Act of approbation to [John Campbell], earl of Loudoun, chancellor

The earl of Loudoun, chancellor, exhibited in face of parliament five letters directed to them: one from the parliament of England, dated at Westminster, 24 June 1645; another from the commissioners at London, dated at Worcester House, 27 June 1645; a third from the committee at the army in England, dated at Nottingham, 1 July 1645; the fourth from the said commissioners, dated 8 July instant; the fifth from the parliament of England, dated at Westminster, 12 July 1645; which letters, after public reading, were taken into consideration by the estates, who having heard the said lord chancellor make a verbal summary relation of the present condition of affairs in England, in which they found themselves well satisfied, and that the said noble lord had with great care and fidelity discharged that trust put upon him as a worthy patriot and deserved thanks and approbation for the present until their weighty affairs would permit them to take his lordship's merit and pains to a more particular consideration and hear his lordship make a full report of such particulars as did occur during his lordship's negotiation.

Committee for prosecution of the war

The estates of parliament, presently convened in the fourth session of this first triennial parliament by virtue of the last act of the last parliament held by his majesty and three estates in 1641, have nominated and appointed the persons underwritten, namely: for the nobility, Archibald [Campbell], marquis of Argyll, William [Keith], earl Marischal, Alexander [Montgomery], earl of Eglinton, John [Kennedy], earl of Cassilis, Robert [Ker], earl of Roxburghe and William [Hamilton], earl of Lanark; for the barons, the lairds [Mr William Cochrane of] Cowdoun, [Mr Robert Meldrum of] Burleigh, [Arthur Erskine of] Scotscraig, [James MacDowall of] Garthland, [Sir John Hamilton of Orbiston], justice clerk, and [Hugh Campbell of] Cessnock; for the burghs, Sir John Smith [of Grotehill], Mr Alexander Wedderburn [of Blackness], Patrick Leslie [of Iden], Thomas Bruce [of Weltoun], John Kennedy and Mr Robert Cunningham, and [John Campbell, earl of Loudoun], lord chancellor, and [John Lindsay, earl of Crawford Lindsay], president of parliament, to be supernumerary, to treat and think upon what course may be thought fittest for the prosecution of the present war against the rebels and to find what obedience is given to the late act made for deploying the forces; which committee is appointed to meet with the gentry and such of the committees of war of each shire as are present, and the burghs to meet with the shires within which they naturally lie. The quorum of which committee, not including the said supernumerary persons, is appointed to be 11, there being two of each estate; and the said committee to meet presently in the parliament house.

Act anent those who go away from the army

The estates of parliament, now convened in the fourth session of this first triennial parliament by virtue of the last act of the last parliament held by his majesty and three estates in 1641, taking into their consideration that various of the subjects who have now lately convened here for prosecution of the rebels have now returned to their own homes without permission obtained for that effect, and thereby so far as in them lies have weakened the good cause by withdrawing their help, therefore they statute and ordain that no person of whatsoever state or quality may go to their own homes from the army and quarters under the pain to be reputed and held as malignants and persons disaffected to the good of religion and the kingdom and to be proceeded against, according to the certification contained in the act of parliament made at Stirling. And they order this act to be published at the market cross of Perth by sound of trumpet and to be sent by the lieutenant general to be published by him in the leaguer and in the quarters where the army lies, which the estates declare to be a sufficient publication hereof to put all the transgressors of the premises in bad faith.

Procedure: commission for the provision of the army
Commission for provision of the army

The estates of parliament, now presently convened in the fourth session of this first triennial parliament by virtue of the last act of the last parliament held by his majesty and three estates in 1641, by this act give and grant full power and commission to the particular persons after-specified, namely: Robert [Balfour], lord [Balfour of] Burleigh, John [Carnegie], lord Loure, Sir John Haldane of Gleneagles, David Carmichael of Balmedie, Mr Francis Hay of Balhousie, John Oliphant of Bachilton, Robert Arnott, provost of Perth, and George Jamieson, provost of Cupar, to meet, convene and set down some course for provision of victuals and support for horse and foot in the armies and ensuring the preservation of the corn and to do everything that may tend to the good of the armies through which they may be completely provided and cheaply served in time coming, and order them to report their proceedings to the estates of parliament.
