Procedure: summons to be raised against the Earl of Montrose and others

[Robert Balfour, lord Balfour of Burleigh], president of the parliament, produced a paper containing some questions if the articles exhibited against [James Graham], earl of Montrose, [Archibald Napier], lord Napier, the lairds [Sir George Stirling] of Keir and [Sir Archibald Stewart of] Blackhall and [Lieutenant Colonel] Walter Stewart should be grounds of citation against them or not for the reasons contained therein; which being publicly read,

After voicing, it was found by the estates that the articles produced and read are a sufficient ground of citation against the persons above-named, and accordingly ordain summons to be raised and they to be cited. And for doing hereof, appoint Masters Roger Mowat, Alexander Pearson, James Baird and Thomas Nicolson, procurators formerly appointed by the committee for the public, to whom adjoins Sir Thomas Nicolson [of Carnock], and finds it incumbent to [Sir Thomas Hope of Craighall], his majesty's advocate, to concur and insist in this pursuit and command him to do the same, all which advocates the estates appoint to draw up the said summons and to insist in the process and whole acts and proceedings thereof.

Procedure: protest

[Sir Thomas Myreton], laird of Cambo, commissioner for Fife, declared that albeit he acquiesced to the place and rank wherein he is now put only for this time and for a peaceable and quiet end, and yet he desired that the same should be without prejudice to the shire of that place and rank due to the shire of Fife at another time.
