The estaits of parliament, now presentlie conveined in this thrid session of this second trienniall parliament, taking to thair consideratioun the great soums of money restand awand be the publict to Colonell James Campbell of Lawers and being maist willing that he sould be payit and satisfied thairof, doe by thir presentis give power to him to sute and recover payment of sick soumes of money as shall be fund restand awand in the handis of any of the collectors of the monthlie mantinance, taxt, loane, tent and tuentie penny and uther publict dews restand of the shirefdome of Perth or any uther shyr or brugh of the kingdome preceiding the month of November last by past, quhilk is also heirby ordainit to be payit to the said laird of Lawers in pairt of his arreirs and whois dischairge and aquittance is declairit heirby to be ane sufficient aquittance and exoneratioun to the saids collectors and everie ane of them. Lykas the commissiounars nominat and appointit for tryell and examinatioun of the accompts of the saidis collector of the shirefdome of Perth are heirby requyrit to use all diligence for fitting of the saidis accompts conforme to thair commissioun grantit theranent, and caus mak payment to the said laird of Lawers (or any having his ordor) of sick soumes of money as shall be fund restand in thair hands at the fitting and cleiring of the saidis compts in pairt of payment of his arreirs. And als considering that Sir Adame Hepburne of Humbie, knyght, leat collector generall of the taxt and loane and of the first sevine months mantinance of the said shyr, did tak band fra the collectors thairof that they sould mak payment to him of the samyne and that it is requisit that the saids bandis be assignit and delyverit be him to the said Colonell James Campbell of Lawers, the saidis estaits of parliament doe heirby give warrand and command to the said Sir Adame Hepburne to assigne and delyver to the said Colonell James Campbell the tua obligatiouns undirwrittin, ane thairof is grantit to him be Johne Oliphant of Bachiltoune, collector of the taxt and loane, and the uther be Robert Murray of Buchintie, collector of the first sevine months mantinance, with warrandice fra his awine deid in sua far as he hes not hithertills receavit compt, reckoning or payment fra the saidis collectors or any of them. And in regaird that the great soums awand to him for his service in Irland and the soume assignit to him for his losses to be payit to him be the parliament of England are ineffectuall and desperat, and that thair wes precept givine of befoir be the parliament in anno 1647 yeirs and renewed againe in anno 1648 for payment of the soume of fourtie thousand merks in the first end of the said soume of fourscoir auchtine thousand pundis Scottis money due to him as his arreirs for his service in this kingdome, and als in respect of the said laird of† Lawers, his urgent necessitie and long lying out of the soume foirsaid and present conditioun, being under great burdeins and disable as said is, the saidis estaits did thairfoir ordaine the foirsaid soume of fourtie thousand merks (whairfor precept wes givin and renewed in maner foirsaid), with the soume of tuentie thousand merks farder, extending the saids tua soums to the soume of fourtie thousand pundis Scottis, to be payit to the said Colonell James Campbell of Lawers and that in the first end of the foirsaid soume of fourscoir auchtine thousand pundis of arreirs due for his service in this kingdome. He creaved that the saidis estaits of parliament wold be pleased to mak the former wayis and meins appointit be thame effectuall for his payment of the foirsaidis soums, as at mair lenth is conteinit in the said suplicatioun. Quhilk eftir reiding thairof in face of parliament, being remittit to a select committie, who having reveised ane list conteinit in ane act of the last sessioun of parliament daitit the nynt of Mairch jM vjC and fourtie nyne yeirs of certaine persouns for lening of money for the wse of the said Colonell James Campbell of Lawers, the said committie, eftir reveising therof, did condiscend and agrie wpon ane list for the use of the said Colonell James Campbell of Lawers and reportit the samyne back to the parliament. Quhilk being thaireftir takine in consideratioun be them, the saidis estaits of parliament doe heirby appoint such persouns according to the foirsaid list conteinit in ane act of the dait the tuelff of this instant conceaved in favors of the said James Campbell† of Lawers or that shall be givin in be him to the saidis estaits or thair committies and sall come undir the compas of the act maid in the last sessioun of parliament anent persouns fra whom moneys sall be borrowed or