The estates of parliament, having taken into their consideration what persons are to be excepted from getting pardon or conditions granted to them, the estates find and declare that James Graham, [sometime earl of Montrose] is not capable of pardon, and that any power formerly granted to any general officers or to be granted hereafter to them or others authorised by the parliament did never extend nor shall hereafter be extended to pardon the said James Graham, and that there shall never be any conditions granted to him nor any treaty or capitulation with or for him. And likewise the said estates of parliament find and declare that Alastair MacDonald shall have no conditions and likewise that James Gordon, sometime [viscount of] Aboyne shall have no conditions. As also find and declare, after voicing as said is, that George Gordon, sometime marquis of Huntly, Ludovic Lindsay, sometime earl of Crawford and Sir John Hurry shall have no conditions granted to them or any of them, but the estates find, after voicing, that Lewis Gordon, son to the late marquis of Huntly, may have some conditions.

The estates of parliament give hereby warrant to the magistrates of Edinburgh to deliver to Sir Robert Moray, colonel of the Scottish regiment in France, these persons, prisoners, namely: William Joyes, Dominic Leneis, Hugh MacRorie, Thomas Leneis, John MacConer, Peter Sownar, Ùisdean mac Eòin†, Tadhg mac Dhonnchaidh†, Redmond Ofnichie and Edmund Conner who are incarcerated in the iron house of their tolbooth; as also do hereby give warrant to the magistrates of Edinburgh to give in exchange Florence Neillie for Thomas Duncan, skipper in Kirkcaldy, imprisoned in Ireland, and Dominic Joyes in exchange for William Anderson, and James Young, servant to William Anderson, skippers at Limekilns, who are also kept in prison in the said kingdom of Ireland; and in the meantime to retain the said two persons in the tolbooth of Edinburgh where they remain incarcerated until the other three persons above-named for whom they are to be exchanged be relieved out of the prisons and jails where they are held in Ireland, for the which this act shall be a warrant.
