Committee for processes, monies and excise

The estates of parliament, considering how necessary it is that some course be taken for bringing in of money for the dispatch of such necessary affairs as concern the present good and peace of the kingdom and which cannot be ordered without present money, have therefore thought fit to appoint some of each estate to be a committee for that effect during the sitting of this session of parliament or for a shorter time if the parliament shall think fit. And accordingly the estates nominate the earls [John Kennedy, earl of] Cassilis, [James Murray, earl of] Tullibardine and [David Carnegie, earl of] Southesk for the noblemen, the lairds [Mr George Dundas of] Manor, [Sir John Wemyss of] Bogie and [Mr William Cochrane of] Cowdoun for the barons, Edward Edgar, John Kennedy and John Semple [of Stainflett] for the burghs (or any five of them, there being one of every estate), with power to them to call before them all such persons as have not yet lent money or who have formerly lent and are repaid, and according to the restrictions and conditions expressed in the act of parliament at St Andrews to ordain them to lend such sums of money as they shall think fit and to give them public surety thereof. With power to them also to call before them all such delinquents as have not yet been judged for their compliance with the rebels and to try, judge and censure them according to the act of classes, provided that they call none who have got General Major Middleton's assurances. With power also to them to call for the concealment of persons' rents given in to the committee, and to proceed therein according to the act of parliament made relating thereto. And the estates ordain the said committee to call for the magistrates of Edinburgh and to take in an account of their excise since 1 November seeing it is not yet disposed of, and out of the readiest thereof to cause provide meal for [James Campbell of] Ardkinglas' regiment. As also ordain the said committee to be solicitous in providing maintenance for the garrison of Inverness and other public services in the kingdom. With power likewise to this committee to call for all collectors of excise within this kingdom and cause them make account and payment according to their intromissions since the said 1 November instant.

Act in favour of [James Ogilvy], earl of Findlater

The estates of parliament, taking into their consideration the desire of supplication of the earl of Findlater, craving that some effectual way may be provided for his payment of £8,452 1s 1d due to him by the public of lent money of principal sum and annualrents and some means found out for reparation of his losses and subsistence, and in the meantime to liberate him and his lands of all maintenance, quarterings and other public dues, as the supplication bears, together with the report and opinion of the committee for the bills relating thereto, they remit and recommend the first part of the desire above-written anent the providing of some effectual way for the supplicant's satisfaction of the sum above-written to that committee appointed for Sir William Dick [of Braid's] business, to be taken into consideration by them for finding out the best and readiest ways for that effect; and also the estates grant exemption to the said James, earl of Findlater and his lands from all payment of maintenance, quarterings and other public dues during the pleasure of the parliament, and do hereby discharge the collectors principal and their deputes of all charging and troubling of the earl of Findlater and his lands for payment of any maintenance and other public dues for the same; as also all officers, commanders and soldiers of horse and foot from all quartering thereupon during the space aforesaid or until the same be discharged by the parliament or their committee.

The estates of parliament nominate the lords [John Hay, lord] Yester, [Robert Balfour, lord Balfour of] Burleigh and [Alexander Lindsay, lord] Balcarres for the noblemen, [Sir Andrew Agnew of Lochnaw], sheriff of Galloway, lairds [James MacDowall of] Garthland and [Mr William Cochrane of] Cowdoun for the barons, John Kennedy, William Glendinning [of Gelstoun] and Robert Brown for the burghs (or any five of them, there being one of every estate), to be a committee to consider the Irish business and report to the parliament.
