The report of the committee for examination of [James Graham], earl of Montrose read in audience of his majesty and parliament, who take the same to their consideration and to advise what shall be further done.
The report of the committee for the Irish business read in audience of his majesty and estates of parliament, who appoint every estate to have a duplicate thereof to be advised.
Ratification of a signature of mortification of the bishopric and priory of St Andrews to the university thereof read, voted and passed in parliament, with the declarations, reservations and protestations following, namely: it is declared that the gift and ratification shall not prejudice the heritors of the benefit of the valuation of the teinds of their lands, either valued or to be valued, according to the act of parliament. And also excepting and reserving out of the mortification and ratification foresaid the kirks of Haddington and Linlithgow, which were dissolved and dismembered from St Andrews and conveyed to [Thomas Hamilton], earl of Haddington, and also all rights granted by [James Stewart], duke of Lennox to Sir Alexander Gibson of Durie of the teinds of his lands. And the persons underwritten protested that the said mortification and ratification be without prejudice of their rights to their lands or teinds, namely: Sir John Stirling [of Garden] and Sir Thomas Hope [of Craighall] for the lands of Ochiltree, Sir William Scott of Harden for [...], [John Forbes], laird of Leslie for Monymusk and Keig, [Sir William Cockburn], laird of Langton for [...], [John Erskine], earl of Mar for any lands or teinds belonging to him or conveyed by him or his predecessors.†
Appoints the several bodies of estates to meet at 2 o'clock after noon to think upon the best means of accommodation of business and bringing the same to a happy conclusion.
Memorandum regarding the ratification of the mortification to the University of St Andrews: it was ordained that the acre teinds of St Andrews excepted in the signature should be also excepted from the declaration made in favour of the heritors for the teinds of their lands, valued or unvalued. Item, that the reservation of [Thomas Hamilton], earl of Haddington and [Sir Alexander Gibson of] Durie their rights should bear this clause: the Earl of Haddington and Durie paying to the university the reddendo contained in their rights, if any be. And also that this clause to be subjoined: and if need be ordains a new gift of mortification to be passed and complete at his majesty's great seal, relative to the act of parliament foresaid. All which was instantly written and added to the first minute upon the act. Which act ordains to be extracted without mention therein of the protestations, but that the protestations written upon the act, or any other which shall be produced by any party pretending interest, may be extracted separately and apart as they are desired.
