Ordinance anent the town of Wigtown against [Alexander Stewart], earl of Galloway

Anent the supplication given in to the estates of parliament by Patrick Hannay, provost of Wigtown, commissioner for the said burgh, in name and on behalf thereof against Alexander, earl of Galloway, making mention of the complaint and process intended and depending at the instance of the burgh of Wigtown against the said earl of Galloway before the last parliament in 1641 for the wrongs and injuries allegedly done by the earl of Galloway against the town of Wigtown; as also making mention of the process and probation led and carried out before the parliament relating thereto and therefore desiring letters for citation of the said Alexander, earl of Galloway to have compeared before this parliament to have heard and seen the aforesaid complaint, process and probation revived and justice administered therein to the final end and decision thereof, according to the probation and deposition of witnesses already led and carried out in the said matter, as the said supplication at more length bears. Being upon 22 June last read and considered by the committee appointed by parliament for receiving, hearing and considering bills and supplications, that committee gave warrant to a macer or messenger of arms to warn the said Alexander, earl of Galloway to have compeared before the parliament and answer to the desire of the said supplication, which was accordingly done and the said Alexander, earl of Galloway summoned to have compeared 16 July instant; and thereupon the aforesaid supplication and parties above-named being this day called in audience of the parliament, compeared personally the said Patrick Hannay, provost of Wigtown, commissioner and in name of the said town, and also compeared personally [Sir] James [Stewart], lord Garlies, in name of the said Alexander, earl of Galloway, his father, and the estates of parliament, after reading of the aforesaid supplication in their audience and hearing the parties compearing thereupon, continue the matter above-mentioned in the same state and condition as it now stands, without prejudice of party, to the next session of this present parliament then to be heard and considered without any new citation for that effect, and ordain the parties there to attend and be present that justice may be administered in the said matter according to the law; and the parties compearing as said is are warned hereof according to the act.
