Act in favour of the town of Forres

The estates of parliament etc., having taken into their consideration the supplication given in to them by Thomas Warrand, commissioner for the burgh of Forres, on behalf of the provost, bailies, council and community of the said burgh, craving warrant for directing letters at their instance discharging Thomas Dunbar of Westfield, now sheriff of Moray, and his successors, their deputes, clerks, fiscals, officers and other members of court from impeding, troubling or molesting the said supplicants in the exercising of the office of sheriffship as sheriffs within their said burgh and liberties thereof, and that under the pains of such sums of money or other certifications as the estates should think fit; and that they would declare the said sheriff to be held as lawfully cited, seeing James Gibson, his procurator, by his ticket acknowledged the citation aforesaid, as in the said supplication at more length is contained. Which, with the infeftments, ratification, acts, writs and letter of the said James Gibson produced by the said supplicants, being seen and considered by the said estates, they find the said supplication sufficiently instructed and therefore have remitted and by this act remit the decision and determination of the right of the sheriffship of the said burgh of Forres within the liberties of the same and declarator thereof to follow thereupon to the judge ordinary; and in the meantime, until the decision and determination aforesaid and declarator to follow thereupon, have discharged and do hereby discharge the said sheriff of Moray, his successors and their deputes, clerks, fiscals, officers and other members of court of all impeding, troubling or molesting of the said magistrates of the said burgh of Forres present and to come in the exercising of the office of sheriffship as sheriffs within their said burgh and liberties thereof, and ordain letters to pass and be directed hereupon to the effect aforesaid.
