicessors of the patronage of the kirk of Haills or Colintoun, bot that the same rights and securities should stand in full force in all tyme comeing, notwithstanding of the said act, and as if the same had never been nor granted, and therupon asked and tooke instruments.

Our soverane lord, with advice and consent of the estates of parliament, considering that upon ane petition given in be Johne, earle of Lawderdale etc., sole secretary of state to his majestie for the kingdome of Scotland, to his majesties' commissioner and estates of parliament, mentioning that the time of the late troubles the said earle his writs and evidences of his lands and others wer totallie spoiled (except some few with the inventars of the most parte of the writs and evidents written be the deceast earle of Lauderdale his oune hand[)] and that be putting and hyding of them under the ground in the yeard of Balcarras, wher the underwater came throw the seems of the yron chists wherin they wer put, and spoyled the saids writs; and therfor, craveing that his majestie and estates of parliament would be pleased to grant commission to some of their number to take tryell anent the realitie of the loseing and spoileing of the saids writs, and of the maner of the spoileing thairof and what occasioned the same, and to find out the best expedient for supplieing of the saids writs and evidents as are spoiled and not extant, and to doe everie thing requisite theranent, as the same more fully proports.
Ane commission wes accordinglie given to the persones therin mentioned, being tuo of each state videlicit, the earle of Loudoun, the Lord Duffus, Sir James Lockhart of Lee, knight, Sir Peter Wedderburne of Gosfoord, Sir Robert Murray, provest of Edinburgh, and Johne Bell, provest of Glasgow, sex of their number, and Sir Archibald Primerose, lord clerk register supernumerarie, and that the saids commissioners, haveing given in and returned their report of their proceidings and judgement concerning the premisses, beareing that they haveing diverse tymes met and conveined be vertew of the said commission and severall of the said earle of Lawderdale his friends, commissionat be him for oversieing his affairs, haveing produced befor them diverse inventars written be the said deceast earle of Lawderdale, father to the said Johne, now earle of Lawderdale, [in] his oune hand of the said earle, his writts and evidents of the lands, liveing, lordships, barronies, regalities, patronages, teinds and others perteaneing to him mentioned in the saids inventars, and that the said earle of Lawderdale his freinds haveing also produced befor them diverse famous witnesses for proveing of the spoileing and loseing of the saids writs and evidents in maner and upon the occasion forsaid, and also for proveing of the saids inventars to be written be the said deceast earle [in] his oune hand, and for that effect having produced severall missive letters written be the said deceast earle [in] his oune hand for proveing and cognosceing of his said hand writ, and that the saids commissioners, haveing receaved, sworne and examined the saids witnesses and haveing seen and considered the saids inventars and the deposition of the saids witnesses, they find it sufficiently proven that the saids writts and evidents wer put under the ground in the yeard of Balcarres in three yron chists in the yeer 16[...] yeers after the feight of Dumbar, and that the same have been totallie spoiled and losed be underwater comeing in throw the joyneing and seems of the saids chists (except a few therof and the saids inventars) and that it is sufficiently cognosced and proven be the saids depositions and missive letters that the saids inventars are all written with the said deceast earle of Lawderdale his oune hand, and that inrespect of the premisses and of the other adminicles undermentioned produced befor them be the saids freinds and commissiors of the said Johne, earle of Lawderdale, videlicit, ane charter ynder the great and privie sealls in favours of the deceast Johne, lord Thirlestane, chancellour of Scotland, grandfather to this present earle of Lawderdale, in lyverent and to the said deceast earle, father to this earle, in fie, dated the sevent day of March 1593 yeers, with the instrument of sasine following therupon of the date the first of Aprile 1594 yeers, together in lykmaner with this present earle of Lawderdale his retour to the said deceast earle his father, of the date the fyft day of September 1649 yeers, which charter, infeftment and retour forsaid, being seen and considered be them, they find that the same doe containe and comprehend the said earle of Lawderdale, his saids lands, lordships, barronies, regalities and others forsaids for the most parte, and seing it is notour that the said earle, his deceast father, wes ane understanding nobleman of eminent and unquestionable integritie, so that it cannot be doubted but that the whole writs contained in the saids inventars wer extant when he made and wrote the inventars of the same with his oune hand; therfor, and for supplieing of the want thairof, it is their opinions that ther be ane act of parliament made wherin the saids inventars should be verbatim insert, and which should be of the tenor aftermentioned of this present act.
