Anent the supplication given in to the estates of parliament by Mr Robert Farquhar of Mounie, showing that he had bond or decreet granted in his favour by James Wishart of Arduthie for payment to him of 600 merks of lent money for the use of the public and allowed to the supplicant in part of the sums due to him by the public, which the said James Wishart had suspended by warrant of the committee of estates of 21 December 1647 until this session of parliament, and by virtue of that warrant had summoned the supplicant to compear before the parliament to the effect contained in the said warrant, as the copy subscribed by John Wishart, messenger, bears; and therefore desiring the parliament to grant protestation in the supplicant's favour against the aforesaid suspension, and to declare the same suspension void, and to ordain the supplicant's bond, decreet and letters to have effect and to be put to further execution for payment to him of the sum aforesaid notwithstanding of the said suspension, as the aforesaid supplication more fully bears. Which supplication and parties above-named, being upon 4 April last publicly called before that committee of parliament appointed for bills and supplications, compeared personally the said Mr Robert Farquhar, supplicant, for himself, and also compeared Arthur Straton, writer, for and on behalf of the said James Wishart, and in his name produced the aforesaid suspension granted in his favour by the committee of estates of the date above-written, suspending all execution against the said James Wishart for the said sum of 600 merks until this session of parliament. Whereupon both parties being at length heard before the committee for the bills hereupon against and in fortification respectively of the said suspension, and the same with the opinion of the committee for the bills thereupon being this day read in audience of the parliament, the estates of parliament, after consideration of the aforesaid supplication, suspension and report aforesaid, declare the aforesaid suspension and warrant thereof purchased by the said James Wishart of Arduthie against the payment to the said Mr Robert Farquhar of the said sum of 600 merks Scots to be void and of no force nor effect in time coming, and notwithstanding thereof ordain the said Mr Robert Farquhar's decreet, warrant and letters purchased and raised at his instance for payment to him of the aforesaid sum of 600 merks to have effect and to be put to further execution against the said James Wishart, according to the tenor thereof in all points, for the which the estates declare this act shall be a warrant.
