In the parliament held at Edinburgh, 17 November 1641, the which day James Cochrane, merchant burgess of Edinburgh, commissioner for the said burgh, in name and on behalf of the provost, bailies, council and community thereof, protested that the ratification granted by the king's majesty and estates of parliament of the date hereof in favour of Robert Leslie, brother-german to [Patrick Leslie], lord Lindores, of the letter of tack granted to him by his majesty of the date 2 September 1641, of the lands, rents, teinds, duties and profits of the bishopric of Orkney, for the space of two nineteen years after his entry thereto, which was of the crop 1641, for the yearly payment of the sum of 8,000 merks Scots money, and of the warrant subscribed by his majesty directed to the treasurer, treasurer depute and other commissioners of exchequer for allowance to the said Robert Leslie of the yearly pension of £200 sterling, payable to him out of the exchequer of England and that out of the said tack duty above-written of the said bishopric of Orkney, to be retained by him during the years of the tack, should be always without prejudice to the gift and mortification granted by the king's majesty to and in favour of the said provost, bailies, council and community of the burgh of Edinburgh and their successors of the fruits, teinds, rents and duties of the said bishopric of Orkney, spirituality and temporality thereof, for the supply of the maintenance of their ministers of said burgh, and that the same gift and mortification granted to them by the king's majesty to the effect foresaid be in no way impaired, hurt nor prejudiced by the foresaid letter of tack and ratification thereof granted to the said Robert Leslie; and hereupon the said James Cochrane, commissioner foresaid, in name of the provost, bailies, council and community of the said burgh of Edinburgh, and in open and plain parliament in audience of his majesty and estates of parliament, asked instruments.

In presence of the king's majesty and estates of parliament compeared Robert Hepburn, advocate, as procurator for and in name and on behalf of George, earl of Kinnoull, and protested that this declaration following, namely: 'It is hereby expressly provided and ordained that the rehabilitation granted by our sovereign lord to and in favour of Patrick Ruthven, brother to the late John [Ruthven], sometime earl of Gowrie, with the ratification of the parliament interposed thereto, shall be in no way hurtful nor prejudicial to the said George, earl of Kinnoull and Sir James MacGill of Cranstoun-Riddel, knight, one of the senators of the college of justice, of their rights and possession of the lands of Cousland, teinds and whole pertinents thereof, and of a lodging and dwelling house in the town of Perth, but that notwithstanding of the rehabilitation and ratification and reduction of the act of parliament in the year 1600 the said Earl of Kinnoull and Cranstoun-Riddel, their heirs and successors shall hold and possess the said lodging and dwelling house in Perth, and the said lands of Cousland, whole teinds and pertinents thereof, according to their rights, security and possession, which the said Patrick Ruthven, his heirs or successors shall never be heard to quarrel or impinge in any sort' might be inserted in the foresaid ratification granted in favour of the said Patrick Ruthven. In the parliament held at Edinburgh, 17 November 1641, the which day James Cochrane, merchant burgess of Edinburgh and commissioner for the said burgh in this present session of parliament, protested in open and plain parliament, in audience of the king's majesty and estates of parliament, in name of the said burgh of Edinburgh and magistrates thereof, against the act made in this parliament of the date hereof in favour of the hatmakers within the said burgh, granting power, liberty and privilege to the said hatmakers of an overseer and quartermaster yearly of their own calling to be elected, nominated, chosen and given to them by the provost, bailies and council of the burgh of Edinburgh, as the said act purports; and that the same act should in no way be prejudicial to the rights, liberties and privileges granted to the provost, bailies and council of the burgh of Edinburgh, for making of laws and setting down of orders for governing of the said burgh, which is only competent to the magistrates thereof, and that no deacon nor quartermaster can be given to the said hatmakers, not being a craft, seeing the number of crafts of the said burgh and deacons of the same crafts are already limited by the decreet arbitral pronounced by his majesty's late dearest father of worthy memory between the merchants and crafts in Edinburgh; and hereupon the said James Cochrane, commissioner foresaid, in name and on behalf of the said magistrates of Edinburgh and in audience of the king's majesty and estates of parliament, asked instruments.

