The estaits of parliament, taking to thair consideratioun that the place of generall of artaillerie is now vacand through the sentance and deprivatioun laitlie pronuncit aganis Colonell Alexander Hamiltoun, lait generall of artaillerie, and considering that Colonell James Weymes hes bein brought up from his youth in militarie affairs, and speciallie in the pratick of ordinance and artaillerie, and that he hes givine sufficient proof of his skill, experience and abilities for dischairging of the said office, thairfoir the saids estaits of parliament have nominat and appointit and be thir presentis nominats and appoints the said Colonell James Weymis cheiff generall of artallarie and maister of the ordinance, arms and amonitioun within this kingdome of Scotland during all the dayis of his lyftyme, and ordanis the said generall [of] artillarie to mak just inventar of all cannons, guns, amonitione, pouder, match, ordinance great and small or uthers whatsumever thairto belonging [and] perteining to this kingdome, to the effect the said generall [of] artillarie may give to the estaits of this kingdome trew informatioun of all the warlik instruments within the said kingdome perteining to the same, and that the said generall of artillarie doe all and sundrie uther things tuiching the premises which the former generall of artillarie or maister of the ordinance and amonitioun at any tyme bygane did use and exerce as he sall think fitt and expedient. Lykas the saidis estaits of parliament givs and grants full powar and authoritie to the said generall [of] artillarie be himselff and his deputs (for whom he shall be anserable) to visit, vew and tak inspectioun of all cannons, guns [and] ordinance alsweill great and small within the haill schips of this kingdome of Scotland, with powar and authoritie to them to tak speciall assurance, cautioun and securitie from all maisters and mariners of the saids schipps caring cannon, guns and warlyk furnitor and instruments of quhatsoevir kynd, that when they shall goe to forraine pairts and tarritories they shall not annailie any of the saidis cannone, guns and warlik instruments to strangers or whatsumever uther persone duelling or heaving thair residence without this kingdome, bot that upon thair saife returne from thair voyagis they shall bring and report the said cannone and guns to this kingdome and give accompt thairof to the said generall commissioner [of] artillarie and his foirsaidis, that any scruple anent the alienatioun thairof may be removed, and that under the paine of confiscatioun thairof as shall be thought fitt and expedient thairanent, the ane halff therof to apperteine to the saids estaits and the uther halff to the said generall of artillarie and his foirsaidis. In consideratioun of the quhilks premises and for the great treavell and expenss to be had be the said generall [of] artillarie in attending the foirsaid service, the saids estaits have givine and grantit and be thir presentis givs and grantis to the said generall [of] artillarie ane yeirlie fie of tuentie four pundis Scots to be payit to him and his assignis foirsaidis at tua terms in the yeir, Witsonday and Mertimes be equall portiouns, beginand the first termis payment therof at the feist and terme of [...], and sua furth yeirlie and termlie thaireftir at the saids terms and be equall portiouns; and ordanis the lordis commissiounars of the thesaurie, the lordis of exchecker and receavers of his maties rents for the present and in tyme coming that they mak payment to the said generall of artillarie and his foirsaidis of the said yeirlie fie of tuentie four pundis Scottis money foirsaid during the space abonewrittin at the terms of payment abonementionat, and ordanis the auditors of the said exchecker accompts upon sight heirof to allow the samyne to the payers therof in thair accompts. As lykwayis they command all and sundrie captains, keipers and constabls having chairge of castles and fortes that they and everie ane of them anser and attend and obey the said generall [of] artillarie in all and everie thing tuiching the premiss at all tyms and als oft as they shall be requyrit by him thairto, and that undir all hiest paine that they or any of them can committ or incur thairthrow. And sicklyk the saidis estaits have givin and grantit and be thir presentis givs and grantis to the said Colonell James Weymes the said office of generall [of] artillarie with all honors, dignities, liberties, fies, cassualties and uthers belonging thairto alse frielie in all respectis as the said Colonell Alexander Hamiltoun hes bruikit and possessed the samyne in any tyme befoir during all the dayis of his lyftyme, and ordanis the director of his maties chancellarie to cause writt ane gift to the said Colonell James Weyms of the foirsaid office heirupon undir the great seall, and to the lord chancellar for causing append the said great seall therunto without the passing of any uther sealls or registers.

