Supplicatioune of the heretours of the landwart parrosche of Perth

To the kingis most excellent matie and the honorable and hie court of parliament, the supplicatione of the heretors of the lands lyand within the landwart parochin of Perth, for themselves and in name and behalf of the remanent of his hienes subjectis having occasione to tred or resort to the said burghe of Perth

Humeblie schaweth,

That albeit be the law and practick of the land the commoune wayes and hie gaittis quherby his maties subjectis and utheris have acces and regres to and fra the royall burrowes of this realme for performing of their lawfull effairis sould no wayes be impedit nor stopit bot the samen aucht and sould be made patent and accessible to the effect foirsaid, nevertheles Andro Grant of Balhaggills, provest of the burghe of Perth, be himselff or with assistance of the bailyies and counsell therof, hes of lait cawsit imput and infix certane staikes or stowpes of great timber in the mids of his maties calsay and ordinar hie way within the Castell Gevill Port of the said burghe and be ane act hes dischairgit the haill inhabitantis therof to sell draff or muck to the supplicants, quhairthrow neather kairt nor slaid can have acces to the said burgh or regres therfra be that port for transporting of coalls, barrells of herring and all uther commodities requisite, with muck and fulyie for bettering of the supplicants lands nixt adjacent to the said burgh according to use and wont, howbeit that the said port hes bein continuallie of befoir ane ordinar passage quherby kairts and slaids went to and fra the said burgh to the effect abonementionat, and that the buying and transporting of the said muck not onlie occasiones the streits of the said burgh to be cleanlie bot also renders commoditie to the inhabitants therof, awners of the samyn muck, sua that the supplicants and all utheris his maties subjects having effairis to doe within the said burgh and the maist pairt of the inhabitants ar and wilbe exceidinglie damnified. This holds out sum privat interest in the said provest or disaffectione towards his neighboures and aucht not to be tollerat, being ane oppressione that calls for redres as contrar to the law and practik of the land, and tending greatly to the detriment of the subject. Besydis that if remeid be not provydit, the said provest be all probabilitie will doe the lyk in the remanent calsayes and hie wayes of the said burgh, and therfor it is humeblie supplicat that his matie and the parliament mey be pleasit to tak the premises to consideratione and witnes the samyn be granting warrand to ane maisser or messinger of armes to chairge the saids provest and bailyies of the said burgh of Perth personallie or at ther dwelling place, and the counsell therof be opin proclamatione at the mercat croce of the samyn burgh becaus they ar ane multitude, to compeir befoir his matie and the parliament or thair committie or befoir the committie of estates the xvij day of Junii in the hour of cawse etc. to ansuer to this complaint and to heir and sie the samen verefiet and proven, and the samen being verifiet and proven, to heir and sie sik punishment inflicted upon them in their persones and guids as such oppressione calls for. As alse to hier and sie them decernit with all diligence to lift the saids haill stowpes or staikes imput in the foirsaid calsay, and to mak, keip and hald the samyn calsay patent and red in all tyme cuming as of befoir, and to annull and rescind the foirsaid pretendit act, and lykwayes to desist and ceis fra making any impediment to the supplicants or any utheris his maties subjectis quherby they mey not saiflie and frielie pas and repas to and fra the said burghe be the foirsaid port and calsay and remanent ports and calsayes therof with horses, kairttis and sleds or uther wayes to the effect abonewrittin, and for doeing of all utheres thair effairis within the samyn burghe at all occasiones according to equitie, reasone and the law and practick of the land.
