The estaits of parliament, taking to thair consideratioun the suplicatioun givine in be Hew Campbell, merchand, sheweth that he having obteinit ane decreit befoir the lords of counsall aganis Johne Hamiltoun of Balemoney for the soume of thrie thousand, tuo hundreth and fourtie merks Scottis justlie adebtit be him to the said suplicant, and for not payment thairof, haveing denuncit him to the horne and incarcerate [him] in the tolbuith of Glasgow, the said James obteinit warrand for his liberatioun forth of the said tolbuith upon ane assignatioun maid be him to me of his escheit guids and amongst uther particulars of ane doubill Inglish band maid to him be the erle of Ancrum, conteining the soume of fyve hundreth pund sterling, with conditioun that if the ane fyve hundreth pundis be payit, the band to be voyd or sua meikill thairof as†[is] justlie resting for payment of the foirsaid sowme adebtit be him to the said Hew and annuellrent theroff, quhilk band wes delyverit in to Sir Johne Gibsone, clerk to the proces, and wes nevir givine up be him to the said suplicant. And sieing without the said band the assignatioun maid to the said suplicant be the said James Hamiltoune can na wayis be effectuall to him, naither hes the suplicant any means for his subsistance and intertainement but what he may expect that way, all the rest of his means being takine from him be the Irish rebells in Irland the tyme of the first rebellioun thair, and thairfoir suplicating the saids estaits of parliament to give warrand to the clerk registere and his deputs (wha have now the said band in keiping) to delyver and give up to the said suplicant the said band, to the effect he may thairby stryve to recover payment of the sowme abonewrittin justlie restand to him be the said James Hamiltoun and annuellrent thairof sua far as shalbe fund dew be law, conform to his assignatioun maid to him theranent, as at mair lenth is conteinit in the said suplicatioun. Quhilk being considerit be the said comittie of bills and reportit be them to the parliament, the saidis esatits of parliament hes ordainit and ordanis the clerk of registere and Mr James Ballfour, now his deput, to delyver up to the suplicant the said band conteining the foirsaid soume, and this inrespect the said Hew Campbell, suplicant foirsaid, hes upon the back of the suplicatioun inactit himselff to mak the superplus of the soums of money conteinit in the said band moir nor satisfies himselff furthcumand to his cedent and his creditors sua far as shal be resavit be him.