And his majestie and estates of parliament, having taken to their consideration the said report and grounds thairof, thairfor his majestie, with advice and consent of the saids estates of parliament, hes allowed and approven and, be thir presents, allow and approve the report forsaid, and for supplieing the want of the said earle of Lawderdale his writts and evidents spoiled and lost, upon the occasion forsaid, his majestie, with advice and consent forsaid, hes declared, statute and ordained and, be thir presents, of certane knowledge upon and for the causes and considerations forsaid, after mature deliberation, declars, statuts and ordains the forsaid inventars (whairof the tenors followes and are verbatim heirafter insert) or extract of this present act to be als valeid, effectuall and sufficient, authentick and forceable, and to make als great faith in judgement and outwith the same in tyme comeing, in sua far as the words of the saids inventars proports, for intenting of persutes, founding of exceptions and other alledgeances therupon, instructing of services, satisfieing of productions in reductions and improbations, and in all other actions, and to all other effects, ends and purposes, as if the principall evidents wer extant of the dates, tenor and contents mentioned and exprest in the saids inventars.

Inprimis, a charter under the great seale granted be Robert the first Joanni filio quondam Joannis filij Nigelli of the land which pertained to Allan Law Suche,† with the pertinents in Mertoun, tuo husband lands and tuo coat lands in Newbiging, the maynes which wes Johne of Ballioll's, called Lawflats, the halffe of the walke milne which belonged to the said Johne Ballioll, and the land which wes Issach Rutherfoord's in Newbiging, with the pertinents within the constabularie of Lawder faciendo servitium dominorum† architenentiam in exercitu nostro, dated apud Melrose, 8 Junij, anno regni undecimo. Inventar of evidents which concerne the baillierie and lordship of Mussilburgh shire. - Baillierie: Inprimis, charter granted be Robert, commendator of Dumfermling and convent thairof, of the justiciarie and baillierie of the haill regality of Dumfermling, alswell within the bounds of the toun of Mussilburgh as within the bounds of the haill lordship and barronie of Mussilburgh shire, and of all lands therof and others lands whatsoever lyeing on the south parte of the river of Forth, alswell proppertie as tennandrie etc., with 100 marks of fie to be uplifted out of the readiest of the maills and fermes of the lordship forsaid to James, earle of Mortoun, regent and to his aires male and of tallie contained in his infeftment of the earledome of Mortoun etc., dated at Dumfermling 20 September 1574, containing a precept of sasine subscryved be the abbot and 12 munks and sealled with the common chapter seale. A warrand under the privie seale direct to Gawine, archbishop of Glasgow, chancellour, for expedeing a charter of the samen lands to the said George and Alieson, apud St Andrews, [---] May 1642. A precept of sasine upon the retour direct be Henrie and Marie, king and quein of Scots, direct to the baillies of Lawder to infeft George Wedderit, eldest uncle and nearest air male to the said wmqhile George Wedderit, younger, his brother sone, in the saids lands of Castillhill disponed, as said is be, King James the fyft to George Wedderit, elder and his spous Alieson Lawder, to whilk George, elder, William Wedderit succeided, whilk Williame begate the said George, younger. Inventar of evidents concerning the tenement of land with the yeard and croft lyeing at the eist porte of the burgh of Lawder bought from James Rolmanous and Issobell Wedderheid, his spous, for the summe of fyve hundreth punds at Mertymes 1634. - Inprimis, a charter granted be Johne Riddell, burges of Lawder, with consent of Margaret, his spous, to William Wedderheid, burges of Lawder, of a tenement of land with the croft and yeard, with the pertinents lyeing in the eistend of the said burgh upon the southside of the king's streit betuixt the lands of Patrick More on the north, and the land of Gilbert Lawder, called Greinlaw, on the south etc., sealled 17 May 1598. Note of Alexander Wilkeson his evidents of the Netherfeild of Pilmore brought be him to Lethingtoun, 5 July 1632. - A contract betuixt James Pringle of Gallowsheills and Archibald Wilsone in Pilmore, wherby Archibald is obleidged to pay to the said James betuixt and the thrid of May nixt, after the date of the said contract, the sume of one thousand punds, at the receipt whairof the said James Pringle is obleidged to sell, annalie and dispone to the said Archibald in lyverent and Thomas Wilsone, his sone, and his aires heretablie, all and haill the lands of Netherfeild, and to infeft them therin be charter containeing precept of sasine and seaseing following therupon, to be holden of the said James, his aires and assignayes in the lyk maner and forme as he holds the same of our soverane lord, and the said Andrew paying the thirle multers of his cornes as use wes of old, and at the recept of the money to receive the said Andrew to the possession of the land, excepting so meikle therof as is set in tack to Andrew Allane, and so meikle as Marie Borthwick, his mother, hes in her thrid for all the dayes of her lifetyme, and likewise that parte which wes wodset to William Herron and William Woddell unto the