that sall be fyned [or that] sall len money wpon the publict faith and have the lyk securitie as sall be givine to uthers fra whom moneys sall be borrowed be the publict. And what sall be gottin fra the foirsaid persouns listit or to be listit for the use of the said Colonell James Campbell of Lawers, the ane halff therof to apperteine to the publict and the uther halff to the said Colonell James Campbell for payment to him of the foirsaid soume of fourtie thousand punds, and ordanis him to be payit of the samyne out of the first and rediest of the saidis soums swa to be borrowed, and that non be preferred to nor have the benefeit of the foirsaid list or soums to be borrowit from the foirsaidis persouns thairinconteinit, bot onlie the said laird of Lawers till first he be satisfied of the foirsaid soume of fourtie thousand punds. And to the effect the foirsaid act and list givin or to be givine for the use of the said Colonell James Campbell of Lawers may be maid effectuall to him, thairfoir the saidis estaits of parliament ordanis citatiouns to be maid and direct at the instance of the said publict aganis the saidis persouns continit in the list givin or to be givine for the use of the said Colonell James Campbell of Lawers, and that wpon the expenses of the publict for summonding of them to compeir befoir the saidis estaits of parliament or thair committees appointit or to be appointit for moneys, to heir and sie them decernit aither to len furth soums of money or wndergoe such fyns as sall be thought fitt to be imposit upon them be the saidis committies, conforme to the tennor of the foirsaid act of parliament. And the saidis estaits of parliament hes ordainit and ordanis that any soums of money which sall happin to be borrowit from any uther persouns by and attor the list givin or to be givin in for the said laird of Lawers, his particular wse and continit in the foirsaid act conceavit in his favors, the samyne sall be imployit for payment of Doctor Sharp, [his] relict in the first place, Lawers in the second place and Glonwrquhy in the thrid place and the laird of Auchinbreck in the fourt place, so as they are to have preference of payment out of the moneys to be borrowit befoir any uthers, according to the ordor and maner foirsaid; but prejudice to the said Colonell James Campbell of Lawers to sute and recover payment of the foirsaidis soums of money fra the generall commissar out of the superplus of the mantinance and excyse, which sall be ovir and above the intertainement of the army, incident chairgis and debtis awand to the generall commissar and be the wayis and meins preseryvit and assignit to him be the former act of parliament grantit in his favors for payment of the foirsaids soums of money respective and annuell rents therof of all yeirs and terms during the not payment of the samyne eftir the forme and tennor of the foirsaidis actis of parliament grantit to him theranent, quhilks actis are all heirby ratified and approvine. And the estaits of parliament, having considerit thair former act of parliament maid for the yeirlie impositioun towards the mantinance of six ministers and the declaratioun and provisioun therincontenit, and being werie willing that the good toune be weill furnished with a sufficient number of able and weill qualified ministers, doe thairfoir with the augmentatioun of the annuitie eftirspeit ratifie and approve and confirme the said act of parliament, quherof the tennor followis: At Edinburgh, the second day of Mairch the yeir of God jM vjC and fourtie nyne yeirs. The estaits of parliament, now presentlie conveined in the second sessioune of the second trienniall parliament, having considderit the petitioun of the towne of Edinbrugh for approving and ratifieing the act of the committie of estaits for ane yeirlie impositioun upon the house maills and uthers for the mantenance of sex ministers, togidder with the report of the committie of bills thairanent, and being verie sensible of the constant affictioun of the guid toune of Edinburgh to religioun and thair eminent and examplarie zeall and desyr for provyding and establishing of a sufficient number of pious, abill and weill qualified ministers for thair severall kirks, and taking also to thair serious consideratioun the vast chairgis they have bein at in building of thair kirks and uther publict workis, in advanceing great soums of money for the use of the publict toward the mantenance of the cause and promoting the reformatioun and the great losses they have susteined since these great troubls and distractiouns, and being desyrous to encourage and inabill them towards the mantaining and provyding a sufficient number of abill and weill qualified