Procedure: instructions to the lieutenant general
Instructions by the estates to [James Livingstone], earl of Callander anent his commission as lord lieutenant general

1. You shall with all possible diligence advance with the forces into England in pursuance of the ends expressed in the covenant.

2. You shall by all means possible pursue to the utmost [Ludovic Lindsay, earl of] Crawford, [James Graham, earl of] Montrose, [Robert Maxwell, earl of] Nithsdale, [James Gordon, viscount of] Aboyne, [James Ogilvy, lord] Ogilvy, [John Maxwell, lord] Herries [of Terregles] and [Donald MacKay, lord] Reay with all their adherents and associates, our unnatural countrymen; as likewise all others who have or shall adjoin themselves to them or shall be in arms against the parliaments or estates of both or either kingdoms.

3. You shall be careful as you advance to take notice of Berwick and Warkworth Castle and give such orders as shall be necessary for their security.

4. You shall take notice of the condition of the country, and as much as in you lies stop the enemies' arraying of them or plundering their goods, and give the well-affected all assistance and encouragement which may best witness our brotherly affection to that kingdom.

5. You shall carefully attend the motions of these enemies, and before you engage yourself in any important design of fixing yourself before any town or strength (except for securing some sea ports for the provision of the army and relieving of the forces of Bishoprick in case of extremity), you shall endeavour to dissipate their forces.

6. You shall appoint such places as you shall think most convenient and safe where victual may be sent for their supply, and what shall be necessary to take from the country people for maintenance for the army, you shall cause it to be done in an orderly way, and that billets be given to them for the same.

7. You shall keep correspondence with the English commissioners and our forces in Bishoprick and aid and assist them as shall be necessary and expedient for the good and advancement of the service.

8. You shall (without prejudice to the fifth article) by all means endeavour to reduce and secure the town of Newcastle, castle of Tynemouth and all other places possessed by the enemy for the use of the king and parliament of England, and make such use of the forces in Bishoprick as may contribute most for these ends, but with a special regard to the safety of the town of Sunderland.

9. You shall call to you the well-affected gentry and inhabitants of the country where you shall happen to be for their concurrence in everything necessary for the good of the forces with you and carrying on of this work.

10. You shall be careful to obey and observe such orders as from time to time you shall receive from the parliament, their committees, the lord general or committees of both kingdoms, and as you rencounter with such difficulties as you conceive do require their advice, to acquaint them thereupon and to give them a constant account of your proceedings.

11. If any emergencies occur in the prosecution of the former instructions which cannot now be foreseen nor admit delay without prejudice or loss, you shall do in that particular matter as in your judgement you conceive may contribute most to the good and advancement of the service.

Act and proclamation discharging the market at Brighouse Knowe

Whereas the estates of parliament, presently convened by virtue of the last act of the last parliament held by his majesty and three estates in 1641, are informed that certain avaricious persons have presumed at their own hands to set up and keep markets for sale of their goods at such places as they please, and especially at Brighouse Knowe and other places thereabouts in prejudice of the town of Edinburgh and their market at the House of Muir without any lawful warrant, therefore the said estates of parliament require and hereby command heralds to pass and by open proclamation at the said Brighouse Knowe and other places needful to discharge all and whatsoever persons to keep any market places with their goods but at such places as are allowed by the laws of this kingdom, and especially that none presume to set up or keep any market at the said Brighouse Knowe or any other places of their own, but that they bring in their goods to the said House of the Muir as they will be answerable.

Legislation
Act and proclamation for the returning of the officers to the army

The estates of parliament, now presently convened by virtue of the last act of the last parliament held by his majesty and three estates in 1641, considering that there are sundry colonels, captains, rutmasters, lieutenants, ensigns and other officers who are not as yet gone up to the army at the south, and that there are others who are come home upon a leave of absence and do not timeously return, so that by their absence the army is impeded in their march, to the great prejudice of the common cause, religion and good of the country; therefore the said estates of parliament command and charge all officers aforesaid to proceed to the army in the south between now and 20 June instant without delay (except such as are members of the parliament, who are to stay until they receive orders). With certification to those who fail, their places shall be disposed upon in favour of others and they punished as neglecters of the common orders and enemies to the public. And ordain the same to be presently published at the market cross of Edinburgh by a herald with sound of trumpet.
