Forasmuch as the estates of this kingdom have employed Captain James Jackson, Englishman, and his ship for guarding the coasts of this kingdom and other parts where either the enemies thereof within may receive supply from those of their conspiracy or hinder supply to be convoyed to the armies in England and Ireland or molest his majesty's subjects by sea, as he shall receive orders from the said estates or their committees; for which purpose he has also furnished his ship with artillery, men of war and ammunition and other necessary provision, and a contract is agreed between him and the said estates relating thereto. And whereas it is likely that in this service he may rencounter with Dunkirk or Irish frigates infesting the coast or any other ships belonging to the said enemy of the two covenanted kingdoms of Scotland and England, who are very industrious either to supply the enemies of the said kingdoms or to intercept supply or provision going to the two armies, as also to seize upon merchants and others of his majesty's good subjects travelling by sea, therefore the estates of this kingdom give full power and commission to the said Captain Jackson not only to defend himself, his ship and goods from any of the frigates and others aforesaid, but also to follow and pursue them with all manner of hostility and to apprehend, sink or destroy them and use them as professed enemies to the said estates, and such of them or their ships as they shall apprehend, to make the same forthcoming to be disposed of as the estates shall think fit, and to do every other thing herein as he shall be commanded by the estates of this kingdom or their committees. This commission is to endure for a period of five months.

Contract with Captain [James] Jackson

Forasmuch as Captain James Jackson, captain of the ship called the Hopeful Adventure, has undertaken and by this contract undertakes and obliges himself in presence of the estates of this kingdom now convened to furnish his ship with 20 piece of good ordinance, 60 men of war with victual, ammunition and all other necessaries for the space of five months, to be employed for the service of the kingdom of Scotland according to the orders to be given to him from time to time by the estates thereof and their committees; therefore the estates of this kingdom by this contract agree to pay to the said Captain Jackson £200 sterling monthly for his service in the employment of his said ship, furnished as said is, and two months' pay advanced to him, and that the said estates shall cause provide red cotton for side cloths to his ship, together also with a shallop for the use of the said ship. Likewise the said captain does hereby oblige himself to victual and provide his ship at one time for three months, and the said estates declare that his entry upon the service of the public shall be and begin upon the 16 April instant.

Act for cannon in Leith

The convention of estates understanding that William Keir in Leith has two piece of ordinance called sakers whereof he has no use for the present and which will be very useful for Captain Jackson's ship in the service for which he is now employed for the public, therefore ordain the said William Keir to lend the same to the said captain for the use aforesaid, he giving bond to restore the same to the said William or the price thereof between now and the space of five months.

The convention of estates having heard the petition of Andrew Drummond, prisoner in the tolbooth of Edinburgh, purporting that upon occasion of his being in the company of Lewis Marshall when he was taken for the slaughter of the young laird of Clackmannan, he was brought here with him and put in ward, where he has remained this month or thereby albeit he be innocent of being accessory to or having knowledge of this slaughter, being 40 miles from the place where and when the same was committed, as the pursuers knew; who, having upon 2 April proceeded against the said Lewis, who was convicted and suffered, had nothing to lie to his charge, and therefore desires to be put to liberty. And Gilbert Bruce, younger, of Clackmannan, for himself and other pursuers, being charged to appear and hear his desire granted or else show a cause why, and not compearing, the estates, in regard thereof, ordain the provost and bailies of Edinburgh to put the said Andrew to liberty in so far as he is warded for the cause above-written, for which this act shall be their warrant.

Precept to Captain [James] Jackson

The convention of estates ordain and command William Thomson to deliver to Captain Jackson £200 Scots for providing red cotton and green linen to be side cloths to his ship which is employed for the public service, for which this act shall be his warrant.

The convention of estates ordain and command the bailies of Leith to use their best endeavours to procure a shallop which the estates have conditioned to furnish to Captain Jackson for the use of his ship employed in the service of the public, and that the said bailies price the same and report to the convention, that orders may be given for payment thereof.