ministers, thairfoir the saidis estaits of parliament, eftir serious consideratioun of the premises and of the said petitioun of the guid toune and report maid theranent, doe ratifie and approve the act of the counsall of the said good toune of Edinburgh, with the advyse and consent and concurrance of thair nyghbors, wpon the tuentie day of October lastbypast concerning thair resolutioun to have tuelff ministers constantlie within the said brugh. As also doe ratifie and approve the said act of the lait committie of estaits of the tuentie aucht day of December last for the yeirlie impositioun of the soume of nynteine thousand merks upon the hous maills within the said brugh to be a constant provisioun for sex of the said tuelff ministers of the said brugh, with the alteratiouns and aditiouns following. And the saidis estaits of parliament, considering that the provyding and mantining of the saidis sex ministers doeth concerne the worship of God and tend to the propagating and mantaining thairof in the cheif citie of this kingdome, from which non that are partakers of so great a benefite will in conscience withdraw or exeeme them selffis without great giltines befoir God, thairfoir the saidis estaits of parliament doeth heirby statut and ordaine that the yeirlie stipend of sex ministers be imposed and laid upon the wholl rents and maills of all the duelling houss, chalmers, buiths, cellars and all uther houses high and laigh payand maill within the said brugh, quhilk impositioun sall be payit by the inhabitants and possessors and that without any exemptioun or exceptioun of any house of whatsumevir holding or natur they be of or of any person or persons of whatsumevir degrie, qualitie or place they be of wpon any privilledge or pretence whatsumever. And that the said impositioun may be certaine and effectuall, it is ordainit that upon everie hundreth merks of maill throughout the wholl towne the annuitie of fyve merks be imposed wpon the wholl rents and maill foirsaids, that thairby the soume of nynteine thousand merks may be maid wp yeirlie to be a constant provisioun to sex ministers within the said brugh, that everie ane of the saidis sex ministers may have yeirlie the soume of tua thousand and sevine hundreth merks for his stipend and four hundreth merks for his house maill, and the four hundreth merks remaining to be allowit for the [...]† house maills and for the collectioun of the impositioun. The payment of which impositioun and annuitie sall be quarterlie each thrie months by advance, the first quarters payment beginand at Mertimes lastbypast for the first quarter, and the nixt quarter being the first of Februarii last for the months of Februar, Mairch and Apryle, and the thrid quarter for the first of Maii for the months of Maii, Junii and Julii, and the last quarter the first of August for the months of August, September and October, and sua furth everie yeir thair eftir quarterlie each thrie months. And that the rents and maills of all the houses, chalmers, buiths and uthers afoirsaid may be treulie knowin, thair sall be ane exact survey thairof maid and takine upon the aiths of the inhabitants, and thaireftir the said proportioun of fyve of everie hundreth imposed thairupon. And incaice [after] exact tryell upon aith by the surveyers in maner afoirsaid it shall be fund that the impositioun of fyve wpon the hundreth will not mak wp the said whole soume of nynteine thousand merks, that, wpon report to the parliament of what salbe wanting and inlaiking, the estaits of parliament will tak to consideratioun what farder quota salbe imposed for mak[ing] up the said whole soume of nyntine thousand merks for the constant and yeirlie provisioun of the said sex ministers. And als it is heirby ordained that the said impositioun salbe allwayis collected by the deacons of the kirk to be delyverit to the thesaurer of the kirk sessiounis, and is not to come in the handis of the toune counsall nor to be applyed to any uther wse than is abonewrittin. It is allwayis declaired that the foirsaid impositioun is to be laid upon the inhabitants, tenents and possessors without exemptioun or exceptioun of any upon what privilledges or pretence whatsumevir. And the said impositioun shall nawayis affect the ground ryght or propertie of the houses, tenements, buithis and uthers foirsaidis, but that the proportionating and divisioun of the foirsaid [sum]† to be payit be the inhabitants according to ther maills is onlie to be the reule and squair for taxing the inhabitants for payment therof at the raitts of the maills payit by thame and not to affect the ground as is afoirsaid, the tenents, inhabitants and possessors being allwayis subject in payment therof and lyable