Ordinance in favour of Thomas Cunningham

Anent the articles exhibited in parliament in favour of Thomas Cunningham, it is ordered that command and warrant be presently granted to Archibald Primrose, John Aitchison or any persons whatsoever who hold in their hands the bonds granted for the arms delivered to the gentry and shires to deliver the said bonds to Mr Robert Dalgleish, whom the estates of parliament also command to seek execution thereupon immediately for the use of Thomas Cunningham. And also it is ordered that instructions be presently given to [Arthur Erskine of] Scotscraig for getting order from the committee and commissary-general of the Scottish army to the committee at Goldsmith Hall in London to pay Thomas Cunningham £5,000 sterling or thereby, and they shall be supplied with the same proportion from here in victual or other commodities. But it is declared that the same ordinance is always without prejudice of the act made in favour of the sheriffdoms of Berwick and Roxburgh anent the ammunition furnished to them by the public and bond given thereupon, whereby it is appointed that the price of the arms is to be allowed to the shires in these sums owing to them by the public. And further anent the three articles, it is agreed that a letter of encouragement be written from the parliament to the said Thomas for this effect. Item, to the fourth article craving that [Alexander Livingstone], earl of Linlithgow would free the ship and goods at Dumbarton, the parliament remit the same to the committee of estates. Item, anent the fifth article, the parliament grant the same and ordered Archibald Sydserf to give to [Archibald Napier], lord Napier a discharge for the sum of £10,000. The estates, having debated whether or not there shall be any addition made to the number of those who were formerly nominated to treat with the commissioners in England, do find after voting that there shall be no addition for the present.