The estaits of parliament, haveing hard the suplicatioun givine in to them be Gideon Jack, baillie of Lanerk, schewing that he being within the brugh of Lanerk the tyme that the army undir the command of James Grahame wes in that pairt of the countrie, and they having conveined at thair committie at Lanerk, did send for the suplicant to reid thair declaratiouns, threatning to send him along to James Grahame if he did refuis; wha did refuis and by God's providence escaped thair handis, wes necessitat to flie himselff to the toune of Air and eftirward to Cairlill and nixt to Bervick and thaireftir to Philliphauch, and came to Lanerk with some of the saidis estaits of parliament present, his wyff, ten childrine and fyve servands, with six horse, fled to Portpatrik whair they leived ten weiks at great chairgis; and the enemy, finding he wes escaped, brack up his doors and his kistis, plundered and tuik with them his linnings, bedclothis and uther plenishing being thairintill and brunt his coffers and kists, dressors and uther plenishing; as also eat and distroyit tuentie bolls threshin, eats four stacks aitts, pies and hay, tuik away his beiff, meill and uther vivers out of his sellars. As also the tyme of the unlaufull Ingadgment, he having chosine raither afflictioun then to joyne in the unlaufull cause, fled himselff from his famellie, thair quartered upon him ane liutenent and ane corporall the space of tuentie days, wha brought in with them somtyms six and somtyms eight to breakfast, denner and super, with thair horse, with sex pundis ilk day by ther intertainement als long as his wyff had intertainement to give them, who wes forcit to disperse hir famellie four sundrie places. And lykwayis the said army undir James Grahame brack up his house in Braxfeild, plundered the same and banished away his servands, seased upon his horse and uther bestiall, distroyed his corns, medows and cuttit his young planting. And sicklyk the tyme of the unlaufull Ingadgment his saidis house in Braxfeild wes againe brokine up and his guidis therin plundered, and remanit thair fyve weiks, eating and destroying of his corns, medows and cuttit and distroyit his wood and planting thair, whairthrow by thir great lossis and sufferings the suplicant can scarce get intertainement for his famellie and is damnified thairthrow in the soume of tua thousand, fyve hundreth tuentie four pundis, sex shillings, eight pennys, as the compt of the particulars beirs. And also thir ten yeirs bygane the suplicant hes bein still on[e] of the committie of estaits and did attend dilligentlie thairupon and had nevir receaved (aither for himselff, his man or his horse) ane penny aither from the publict or the toune of Lanerk, albeit the suplicant hes bein at great chairgis thairby. Thairfoir humblie suplicating the saidis estaits of parliament seriouslie to consider the great lossis and chairgis the suplicant hes bein put to for himselff and his famelie, and how oft he hes bein minassed for being contrair to the late unlaufull Ingadgment, and to provyd some way for his reparatioun as the saidis estaits should think fitt, and in the meantyme, till reparatioun be maid, to exeime the suplicant's rowme in Braxfeild from mantinance, quarterings and outreik of horse and foot, as at mair lenth is conteinit in the said suplicatioun. Quhilk, with the report of the committie of bills maid thairanent, being takine in consideratioun, the saidis estaits of parliament finds that the suplicant's conditoune is verie hard and that his sufferings hes bein exceiding great, occasioned for his constant affectioun to the cause and covenant, whairof he hes givin ample and sufficient testimonie; and thairfoir hes recommendit and seriouslie recommends the suplicant to the committie of moneys, that present and effectuall course be takin for his satisfactioun of the soume of tua thousand, fyve hundreth tuentie four pundis, sex shillings, eight pennys of losses and damnage susteined be him in maner abonewrittin, the samyne being instructit to the said committie; and als that consideratioun be takin of the great chairges and expenses he hes bein at thir tuo yeirs bygane in attending the meittings of parliament and committies and no satisfactioun givin to him aither be the publict or the said brugh of Lanerk thairfoir, and that the same be refoundit to him in some anserable way according to his attendance and fidelitie.
