Act in favour of Master James Bannatyne of Newhall

Our sovereign lord, with advice and consent of the estates of this present parliament, has ratified and approved and, for his majesty and his successors, with advice and consent foresaid, by this act ratifies and approves the charters and infeftments respectively underwritten, alienations, venditions and dispositions respectively after-specified contained therein, with the precepts of sasine inserted in the same, made, given and granted by the persons respectively after-mentioned to his highness's trusty and well-beloved councillor Master James Bannatyne, now of Newhall, one of the senators of his majesty's college of justice, designed therein Master James Bannatyne of Newtyle, one of the commissioners of Edinburgh, in manner after-mentioned, namely: the charter and infeftment, with the precept of sasine inserted therein, made and granted by Thomas Cockburn, elder, of Newhall, and William Cockburn, younger, of Newhall, his eldest lawful son and apparent heir, with advice, express consent and assent of certain persons contained therein in manner mentioned therein, and by all the said persons, with one consent and assent, to the said Master James Bannatyne, his heirs and assignees whatsoever heritably and irredeemably without any manner of reversion, redemption, regress, bond, promise or condition of reversion or redemption whatsoever, of all and whole the lands of Newhall, with the tower, fortalice, manor place, orchards, yards, parts, pendicles and pertinents thereof, with the mill and mill lands of Newhall, astricted multures and sequels of the same, and of all and whole the lands of Billingruge, Howden, Hiemurecroce, Woodhead and Wodfute, with the houses, buildings, yards, tofts, crofts, parts, pendicles and pertinents, all lying within the constabulary of Haddington and sheriffdom of Edinburgh, to be held from the said Thomas and William Cockburn, and their heirs, of George Lauder of the Bass, his heirs and successors, then their immediate lawful superiors of the said lands, mill and others above-written, with the pertinents, in fee and heritage for ever, of the date at Edinburgh, 6 July 1620; together with the charter of confirmation thereof made and granted by James Livingstone [of Biel], groom of his majesty's bedchamber, now superior of the said lands, mill and others above-written in place of the said George Lauder of the Bass, late superior thereof, in favour of the said Master James Bannatyne, by the which he ratified and approved and confirmed the said charter above-expressed containing the said precept of sasine, vendition and alienation contained therein, in the whole points, articles, conditions, clauses and circumstances thereof in form and manner contained therein, of the date at Whitehall, 13 July 1630; with the charter, infeftment and precept of sasine inserted therein, made and granted by the said Thomas and William Cockburn, with consent foresaid, and in manner above contained to the said Master James Bannatyne and his foresaids heritably and irredeemably as said is, of all and whole the lands of Cockburn, with the wood and pasture of the same; and of all and whole that pendicle of the said lands of Cockburn, called the merkland of Bolton, with the houses, buildings, yards, parts, pendicles and pertinents thereof, lying in the barony of Bolton, constabulary and sheriffdom foresaid, to be held from them and their heirs of John [Maitland], then viscount and now earl of Lauderdale, and his successors, their immediate superiors thereof, in free blench, fee and heritage for ever, of the date at West Nisbet, 14 August 1620; with the charter of confirmation and new disposition and precept of sasine inserted therein, made and granted by the said John, then viscount and now earl of Lauderdale, superior of the said lands, in favour of the said Master James Bannatyne and his foresaids, by the which he ratified, approved and confirmed the said charter containing the said precept of sasine and of new gave, granted and conveyed the same lands in favour of the said Master James Bannatyne and his above-specified in manner therein contained, to be held in free blench, fee and heritage in manner mentioned therein, of the date at Edinburgh, 26 July 1622; and with the whole other charters, infeftments and precepts of sasine contained therein or a part made and granted by the said George Lauder of the Bass and the said John, earl of Lauderdale and his predecessors, in favour of the said Master James Bannatyne and his foresaids, and of the said Thomas and William Cockburn, their authors and predecessors of the said lands, mill and others respectively above-specified, to be held of the said George Lauder of the Bass and the said John, earl of Lauderdale, their heirs or successors respectively or of their said predecessors, their heirs and successors in fee and heritage, with all charters of confirmation of the same and other rights, titles and securities thereof whatsoever, of whatsoever date or dates, tenor or contents the same be of; together also with his majesty's charter of confirmation under the great seal granted in favour of the said Master James Bannatyne, confirming all the said charters, precepts, rights, titles and securities foresaid, particularly and generally above-rehearsed, of the date at Holyroodhouse, 2 April 1632, in the whole heads, articles, clauses, conditions and circumstances thereof respectively. And wills and grants and, for his majesty and his successors, with advice and consent foresaid, perpetually decrees and ordains that this present general confirmation, ratification and approbation is, and shall be, of as great value, force, strength and effect to the said Master James Bannatyne, his heirs and assignees foresaid for the peaceable holding, enjoying and possessing of the said lands, mill and others foresaid, with the pertinents, held of the said superiors respectively as said is, as if the said whole charters, precepts, rights, titles and securities particularly and generally above-expressed were at length word by word herein expressed; regarding the which and all that has followed or may follow thereupon and all faults and imperfections that may be proposed or alleged against the validity hereof or this present general ratification and approbation of the same, his majesty, for him and his foresaids, with consent above-named, has dispensed and by this act dispenses for now and ever. And his majesty, with the advice of the three estates, decrees, statutes, finds, declares and ordains the foresaid whole infeftments to be good, valid and effectual rights whereby the said Master James Bannatyne, his heirs and successors may peaceably possess, hold, and enjoy the said lands and others in all time coming.
