The earl of Sutherland protested that the calling and voicing of [William Keith], earl Marischal before him in this convention should be without prejudice of his right and precedence before the said Earl Marischal; and the Earl Marischal protested in the contrary.
The earl of Glencairn protested that the ranking, calling and voicing of the earl of Eglinton before him in this present convention should be without prejudice of his right and precedence or of any process intended by him against the said earl of Eglinton relating thereto; and the earl of Eglinton protested in the contrary.
The earls of Dumfries, [James Douglas, earl of] Queensberry, [David Carnegie, earl of] Southesk, [John Wemyss, earl of] Wemyss and [James Ogilvy, earl of] Airlie protested that the ranking, voicing and calling of the earl of Lindsay before them in this present convention should be without prejudice of their right and precedence before him, they being in actual possession as earls for 10 years while he was only a lord; and the earl of Lindsay protested in the contrary in respect of the date of his patent.
The earl of Callander protested that the ranking and voicing of the earl of Leven before him shall be without prejudice of his right and precedence, according to the date of his patent; and the earl of Leven protested in the contrary, in respect he sat as earl in the last parliament where the earl of Callander sat only as a lord, and that his majesty has by his letter signed with his hand signified and declared that his intention was ever that the earl of Leven should have precedence.
The Lord Borthwick protested that the ranking, calling and voicing of the Lord Yester before him in this present convention should be without prejudice of his right and precedence before the said Lord Yester.