In the parliament held at Edinburgh, 17 November 1641, the which day Sir Archibald Johnston of Wariston, knight, one of the ordinary lords of session, nominated and chosen by the king and parliament to that place, protested for himself as clerk and procurator for the kirk and general assembly and for his successors in these offices that the ratification granted by the king's majesty and estates of parliament of this date in favour of [James Stewart], duke of Lennox of the gift and donation granted to him by the king's majesty of the temporality of the bishopric of Glasgow, the lands, barony and regality of the said bishopric and others pertaining thereto contained in the said gift, as the foresaid ratification more fully purports; and also that the ratification granted by the king and parliament in favour of the burgh of Edinburgh of this date, or in favour of any other person or persons of the gifts, mortifications and dispositions given by the king to them of the rents of the bishopric of Edinburgh or abbacy of Holyroodhouse, pertaining to the said bishopric, should be always without prejudice of the provision and recourse for security of the fee and pension modified and appointed by the late act of parliament made on 11 June 1640, and mentioned in the act of committee of estates dated 18 December 1640, to the said Sir Archibald Johnston† as clerk and procurator to the kirk and general assemblies, and to his successor in these offices, and that it may be declared by the king and parliament that the foresaid provision and recourse for payment and security of the said fees and pensions shall be reserved and excepted from the foresaid ratifications above-named; the which protestation the king's majesty and estates of parliament found reasonable and have admitted and admit the same, and declare that the foresaid provision and recourse for security and payment of the fee and pension of the clerk and procurator for the kirk, with the acts and rights granted to them thereupon, is hereby reserved and excepted from the foresaid acts of ratification above-mentioned and unprejudiced thereby in any manner of way; whereupon the said Sir Archibald Johnston asked act and instruments.

In presence of the king's majesty and estates of parliament William [Hamilton], earl of Lanark, secretary to his majesty, personally present, protested that any ratifications granted in this present parliament in favour of the burgh of Edinburgh or any others of any gift, right or disposition granted by his majesty to them of the rents, teinds and other duties of the bishopric of Orkney should be always without prejudice to Robert Leslie of the gift, tack or other right granted by the king to him of the rents and duties of the foresaid bishopric of Orkney. In the parliament held at Edinburgh, 17 November 1641, the which day Patrick Whitelaw, now of Whitelaw, compeared personally in open and plain parliament in presence of the king's majesty and estates of parliament and protested that the ratification granted by the king's majesty and estates foresaid of the date hereof in favour of Margaret Stewart, daughter lawful to the late Hercules Stewart, brother to the late Francis [Stewart], sometime earl of Bothwell, procreated between him and late Dame Mary Whitelaw, his spouse, of the letters of rehabilitation granted by the king's majesty to the said Margaret Stewart, whereby his majesty, with consent specified therein, of his highness's grace and clemency, rehabilitated and reintegrated the said Margaret Stewart to her good fame and to all whereof she was deprived and prejudiced by the forfeiture given and pronounced against her said late father, and restored her to his highness's favour and grace against the said sentence with all that had followed or might follow thereupon, and to all lands, heritages, tacks, steadings, rooms, possessions, teinds, actions, goods and gear whatsoever pertaining or which might pertain or in any way be competent to her before or since the said forfeiture, according to the said letter of rehabilitation granted regarding this, dated 27 July 1633, together with the said Margaret, her service and retour as nearest and lawful heir to her said late mother, dated 13 April 1636, as the foresaid act of ratification in the self more fully purports, should be always without prejudice to the said Patrick Whitelaw, his heirs, assignees or successors regarding his and their infeftments, comprisings, dispositions, renunciations, discharges of reversions and other rights and securities whatsoever made and granted to the said Patrick Whitelaw and his foresaids, of the lands of Whitelaw, with the houses, buildings, yards and whole pertinents thereof or in any way lawfully purchased and acquired by the said Patrick Whitelaw or his foresaids thereof, and that the same rights so granted to the said Patrick Whitelaw and his foresaids, lawfully purchased and acquired by them as said is, be in no way prejudiced, hurt nor impaired by the foresaid rehabilitation, service and retour above-written nor by the ratification thereof above-mentioned, but that the foresaid rights shall remain in the full force, vigour and strength thereof, notwithstanding of the said rehabilitation, service and retour above-specified and ratification thereof above-mentioned, and unprejudiced thereby in any sort; and hereupon the said Patrick Whitelaw asked act and instruments.