to personall and reall executioun for the samyne. And sieing by the saidis annuittie and impositioun the said towne of Edinburgh will be the moir enabled to intertine tuelff ministers, it is heirby ordained that they use all dilligence for getting thair kirks provydit with tuelff ministers and for keiping allwayis that number full for the guid and instructioune of the whole inhabitants therof; and when any of the number of the sex ministers provydit by the foirsaid impositioun sall vaik, the stipend or stipends of any of these sex vaikand sall be disposed upon ad pios usus, conforme to the act of parliament, be the kirk sessiouns of the said toune, with advyse of the committie eftirmentionat appointit for decyding of questiouns and diffirencis. And becaus it is not intendit that any prejudice or preparative sould be heirupon inferred to the privilledges and liberties of the colledge of justice or that any member therof sould be unequallie burdened, thairfoir, for preserving the lords of secreit counsall and sessioun and the haill members of the said colledge of justice frie from any prejudice to themselffis or thair privilledgis, it is ordainit that the said annuitie and impositioun salbe laid upon [all]† the inhabitants, tenents and possessors of the houses, chalmers, buithis and uthers afoirsaid within the said burgh eftir exact survey by four sworne men in everie paroche, who sall survey and value the house maills afoirsaid, quhairof thrie salbe citizens to be chosine and sworne be the toune counsall and the fourt shall be nominat, chosine and sworne be the colledge of justice or such as they shall appoint. And if the colledge of justice refuise or delay, being requyrit by the magistrats of Edinburgh as followis, viz: the president of session and deane of facultie to be requyrit in tyme of sessioune and any ane of them to be requyrit in tyme of vacance to the effect foirsaid upon sex dayis, in that caice the magistrats and counsall of Edinburgh to have powar eftir the requisition and expyring of sex dayis to mak choyse and swear sick of the colledge of justice as they sall think fitt for surveying and valuing of the saidis house maills. And if the members of the colledge of justice sall aither not accept or not concur in the said imployment, being requyrit, than and in aither of these caices the remanent of these persouns chosine and sworne by the towne counsall sall have powar to goe on in the said imployment and act by themselffis without the members of the colledge of justice not accepting nor concurring as said is. And if any questioune or debait sall happine to arryse betuix the saidis collectors or any of the members of the colledge of justice concerning the valueing, exacting and uplifting of the proportions imposed or concerning the payment therof, the estaits of parliament thinks it necessarie that thair be ane committie appointed for decyding of questiouns, and thairfoir doe heirby appoint Sir Johne Hope of Craighall, knyght, ane of the ordinarie lordis of sessioun, Sir Williame Scot of Clerkingtoun, knyght, ane of the clerks of session, Johne Dicksoune of Hairtrie and Mr David Heriot for the colledge of justice, the four baillies of Edinburgh present and to come for the said brugh (or any fyve of them, tua allwayis being members of the colledge of justice), and the provest of Edinburgh present and to come supernumerarie, to be a committie for the effect foirsaid, authorizing them and the quorum afoirsaid with thair full power to judge, decerne and determine all questiouns and diferencis afoirsaid summarlie and to doe all things necessarie for that effect without interuptioun quhatsumevir, and upon whose sentence executioun sall follow without any interuptioun by suspensioun or troubls. And as any of the places of these four appointed for the colledge of justice sall vaik by not acceptatioun, deceas or utherways, that the samyne be filled by the colledge of justice, the president and deane of facultie in tyme of sessioun and aither of thame in tyme of vacance being requyrit for that effect. And incaice the colledge of justice sall not fill the places within sex dayis eftir the said requisitioun, the said vaiking places shall be filled by the remanent members of the afoirsaid committie. And it is heirby declaired that, for removing all questiouns and diferencis, the exactioun of all bygane dewis by vertew of any former acts of counsall, sessioun or parliament is heirby dischairgit to such of the members of the colledge of justice or uthers as doe consent and give readie obedience to this present act and mak no obstructioun thairwnto at any tyme heireftir. The estaits of parliament, having hard and considerit ane supplicatioun