redemption thairof and fyve yeers after, whilk wodset the said James Pringle is obleidged to redeime betuixt the date of the contract and the feist of Witsonday 1612 yeers, and the date of the contract the 24 and 25 of January 1611, not registrat. Inventar of evidents concerning the lands of Wgstoun. - A contract and appointment made betuixt Johne, lord Thirlestane, chancellour of Scotland, and Dam Jean Fleyming, his spous, on the ane parte and James, lord Hay of Yester and his cautioners on the other, anent the alienation and heretable disposition of the lands of Wgstoun, 29 May 1591, registrat the same day. Charter of alienation of the lands of Wgstoun forsaid be the said James, lord Hay of Yester to the said Johne, lord Thirlestane and his spous, and the aires betuixt them, whilks failyeing his aires whatsomever, to be holden of the king waird, 22 July 1591, with the precept of sasine ingrossed, sealled and subscryved. A decreit of reduction of a ratification granted by me in my minoritie to umqhile George, earle of Dumbar, 17 February 1618. A band granted be the said William, earle of Douglas and Annandale, lord of Galloway, obleidgeing him and his aires and successors to infeft† upon three dayes warneing, William Maitland of Lethingtoun in the lands of the toun of Thirlestane and milne therof, howsoone he or his aires shall redeem the same from Alexander Forester of Corstorphine or his aires, and that als freely as he or his predicessours held them befor his resignation, sealled at Edinburgh, 7 August 1450. A reversion of the lands of the toun and territorie of Thirlestane and milne therof granted be the said Alexander Forrester of Corsterphine to the said William Maitland of Lethingtoun, upon the soume of sex hundreth merks, but prejudice of ane assedation of the saids lands and milne set to him be the said William for ten yeers after the payment of the said soume 10 August 1450 in a litle old box. Transumpt of the same reversion befor the lords of session subscryved be Mr James Mcgill, clerk of register, transumed 3rd March 1553. Transumpt of a tack of the toun of Thirlestane and milne therof set be William Maitland, lord of Lethingtoun and Thirlestane, to Alexander Forrester, lord of Corstorphine, for ten yeers from the day of the redemption of the lands for 24 libs yeerly 8 August 1450, transumed 28 May 1557. Regres of the said toun, lands and milne be King James the fyft under the privie seale, 3 July 1534, to Ritchard Maitland of Lethingtoun, pronevoy to the said William, with the discharge of the composition within it. The haill order of redemption conforme to the reversion forsaid be Ritchard Maitland of Lethingtoun from Alexander Forrester, frank tenenmenter, and James, his son, fiar of Corstorphine, and of the forsaid lands in January and February 1551 and Aprile 1552 wrapped in a paper. Diverse acts and letters in the said proces of redemption wrapped in a paper together. A reversion granted be Roger of Kirkpatrick to William Maitland of Ledingtoun of ane annualrent of 25 marks out of the lands of Ledingtoun, disponed to him be the said William, with consent of Johne, his sone and appeirand air, redeimable upon 500 marks etc., 18 August 1464. Inventar of evidents concerning the lands of Costertoun. - A nyntein yeer tack of the lands of Costertoun set to Mr James Balfour, persone of Flisk, and Margaret Balfour, his spous, be Mr Robert Pitcairne, archdean of St Andrewes, successour to the abbay of Dumfermling and heretable fiar of the saids lands, sealled and subscryved 18 Aprile 1565. Precept of sasine granted be the said Mr Robert to the saids Mr James and Margaret of the forsaids lands, sealled and subscryved, apud Edinburgh, 10 July 1566. Instrument of sasine following therupon, 18 July 1566, under the signe and subscription of Andrew Gray, notter publict. Procuratorie of resignation of the lands of Costertoun be Mr Robert Ritchardson, commendator of St Marie Ile in the hands of the abbot and convent of Dumfermling, in favours of Sir James Balfour of Pittendreich and his spous forsaid, sealled and subscryved, apud Edinburgh, 18 Novembris 1573. Instrument of resignation forsaid, 20 Novembris 1573, Mr Johne Mcculzean, notter therto. Procuratorie of resignation of the forsaids lands ad perpetuam remanentiam be the said James Balfour, prior of Charterhouse, and Grissell Balfour, his spous, in the hands of Johne, lord Thirlestane and Dam Jean Fleyming, his spous, their superiours, sealled and subscryved be them both at Edinburgh, 20 Martij 1590, with the instrument of resignation written on the bak, beareing date at Thirlestane Castle, 8 Aprile 1591, Thomas Young, notter therto. Discharge be James Balfour, prior of Charterhous, to Johne, lord Thirlestane, chancellour, and his spous forsaid, of the soum of eight thousand merks as price of the lands of Costerstoun condiscendit on be the contract of alienation etc., dated at Edinburgh, 29 December 1591, registrat the penult day. Mr Alexander Syme, advocate, his sasine of the lands of Costertoun [---] with the contract of wodset therof betuixt the said James Balfour and him, beareing the reversion upon the sume of three thousand and fyve hundreth marks reteired, unregistrat. Memorandum: to cause enquire of Sir James Balfour his sasine upon the originall few charter of the lands of Costertoun, either in the protogall of Mr Johne Mcculzeane or of Andrew Gray or elswher.