In the parliament held at Edinburgh, 17 November 1641, compeared personally Archibald, lord Angus, and in presence of the king's majesty and estates of parliament protested that the ratification granted by his majesty and estates foresaid in favour of Sir William Douglas of Glenbervie, knight baronet, of the charter and infeftment, with the new gift contained therein, precept and instrument of sasine following thereupon, made and granted by his majesty with consent specified therein, dated 25 March 1635, to the said Sir William Douglas, his male heirs and assignees of the lands and barony of Glenbervie, comprehending the particular lands, mills, multures, fishings, towns, markets, fairs and others particularly and generally mentioned in the said charter, [to be held of our sovereign lord and his highness's successors in free heritage and free barony, with privilege of free forest, as the charter]† and infeftment of the date foresaid more fully purport, should be always without prejudice to the said Archibald, lord Angus, his heirs and successors, regarding the right and infeftment granted by his majesty to him of the earldom of Angus, containing the said lands and barony of Glenbervie and other lands, baronies and others particularly and generally specified in the foresaid charter and infeftment, and of the precept and instrument of sasine following thereupon, and also without prejudice to the said Archibald, lord Angus regarding his right of superiority of the foresaid lands and barony of Glenbervie with the pertinents. And that the same rights and infeftments granted and pertaining to the said Archibald, [lord] Angus of the foresaid earldom of Angus, containing the said lands and barony of Glenbervie and others foresaid specified therein, and right of superiority pertaining to the said Archibald, lord Angus of the superiority of the lands and barony of Glenbervie be in no way prejudiced, hurt nor in any way impaired by the foresaid charter and infeftment granted to the said Sir William Douglas of Glenbervie, new gift contained therein and precept and instrument of sasine following thereupon, nor by the foresaid ratification thereof above-mentioned; and hereupon the said Archibald, lord Angus, personally present in parliament, asked act and instruments.

The which day, Patrick Bell, late provost of Glasgow and commissioner to this present parliament, desired and protested for the said burgh of Glasgow, and in name and on behalf of the provost, bailies, council and community thereof present and to come, that the act made regarding the ordering of the house of parliament, of the date 19 July 1641, appointing the commissioners for burghs to sit and voice as they are ranked by the roll of the commissioners of burghs, may be only restricted to this present parliament, and that in respect the same roll is only set down by the present clerk of the burghs without warrant, and for the most part contrary to the other rolls of former clerks. And also protested that the said Patrick Bell, his riding, sitting and voicing in this present parliament as commissioner foresaid for the said burgh of Glasgow, according and conforming to the foresaid act made regarding the ordering of the house of parliament as said is, be without prejudice of the rank and place due to the said burgh of Glasgow, according to the right and antiquity thereof; and hereupon the said Patrick Bell, commissioner foresaid, in name and on behalf of the said burgh of Glasgow, asked act and instruments.