givin in to them be Claud Paull in Gorballs and Jonet Lauchlane, his spous, schewing that in tyme of the lait unlawfull Ingadgment James Andersone, baillie in Gorballs, out of his earnest desyr to advance the said sinfull Ingadgment, did ly in wait and search for him to have forcit him to goe on in the said sinfull course aganis his will, and, not apprehending him, cam with a number of souldiors thing† to have apprehendit him, which he missing, eftir many injuries and blasphemous wordis offered to said supplicant's wyff, he strack hir severall tyms and brack hir arme and thaireftir pat hir in prisone; all which he did becaus he did alledge the said Jonet wes the cause of his not goeing out in the leat unlaufull Ingadgment. And inrespect the said supplicant is bot ane poor man and hes not quheron to persew the said James Andersone for these and many uther wrongs done be him to them, humblie thairfoir craving that the said maiter may be remittit to be tryed by certaine honest and sufficient persons living ther, as at mair lenth is conteinit in the said supplicatioun. Quhilk, with the oppinioun of the committie of bills, being takine into consideratioun be the saids estaits of parliament, they have ordainit and ordanis all the said maiter and all wrongous done be the said James Andersone to the said Claud that the samyne be remittit, and for that effect givis power and warrand [to] the lairds of Pollock and Glanderstoun, George Porterfeild, proveist of Glasgow, George Lockart, commissar ther, Peter Johnstoun, baillie ther, or any tuo of them, with full powar to them to tak tryell of any wrongis done to the said supplicant and to doe everie thing neidfull for that effect usit in sick caises, and to mak report of what they find to the committie of estaits betuix and the [...] day of [...] nixtocome.

The estaits of parliament, now presentlie conveined in this thrid sessioun of the second trienniall parliament, taking to ther consideratioun ane suplicatioun givine in to them be Mr Robert Barclay, provest of Irwine, in name of the said brugh, shewing that quheras he as commissionar for the said brugh of Irwine for the tyme, having subscribed Sir Williame Dick, his publict band of 200,000 merks, he is now chairgit to pay the said Sir Williame Dick the soume of ane thousand merks and annuellrents therof as the proportioun of the said principall soume imposed by the act of divisioun upon him as ane of the subscryvers of the said band; and sieing he wes wrged to subscryve the said band as commissionar for the said brugh and that the said brugh, inrespect of the great burdings and be the oppressioune usit ther the last yeir and be quarterings and uther publict burdins, it is na wayis able to releive him of the said sowme, the publict being debtors to that poor brugh for thair guidlins and borrowit money abone tuentie thousand pundis, by thair loisses by sea, quhilk extends to ane hundreth thousand pundis. Reassoune and equitie wold thairfoir that the said Sir Williame wer dischairgit to trouble him any farder for the said soume and that he tak him to the publict for payment thairof, speciallie seing the saidis estaits of parliament have bein pleasit alreadie to tak course with the said Sir Williame for his satisfactioune of the saidis soums dew to him be the publict, bot nothing done as yit for the said poor distrest brugh. And thairfoir humblie desyring the saidis estaits of parliament that they wold be pleasit to dischairge the said Sir William Dick of all farder troubling or chairging the said suplicant for the said soume and to declair him to be frie thairof, as at mair lenth is conteinit in the said suplicatioun. Quhilk being takin in consideratioun be the saidis estaits of parliament, they have ordainit and ordanis the said Sir William Dick to see the said suplicatioun, and in the meantyme have dischairgit and dischairgis all executioun at the said Sir William's instance aganis the said Mr Robert Barclay untill both pairties be hard befoir the parliament.

The estaits of parliament etc., having takine to thair consideratioun ane suplicatioun givin in be James Wallace, merchand burges of Edinbrugh, desyring payment of the soume of tua thousand, ane hundreth fiftie sex pundis Scotis furnished be him for accommodatioun of the commissiounars who wer last heir from England, and that conforme to ane act of the committie of estaits producit be him for that effect; and the saidis estaits of parliament, having heard and considerit the report of the committie of bills theranent, they fand the poynts of the said suplicatioun fullie instructed and doeth heirby recommend the suplicant to the committie of moneys for payment of the soume foirsaid restand to him.