In ane parchment pock. - Ane extract out of the register of Dumfermling of Dam Jonet Beatoun, ladie Braixholme, her renunciation of her kyndnes and possession of the lands of Costertoun in favours of Mr James Balfour, persone of Fisk, beareing date at Burtie, the 16 Aprile 1565, extracted and subscryved be William Lumsdean, keeper of the register forsaid. Three particular discharges be the said Dame Jonet to the said Mr James of the summe of seven hundreth merks for her kindnesse forsaid, the first the 6 of May 1565, the second the 7 July 1565 and the thrid 25 February 1565. Discharge be Robert, commendator of Dumfermling, to Sir James Balfour of Pittendreich, heretable fewar of the lands of Costertoun, of all males, fermes, capones and other dueties whatsoever of the saids lands preceiding, the date therof 20 November 1573. Acquittance be Thomas Toscheat, chalmerland of Dumfermling, upon the recept of 500 libs for the composition of the few of the lands of Costertoun. Robert, commendator of Dumfermling his discharge to Dam Margaret Balfour of Burghlie, conjunct fier of the lands of Costertoun, of the few maills of the saids lands for the yeers of God 1580, 1581, 1582 and all yeers preceiding, at Halyrudhous, 5 March 1582. Note of ane appointment betuixt the tennents of Costertoun and of Sauchnow anent some faill and dovats casten in a peice of pley ground debateable betuixt the saids tuo touns, at Fallowhall, 27 Junij 1581. Letters of arreistment of the forsaid faill, truffs and dovats, 14 July 1581.
And becaus it is possible and probable that ther has bein bands for soumes of money, contracts and other writs containeing personall obleidgements, wodsets of lands and annualrents, compriseings and other incumberances proceiding upon the deids of the said Johne, earle of Lauderdale, his grandfather and grandmother, and his other predicessors above them and his authors, wherby the said earle and his estate may be troubled, though if the calamitie and losse forsaid of his saids evidents had not fallen out, without all doubt, renunciations, discharges and others writts would have been extant to cleir and purge all such incumberances, thairfore, for the said earle his farther security and without prejudice of the benefite forsaid, and supplieing of the want of the writs mentioned in the saids inventars in maner abovewritten, his majestie, with advice and consent of the saids estates of parliament, hes statute and ordained and, be thir presents, statuts and ordains the lords of session to direct and give warrand for generall citations upon summons at the instance of the said Johne, earle of Lawderdale, his aires and successors, against all persones haveing interest in generall (inregaird neither the persones nor the particular writts can be knoune to them) at the mercat croces of such shires, stewartries and regalities as they shall think fit, upon tuentie ane dayes warneing, and at the mercat croce of Edinburgh, peir and shore of Leith, upon threescore dayes for such as are out of the cuntrie, and against tutors and curators of minors, and to direct the lyk citation upon second summons, on sex and fiftein dayes respective, for production of all such writs, with certification that no persone or persons out of the cuntrie or duelling within the saids shyres and jurisdictions shall ever be heard to make use therof, bot that the same shall be null and of no availl if they failyie. And the saids lords of session are ordained and authorized be his majestie, with consent forsaid, to proceid and grant certifications and to give furth their decreits in favours of the said Johne, earle of Lawderdale and his forsaids, for all such writts as shall not be produced in maner forsaid.