The which day Doctor John Strang, principal of the college of Glasgow, personally present in presence of the king's majesty and estates of parliament, for himself and in name and on behalf of the regents and other masters and members of the University and College of Glasgow, protested for himself and in name and on behalf foresaid that the ratification granted by the king's majesty and estates of parliament of the date hereof in favour of a minister at the kirk of Glenluce and a schoolmaster thereat, of the gift and mortification granted by our sovereign lord to the said minister and schoolmaster at Glenluce of the precinct and rooms of the abbey of Glenluce, for a manse and glebe to the minister, and of the sum of 1,000 merks Scots money of stipend yearly out of the bishops' rents within the parish of Glenluce, and of the sum of 200 merks yearly out of the rents of the bishopric of Galloway to a schoolmaster at Glenluce, as the said act of ratification in the self more fully purports, should be always without prejudice to the said University and College of Glasgow, and to the said principal, regents and other masters and members of the same university and college and their successors regarding the gift and mortification granted by the king's majesty to the principal, professors, regents and other members thereof, of the rents, teinds and other duties pertaining to the late bishopric of Galloway, abbacy of Tongland, priory of Whithorn and abbacy of Glenluce, annexed to the said bishopric of Galloway, and regarding the ratification thereof granted by the king's majesty and estates of parliament in favour of the said University and College of Glasgow, and regarding all other right and title whatsoever competent to the same University and College of Glasgow, principal, professors, regents and other members thereof to the teinds, rents and duties of the foresaid bishopric of Galloway, abbacies and priory above-written annexed thereto, and that the same gift and mortification with the ratification thereof foresaid granted in favour of the said University and College of Glasgow, and all other right pertaining or competent to them as said is, be in no way prejudiced, hurt nor in any way impaired by the foresaid gift and mortification granted in favour of the minister and schoolmaster at Glenluce, nor by the ratification thereof above-mentioned; and hereupon the said Doctor John Strang, personally present, for himself and in name and on behalf foresaid, asked instruments.

In presence of the king's majesty and estates of parliament, compeared personally Robert Hepburn, advocate, as procurator for and in name and on behalf of Gilbert, earl of Erroll, and in name of the said earl gave in and produced this paper and protestation following, namely: I, Gilbert, earl of Erroll, high constable of Scotland and John [Lyon], earl of Kinghorn, my tutor testamentary, do protest that whatever has passed in this present session or in any former sessions of this present parliament or in any other preceding parliament concerning the liberties, privileges and extent of my place and office of high constable foresaid and power and jurisdiction thereof, and whatsoever else has been acted and done either in the parliament or in the country wherein the office of high constable may be concerned, shall not prejudice me nor my successors in the rights and privileges due to my place and office foresaid. And in respect of my pupillarity, I protest for remedy of law and restitution in its entirety against any act, practice or what else has passed to my prejudice, which may tend to the impairing or encroaching upon the privileges due to me and my predecessors as high constable of Scotland, according to our ancient rights and privileges of the same. And thereupon the said Robert Hepburn, as procurator for and in name and on behalf of the said Gilbert, earl of Erroll and his said tutor above-named, asked instruments.

The which day Sir John Stirling of Garden, knight, personally present in parliament as one of the two commissioners for the sheriffdom of Linlithgow, protested that the ratification granted by his majesty and estates of parliament of the date hereof in favour of the University of St Andrews, principal, regents, professors and founded persons of the same of the gift and mortification granted to them of the feu mails, feu ferms, kirks, teinds and other rents pertaining to the bishopric and priory of St Andrews, temporality and spirituality thereof, wherein is comprehended the lands and teinds of Ochiltree lying within the sheriffdom of Linlithgow, pertaining to the said Sir John Stirling, as the said ratification of the date foresaid in the self purports, should be always without prejudice to the said Sir John Stirling, his heirs and successors of his infeftments, rights and securities granted to him and his predecessors and authors of the foresaid lands and teinds of Ochiltree by his majesty or his most noble progenitors, or by the dukes of Lennox or [Alexander Livingstone], earl of Linlithgow, according to the said rights, infeftments and securities granted to the said Sir John Stirling and his foresaids of the foresaid lands and teinds of Ochiltree, with the pertinents, lying as said is, and that the same infeftments, rights and securities granted and pertaining to the said Sir John Stirling and his foresaids of the said lands and teinds of Ochiltree, with the pertinents, be in no way prejudiced, hurt nor in any way impaired by the foresaid gift and mortification granted by the king's majesty and estates of parliament to and in favour of the University of St Andrews, nor by the foresaid ratification thereof above-mentioned; and hereupon the said Sir John Stirling, personally present in parliament, asked act and instruments.
