The fourth day of parliament

At Edinburgh, 30 August 1639, to the which day and place this present parliament was continued as is above-written.

Warrant: regarding the riding of parliament

The which day the commissioners of parliament above-named, being convened, compeared the said Sir Thomas Hope [of Craighall], his highness's advocate, and produced the warrant underwritten subscribed by John [Stewart], earl of Traquair, lord Linton and Caberston, high treasurer of Scotland, his highness's commissioner to this present parliament, dated this 30 August 1639, whereof the tenor follows: Forasmuch as this day the supreme court of parliament is to be fenced, it is our will that immediately after the fencing thereof it be declared in our name, as high commissioner to his sacred majesty, that we and the estates intend, God willing, to ride solemnly to parliament upon 31 August instant, and that the whole estates and commissioners from barons and burghs attend us at his majesty's palace of Holyroodhouse. To that effect subscribed at Holyroodhouse, 30 August 1639. It is thus subscribed: Traquair, commissioner. And upon the production thereof asked instruments.

Procedure: fencing of parliament

Whereupon the said commissioners of parliament, namely: John [Drummond], earl of Perth, John [Maitland], earl of Lauderdale, David [Carnegie], earl of Southesk, Alexander [Elphinstone], lord Elphinstone, Archibald [Napier], lord Napier and Sir Thomas Hope of Craighall, knight, his highness's advocate, commissioners constituted by his majesty's commission foresaid under his highness's quarter seal, of the date above-written, for fencing and continuing of this present parliament in manner foresaid, caused lawfully fence this present high court of parliament, and thereafter,

With the suits having been called and the court lawfully fenced,

Procedure: commission for constituting his highness's commissioner to the general assembly of the kirk and parliament

The said Sir Thomas Hope [of Craighall], his majesty's advocate, produced a commission under his highness's great seal to the said John [Stewart], earl of Traquair etc., making and constituting the said earl his highness's commissioner for holding of this present parliament, as commissioner for his majesty therein, whereof the tenor follows:

[Abstract:] The king appoints John, earl of Traquair, lord Linton and Caberston, principal treasurer, as the king's commissioner to the general assembly of the kirk (12 August instant) and parliament (26 August instant). Under the great seal at Whitehall, 5 August 1639, 15th year of the reign.

Upon the production and reading of the which commission, the said Sir Thomas Hope, advocate to our sovereign lord, asked instruments and took up the foresaid commission.

Procedure: continuation of parliament
Continuation of the parliament until tomorrow, 31 August

The which day the said commissioners, under the quarter seal above-named, according to the foresaid warrant subscribed by the said John [Stewart], earl of Traquair, his highness's commissioner, under his majesty's great seal, for holding of this present parliament and all summons, actions and petitions, did, for obedience thereof, in his highness's name and authority and in the name of his majesty's commissioner foresaid, continue this present parliament and all summons, actions, petitions and other matters to be treated therein and belonging thereto until 31 August instant; at the which day ordain the whole estates of parliament to attend and await the said John, earl of Traquair etc., his majesty's commissioner, with all due reverence in manner used to others having the like charge of before at his majesty's palace of Holyroodhouse between 9 o'clock and 10 o'clock before noon, that his highness's commissioner and estates of parliament may ride solemnly from the said palace in parliament the said day to the parliament house at Edinburgh; and ordain the said estates to attend until the parliament conclude, under the pains contained in the acts of parliament made relating thereto; and ordain proclamation to be made hereof at the market cross of Edinburgh. Whereupon [Sir Thomas Hops of Craighall], our sovereign lord's advocate, in his majesty's name, asked instruments.
