Act in favour of [Sir Hugh Campbell], laird of Cessnock

The estates of parliament etc., having taken into their consideration the supplication of Sir Hugh Campbell of Cessnock, knight, showing him upon 28 December 1648 to have acquired from [Sir Hugh Wallace], laird of Craigie, elder, and [Hugh Wallace of Craigie], younger, Mr William Wallace, sheriff depute of Edinburgh, with consent of certain other persons, the heritable and irredeemable alienation, disposition and right of the one hundred and nine merk land of Riccarton, with the mills, coalworks and pertinents thereof, comprehending the lands and others particularly mentioned and set down in the contracts of alienation passed relating thereto, which are held of the prince and steward of Scotland, the charter and infeftment whereof is not as yet passed and issued by reason of the want of the exchequer. And seeing the said supplicant has been using what means possible he could for passing and issuing his said infeftment, reason and equity would follow that the said supplicant should in no way be prejudiced by the delay thereof, but that the date of his charter and infeftment (whensoever the same shall be passed and issued and sasine to follow thereupon) should be drawn back to the date of the said contract of alienation and disposition, as at more length is contained in the said supplication. Which being taken into consideration by the said estates of parliament, they ordain and declare the charter and infeftment to be passed and issued in favour of the supplicant of the lands and others conveyed to him as said is how soon the exchequer shall be established and fit (the said supplicant then using diligence for passing thereof), with the instrument of sasine to follow thereupon in favour of the said supplicant, to be as valid, effectual and sufficient as if the said charter had been passed and issued under the great seal and infeft according thereto within the space of eight days after the date of the said contract of alienation. And likewise the said estates declare that no sasine given to any person or persons of the said lands or any part thereof at any time since then shall be in any way respected to the said supplicant's hurt and prejudice.
