The estaits of parliament, taking to thair consideratioun the suplicatioun givine [in] be Stephane Bryce in Kittochsyd, shewing that quher he being duelling as tennent to Mr Archibald Fleiming, somtyme commissar of Glasgow, in the said toune of Kittochsyd, the said Mr Archibald Fleiming commandit and wold have urgit him to have gone out in the lait unlaufull Ingadgment; quhilk the said Stephane, out of meir conscience, absolutlie refuissit, as his minister's testimoniall did beir; and for feir of compulsioune wes necessitat to absent himselff fra his awine house the space of ten weiks, quhairupon the said Mr Archibald Fleiming, Robert Andersoune and Robert Smith, his tennents, most violentie and unmercifullie at thair owin hands did goe [to] the said Stephane, his house, he being then absent, and in the night seasone away took his haill quik guids, viz: threttie scheip, thrie ky and ane quoy, and plunderit his house, brak up kists, tuik out money and all his uther plenishing, being all worth four hundreth merks Scottis money and abone; and nochtwithstanding therof, still sought and persewit himselff to have sent him out in the said unlawfull Ingadgment. Lykas the said Stephane of lait hes oft and diverse tymes requyrit and desyrit the said Mr Archibald Fleiming to refound to him his guids and geir abonewrittin or prycis thairof foirsaid, bot resavit nothing bot shoring and minassing words. Thairfoir humblie creaving the saids estaits of parliament to have consideratioun of the premises and of his present distres, and to assigne and appoint to him some effectuall and sumar course whairby he may have redres and satisfactioun of his great damnage and lossis abonewrittin, as at mair lenth is contenit in the said suplicatioun. Quhilk, with the opineoune of the committie of bills, and being reportit to the estaits of parliament, they have remittit and remitts the same to the committie of war of the shirefdome of Lanerk, to whom the same wes solemnlie recomendit, and hes ordainit and ordanis the said committie of war to tak speciall consideratioun of the suplicant's conditioun and haill heids of his suplicatioun; and givs powar to them to cognoce and try the same, and to ordaine the said Mr Archibald Fleiming to pay to the suplicant what shal be justlie dew to him, and to allow to him quhatsoevir mantinance or uther publict dewis the suplicant hes payit out as tennent to the said Mr Archibald Fleiming. And ordanis the said Mr Archibald to attend the dyetts of the committie, aither be himselff or some other for him, utherwayis the said committie of war to proceid as if the said Mr Archibald wer present, he allwayis being laufullie ceited for that effect. And ordanis the said committie of war to mak report to the parliament or committie of estaits betuix and the first day of July nixtocome, with powar to the saids committie of estaits, incaice of not sitting of the parliament, to decerne thairin and to modifie expenses to the suplicant.
