[Supplication continued; decreet arbitral between the Earl of Buccleuch and Francis Stewart ratified; act approved]

Continues the supplication between Thomas Muir against the provost of Edinburgh until Monday next.

Ratification of the decreet arbitral pronounced by his majesty between [Francis Scott], earl of Buccleuch and Francis Stewart, dated 8 August 1631, with the article signed by his majesty and both parties at St James made for explaining the said decreet, together with all other explanations contained in his majesty's several letters relating thereto. Sir John Scott of Scotstarvit and Master William Scott of Clerkington, tutors to the Earl of Buccleuch, with Master Thomas Nicolson, procurator, compearing in presence of [John Stewart, earl of Traquair], the commissioner's grace, and articles, protested against the said ratification in so far as the same contained these words 'together with all other explanations contained in his majesty's several letters relating thereto'. Master Robert Craig, procurator for Francis Stewart, asked instruments that the Earl of Buccleuch, his tutors and procurators opposed that clause of the ratification after the said explanations were seen by the Earl of Buccleuch, his tutors and procurators, and registered by their consent. Sir John Scott and Master Thomas Nicolson asked instruments that they opposed the said clause only because they had not seen the same nor been acquainted therewith, and the same was not now produced; and Master William Scott protested for the Earl of Buccleuch, and the rest of the tutors who will adhere to his protestations, that the ratification of the articles signed at St James be without prejudice of their defences as allowed of the law, the controverted words being deleted. The act produced by the noblemen of the committee for the peace of the north, together with the three acts produced by the barons for that effect and an act against the MacGregors, delivered to [George Gordon], marquis of Huntly to be shown to the noblemen.

The commission for the justiciary upon the River Ythan continued until Monday, that [Gilbert Hay], earl of Erroll may be heard. And the act delivered to [James Lyon of] Auldbar.
