At Perth, the tuentie thrid day of December jM vjC and fiftie yeiris. The kingis matie and estaits of parliament, being verie sensibill of the dangerous and distressed conditione of this kingdome, and most desyreous according to the law of God and nature in discharge of there publict trust to wse all lawfull and necessarie meanes for the saiftie and defence of religione, his maties persone and royall authoritie, lawes and liberties of the kingdome aganis ane armie of sectaries who most wnjustlie and perfidiouslie, contrairie to the Solemne League and Covenant and treaties, have invaided and are by all actis of hostilitie destroying the same, thairfore hes statute and ordained that all fensible men within the shirefdomes of Fyiff and Kinross, Clakmanan, Stirling, Dumbartane, Argyll, Boott, Perth, Forfar, Kincardine, Abirdeine, Bamff, Murray, Nairne, Innvernes, Ross, Sutherland, Cromartie, Caitnes and Orknay cum to ane randevouze in the severall divisiones of ilk schyre respective, to be sett doun and appoyntit be the committies of war in ilk schyre according to the number of the regimentis eftirspeit, the haill heretors, noblemen, gentlemen and utheris to burcht and landwart, lyfrenteris, wodsetteris and all other fensible men betwixt thriescoire and sixteine, with all there horses fitt for service and there haill armes for horsemen and footmen (except such as ar excumunicat, forfeited, notoriouslie profane or flagitious, and such as have beene from the beginning and continew still or are at this tyme obstinat and professed enemies and opposeris of the covenant and caus of God) out of the quhilk haill number of fensible persones in ilk divisione all such as are vigorus and able men for war, are heirby appoynted to be drawin out and put in regiments as is eftirspeit with there best horses and armes, so many as are serviceable horses, and the rest on foott with ther best armes, twa pairt musquettis and thrid pairt pickis and all with swords, the horsemen to be armed with pistolls, hulsteris or syidpistollis or launces. The regimentis in ilk schyre to be as followis, viz: the shirefdome of Fyiff and Kinros, twa regimentis of horse, whairof the erle [of] Rothes and Lord Balcarras [colonels]; colonells of foott for the said schyre of Fyiff and Kinros, the erle of Craufoord, the erle of Kellie and the laird of Bogie; collonells of horse for Stirling, Clakmanan and Dumbartane, the Lord Erskine; colonell of foott for Stirlingschyre, Clakmanan and Dumbartane, the laird [of] Buchanan; colonells of horse for Perthschyre, the Lord Drumond and the laird of Adie; collonells of footte for Perthschyre, the erle of Atholl, the master of Gray and Williame Drumond, sone to the Lord Madertie; collonells of foote for Argyll and Boote, the laird [of] McLeane and the laird [of] Ardkinlas; collonell of horse for Forfar, the Lord Ogilvie; collonellis of foote for Forfar, the Lord Carnegie, the Lord Spynie and Lord Coupar; collonells of horse for Kincardine, Abirdeine and Bamff, the erle of Erroll and the erle of Marschall, with reservatione of ane troupe to the laird [of] Thorntoune; collonell of foote for Kincardyne, Harie Mauld; collonells of foote for Abirdeine schyre, the laird [of] Rothemay, the laird [of] Tolquhon, younger, and George Keith; collonell of foott for Bamff, the master of Bamff; the twa troupes out of Nairne, Murray and the laird [of] Grant's bounds to be commandit be the laird [of] Innes, younger; collonells of foote for Murray, Nairne and the laird [of] Grant's bounds, the laird [of] Grant and shireff of Murray; and the Lord Duffus to have those quhom the shireff of Murray is bringing out of the last leavie out of Murray; the laird [of] Kintaill for the erle of Seaforth's name and freinds; the laird [of] Balnagoun for his name and freinds; Sir James McDonald of Slaitt, knyght, for his name and freinds; laird [of] Lumlair for the name of Monro; the tutor of McCleud for his name; the laird of Lochyell, Dougall McPhersone and laird [of] McIntoshe or Lauchlane McIntoshe, his brother, for Badyennoch; [...] McRanald, tutor of Kapech, for his freinds and name; the laird [of] McInnen for his name and freindis; the erle of Sutherland for Sutherland; Frances Sinclair for Caithnes; [...] McKay, brother to the Lord Rea, or Hew McKay of Scaurie for Stranaver; [and] Sir James Douglas for Orknay and Zetland. And that it may be knowne that the haill men forsaid to burgh and landwart cum to the forsaid randevouze in ilk divisione of the saids schyres, it is appoynted and earnestlie recommendit to the ministeris of ilk parische within or without burgh with the commissioner of the parische (or where there is no present minister, twa of the elderis) be present at the said randevouse with the list of the haill men betwixt thriescoire and sixtein within there parische, attested be them to be ane trew list, and delyver the same to the collonell. And siclyke it is appoynted for cognosceing who are vigorus and able men to be drawin out and regimentit as said is, that the collonell of ilk divisione with the persones eftirnamit, viz: for the twa regimentis of horse in Fyiff and thrie regimentis of foott, the erle of Louthiane, Lord Humbie and laird of Niddrie; for the shirefdome of Clakmannan, Sir Alexander Belsches of Toftis; for the shirefdome of Stirling, Collonell James Rae and Lord Clerkingtoun; for the shirefdomes of Argyll and Boott, [...]; for the shirefdome of Perth, the erle of Cassillis, the erle of Roxburgh and Robert Hepburne of Keith; for the shirefdome of Forfar, the erle of Buccleughe, Lord Yester and laird