The estates of parliament, now convened in the fifth session of this first triennial parliament, ratify, approve and perpetually confirm the act of parliament of the date at Edinburgh, 28 June 1633, bearing that our sovereign lord and estates of parliament ratified, approved and confirmed all divisions, one or more, made or to be made of the parish of Aberdour, lying within the sheriffdom of Aberdeen, between the patron, with consent of the other heritors within the same parish and the minister and person present and to come serving the cure of the said kirk of Aberdour, and all assignations and modifications of stipends that were then or should happen thereafter to be assigned and modified to the minister then present and to come serving the cure at the said newly built kirk of Pitsligo, with all manses, glebes and kirk lands that were then or should be thereafter designed thereto; and likewise created and erected the said newly built kirk of Pitsligo upon the lands of Pitsligo in a separate parish kirk per se, and also the whole lands divided or to be divided from the said parish of Aberdour in a separate parish per se to be called in all time thereafter the parish kirk and parish of Pitsligo; and declared that the late Alexander Forbes of Pitsligo, thereafter designed Alexander, lord Forbes of Pitsligo, his male heirs and successors in all time thereafter should remain undoubted patrons of the said parish kirk and parish of Pitsligo and should have the only undoubted right of presentation of the ministers present and to come serving the cure there in all time thereafter, as freely as if the same had not been divided and disjoined from the said kirk and parish of Aberdour, without prejudice of their right of patronage of the same parish kirk and parish of Aberdour, as the said act of parliament at more length purports, in the whole heads, articles, clauses, conditions and circumstances thereof, and also all assignations and modifications of stipends that are already or shall happen to be assigned and modified hereafter to the minister present and to come serving the cure at the said newly built kirk of Pitsligo, with all manses, glebes and kirk lands that are already or shall happen hereafter to be designed thereto; admitting hereby the said divisions, assignations, modifications and designations to be as valid and sufficient as if the same and act of parliament aforesaid were expressly set down and engrossed herein, for the which the said estates of parliament have dispensed and by this act dispense for ever. And further, for the better provision and maintenance of the minister present and to come serving the cure at the said newly built kirk of Pitsligo, the said estates of parliament have of new not only created and erected and by this act create and erect the said newly built kirk upon the said lands of Pitsligo in a separate parish kirk per se, and also the whole lands divided or to be divided from the said parish of Aberdour in a separate parish per se to be called in all time coming the parish kirk and parish of Pitsligo, but also create and erect the said kirk of Pitsligo and lands divided or to be divided from the said parish of Aberdour in a separate and distinct benefice per se to be in all time coming the parsonage and vicarage of Pitsligo, and the minister present and to come serving the cure there to be presented to the said kirk and parish of Pitsligo, parsonage and vicarage thereof, and to be parsons and vicars of the same in all time coming. Likewise the said estates of parliament by this act declare that Alexander, now lord Forbes of Pitsligo, son and heir to the said late Alexander, lord Forbes of Pitsligo, his male heirs and successors in all time coming shall remain undoubted patrons of the said parish kirk and parish of Pitsligo, parsonage and vicarage thereof, and shall have the only undoubted right of presentation of the ministers present and to come serving the cure there in all time coming as freely as if the same had not been divided and disjoined from the said kirk and parish of Aberdour, without prejudice always of their right of patronage of the same parish kirk and parish of Aberdour, parsonage and vicarage thereof, for the which this ratification shall in no way be prejudicial.
