Wedderburne contra Alexander Home etc.

The king's majesties' commissioner and estates of parliament takeing to their consideration a petition presentit to them by George Home of Wedderburne shewing that he wes commissionat by the honorable committie of estates, upon the tuentie one day of November last bypast, to intromet with the rents of the lands belonging to Johne Home of Kello of the cropt [of] 1660 yeers and that, conforme to his warrand, he went to the lands of Kello and took aff the locks from the barne doores, and put on new ones and that, notwithstanding therof, Alexander Home, with Robert and David Homes his sonnes had broken up the saids barne doores and had disponed upon the haill cornes therin and intendit so to doe with the rest in the barne yeard, in contempt of authority. And therfor, craveing that the saids Alexander, Robert and David Homes might be secured in their persones untill they find sufficient caution to refound the saids cornes away taken by them, and desist from doeing the lyk in time comeing or troubleing him in prosecution of the said commission, as the said supplication at more lenth bears. And haveing heard the report of the commissioners appointed for bills, who did fullie and at lenth heare the saids Alexander, Robert and David Homes in the said mater and considered the merites of the cause, and fund that the cornes abovementioned belongs to Johne Home of Kello, fugitive, and therfor, the lord commissioner and estates of parliament hes ordained and ordeanes the saids Alexander, Robert and David Homes to restore and deliver the saids cornes to the laird of Wedderburne, and als ilk ane of them to enact themselffs and find caution under the paine of fyve hundreth merks Scots that they nor none of them shall trouble the laird of Wedderburne nor his servants in the prosecution of the said commission in tyme comeing otherwise nor be order of law, and ordaines letters etc.