of Collingtoun; for the shirefdome of Kincardine, Sir James Murray of Skirling, knyght; for the shirefdome of Abirdeine, the erle of Dumfermling and the laird of Balmaine, the laird of Pittarro and laird of Jonstoun Barclay; for the shirefdome of Bamff, Colonell Johne Innes; for the shirefdome of Elgin and Nairne, Sir Alexander Abircrombie of Birkinboig, younger, knight; who, with the said collonell, shalbe judges of the abilitie and sufficiencie of men and horse. As also that they tak caire to sie them weill armed, and whaire ther are any armes wanting, it is appoynted that the heretors in quhaes bounds the saids persones wanting armes are shall bring money with them to buy armes, which wilbe had at the rates following, viz: nyne pundis for eache musquett and bandeleir, thrie pundis money for ilk pick, fourteine punds money for ilk paire of pistolls, ulster and spanner. It is heirby lykewayes recommendit that the horsemen bring all the bak breistis and heid peices which can be had. It is also statut and ordained that the haill heretors, noblemen, gentlemen and utheris persones sua to be drawin out for the feilds from burgh or landwart shall bring with them fourtie dayes provisione in victuall or money in maner eftirspeit, viz: the sherefdomes of Fyiff, Clakmannan, Stirling, Perth, Forfar and Kincardine shall bring out and carie to Stirling for ilk man, horse and foote sua to be brocht out the quantitie of three furlettis aitt meall. And the shirefdomes of Abirdeine, Bamff, Murray, Nairne, Innernes, Ross, Sutherland, Cromartie, Caithnes and Orknay to bring out als mutch meill as will bring them to the generall randevouze. And further ordanis the saids shirefdomes of Abirdein and Bamff to bring with them als mutch meill as will serve them ten dayes eftir the day of the generall randevouse, togidder with sex pund, fyfteine shillingis to be givin to the generall commissar for provisione of threttie dayes further. And the remanent schyres benorth the water of Spey, viz: Murray, Nairne, Invernes, Ross, Sutherland, Cromartie, Caithnes and Orknay to bring with them als mutch meill as will serve them to the randevouse and fyve dayes thaireftir, togidder with sevin pund, sevintein shillingis, sex pennies to be givin to the generall commissar for threttie fyve dayes provisione. Further, the shirefdome of Dumbartane, Argyll and Boote to bring for ilk man thrie furlettis meill to the castell of Dumbartane. The dayes appoynted for the randevouze in ilk schyre and divisione theroff are as followis, viz: the randevouse of the schyre of Forfar to be upon the secund day of Januar nixt jM vjC and fiftie ane yeiris; the randevouz of the schyre of Kincardine to be upon the thrid day of Januar nixt; the randevouze of the schyres of Abirdeine and Bamff upon the sext day of Januar nixt; the randevouze of the schyres of Murray and Nairne to be upon the nynt day of Januar nixt; the randevouze of the schyres of Innernes and Ross to be upon the fourtein day of Januar nixt; the randevouze of the schyres of Sutherland and Caithnes to be upon the sixtein day of Januar nixt; and the randevouze of the schyre of Orknay and Zetland to be upon the tuentie day of Januar nixt. From the quhilkis randevouze the said vigorus and able men so regimented and armed as said is, horse and foott, are to marche to the generall randevouse as the king and parliament and those haveing power from them sall appoynt. And to the effect that no tyme be lost, it is heirby appoynted and ordained that the committies of war in ilk schyre with uther considerable heretors meit and, with advyse and consent of the collonells, mak choyse of the liuetenant collonells and majors to each regiment such as shalbe approvin be the generall officeris. And lykewayes that they, with consent of the collonells respective, mak choyse of capitanes, liuetenants, cornettis and ensignes and designe the divisiones and places of the randevouze for eache regiment. It is heirby appoynted that where the heritors are either minors, aiged or infirme, they sall send out there best horse with ane able man and sufficient armes in ther awin places. And lykewayes that all moneyed men and utheris who are able to outreik themselfis on horse or foott weill armed shall cum out with fourtie dayes provisione as said is and put themselfis in troupes and regimentis quhaire they can doe service. And becaus there wilbe many men of meane rent who will have many able men wnder them to cum out in this service, and siclyke many poore men in brughes, it is therefore statute and ordained that, for there releiff and bettir supplie, they may have recourse to the committie of war in ilk schyre, who shall lay on the expenses of the forsaid fourtie dayes provisione wpon the haill schyre according to the valued rent; and that the doeing thereof be no retardment to the present outcuming of the regimentis. With certificatioune if any noblemen, gentlemen, heretors, wodsetteris, lyfrenteris and utheris either to burgh or landwart shall not cum according to this present act as they are heirby ordained, they shalbe esteemed infringeris of there covenant, neglecteris of the defence of religione, king and kingdome and punisched by death, infamie, confiscatione of there moveables and forfaltor of the thrid pairt of the haill rest of ther estate. And the kingis majesttie and parliament heirby expreslie dischairges any persone that they presume not upon their march from their awin schyres to tak frie quarters or intertainement aither for horse or man, bot to pay for the same as they answer at ther hiest perrell.
