The estaits of parliament, now presentlie conveined in this fourt sessioun of the second trienniall parliament be vertew of the last act of the last sessioun thairof, taiking into thair consideratioun the 50 act of the king's maties second parliament holdin at Edinburgh in anno 1641, intitulat 'Act anent the electioun of the president of parliament', togidder with the 42 act of the last sessioun of the first trienniall parliament of the dait at Edinbrugh, the tuentie sevint of Mairch 1642, intitulat 'Act anent the electioun of a president of parliament for ilk sessioun of parliament', explaining the former act concerning the tyme of indurance of the president of parliament, according heirunto, Johne, erle of Loudoune, heich chancellor of Scotland, president of the last parliament, having ministered the oath of parliament [to those] present and represented to them the tuo acts of parliament abonementionat, whilk wes red in parliament, the estaits of parliament, eftir voyceing, did ellect and choyse Johne, erle of Loudoune, heich chancellor of this realme, to be president of this sessioun of parliament and to proceid thairintill as president of parliament during this sessioun of parliament ay and whill the taking of the oath of parliament and ellectioun of another president in the nixt sessioun of parliament, conform to the foirsaid act of parliament of the dait the 27 of March 1647.

The quhilk day in presence of the estaits of parliament now presentlie conveined compeirit personallie Archibald, merqueis of Argyll, for himselff and in name of the remanent commissiouners for the thesaurerie, and exhibeit and producit the honors, viz: the croune, scepter and sword in face of parliament, and upon productioun thairof, askit instruments; which honors wer immediatlie thaireftir delyverit be warrand and at command of parliament to Arthur Erskine of Scotiscraige in name of the erle of Mershell, wha receavit the samyne and therupon askit instruments.

The quhilk day, eftir calling of the rollis of parliament, compeirit personallie George Hay of Nauchtoun and [...] of Fingask, commissiounars appointit for the shirefdome of Fyff, and protestit that the calling of the commissiouners of the shirefdome of Edinbrugh befoir them sould not prejudge the said shyre of Fyff in thair place in ryding, voyceing and sitting in parliament, and thairupon askit instruments. Lykas Mr George Winrahame of Libertoun, ane of the senators of the colledge of justice, and Sir Johne Wauchop of Niddrie, knyght, commissiouners for the said shirefdome of Edinbrugh, protestit in the contrair.

Having considerit your maties letter to the committie of estaits, approved the last sessioun of parliament, togidder with the relatioun made to ws be our commissiouners, we cannot bot with all humble thankfullnes acknowledge your maties gratious acceptance of the affectioun and fidelitie of this kingdome and the confidence your matie hes of the loyaltie and candor of our intentiouns, whairof our actiouns shall be most reall evidences. And albeit thair be substantiall grounds and expressions in your maties lettere whairwith we are nowayis satisfied and to which we cannot give our assent that they sall be the subject of a treatie, as will be moir fullie represented to your matie by our commissiouners eftirspeit: [...]†, yit, to witnes the sinceritie and constancie of our affectiouns and that thair is no earthlie thing we desyr with so much earnestnes as to have a richt undirstanding and perfyt agriement betuixt your matie and this your ancient kingdome for establishing your maties royall governement in your dominiouns upon richt principls of puretie and richteousnes for secureing of religioun (which are the onlie best and surrest pillars of your throns), we have sent commissiouners to wait upon your matie at Breda for prosecuting of our former desyrs present to your matie at the Hague by our commissioners. We have no pleasor to remonstrat the dangerous consequencis which most neids eschew upon the lose of oppertunities by delaying or denying the just and necessar desyrs of your maties most loyall and faithful subjects so often presented to your matie, the many prejudices which doe therby aryse to religioun and the work of reformatioun, your owne sad conditioune and the bleiding state of your languishing kingdoms and the great and many advantagis which your enemys gaine by your maties irresolutiouns speak moir nor we are able to expresse. Bot if your matie shall yit be pleasit to harkin to the humble and faithfull advyse of this kingdome, grant our just and necessar desyrs and joyne heartelie with God and your people in the Solemne League and Covenant, it will by his blissing be the most powerfull meane to raise your matie out of your low conditioun and encourage ws with all alacritie and willingnes not onlie to render to your matie that subjectioun and obedience which is dew from loyall subjects, bot will lykwayis oblidge ws and this wholl natioun with our utmost endevors to be reallie servicable according to our covenant for restoring your matie to the peaceable possessioun of the government of your other kingdoms according to your maties undoubtit richt of successioun, and that your matie may have a happie and prosperous rigne sall be the earnest desyr of your maties most humble most faithfull and most loyall subjects.

The estaits of parliament, presentlie conveined in the fourt sessioun of this second trienniall parliament, having resolved that, in prosecutioun of thair former desyrs, commissiouners sould be sent to his matie, and haveing sufficient proofe and experience of the faithfullnes, good deservings and abilities of the richt honorable Johne, erle of Cassills, Williame, erle of Louthian, Alexander Brodie of that ilk and Mr George Winrahame of Libertoun, tuo of the senators of the colledge of justice, Sir Johne Smith and Alexander Jaffray, doeth thairfoir nominat, appoint, authorize and give power to the foirsaid persouns being all present togidder and to any four of them (bot incaice of seiknes, returne or necessarie absence of the rest, to any thre of them) to repair to the king's matie at Breada or whair he shall happin to be within the United Provincis or thair dominiouns, or to any uther place whair the reformed religioun is professed or tollerated, and thair to treat with his matie upon the grounds of the former desyrs presented to his matie at the Hague be the commissiouners of the parliament of this kingdome according to the Solemne League and Covenant and the instructiouns which are givine or heireftir sall be givine by the parliament or thair committies (not being contrarie to these now givin by this parliament to them) in pursuance of these ends, firm and stable holding whatsumever sall be done by them, conform to the said instructiouns.
