Act in favour of [Alexander Fraser], laird of Philorth, younger

Our sovereign lord, with advice and consent of the estates of parliament now presently convened, ratifies and approves and, for his highness and his successors, perpetually confirms the charter and infeftment granted by our sovereign lord's late dearest father, James VI, king of Scotland for the time, of everlasting memory, under his highness's great seal, to the late Sir Alexander Fraser of Philorth and Fraserburgh, knight, the male heirs then lawfully procreated or to have been procreated of his body and their assignees, which failing, to the nearest and lawful male heirs whatsoever of the said late Sir Alexander bearing the surname and arms of Fraser, and their assignees whatsoever heritably, of all and sundry the lands, baronies, mills, mill lands, multures, woods, fishings and others particularly and at length mentioned, inserted and contained in the said charter, lying within the sheriffdom of Aberdeen, with the whole privileges, liberties, immunities, casualties, profits and commodities whatsoever pertaining and belonging thereto likewise mentioned in the said charter, upon the provisions and conditions mentioned and contained in the said charter; together with the new gift and disposition contained in the said infeftment granted by his highness's said late dearest father to the said late Sir Alexander Fraser and his foresaids of all and sundry the said lands, baronies, mills, woods, fishings and others foresaid mentioned in the said charter, with the whole privileges, liberties, immunities, casualties and commodities belonging thereto, all erected, united, annexed and incorporated in a whole and free barony called the barony of Philorth, to be held of his highness's said late dearest father, his heirs and successors in manner mentioned in the said infeftment, as the same of the date at Holyroodhouse, 4 April 1601, with the precept of sasine directed upon the said charter forth of the chancellery, under his highness's said late dearest father's quarter seal, of the date of the same charter, for giving sasine to the said late Sir Alexander of the lands and others therein mentioned, together with the instrument of sasine following upon the said precept, of the date the [...] day of [...] 16[...], together also with the charter and infeftment granted by our said sovereign lord under his highness's great seal, with consent of his highness's right trusty cousin John [Erskine], earl of Mar, lord Erskine and Garioch etc., his highness's principal treasurer, collector and comptroller within this his majesty's kingdom of Scotland for the time, and of his highness's trusty cousin Archibald [Napier], lord Napier of Merchiston, his highness's depute in the said offices for the time, and of the other lords, his highness's commissioners of the said kingdom, to his highness's beloved Alexander Fraser, grandchild to the said late Sir Alexander Fraser of Fraserburgh, knight, and to the male heirs lawfully procreated or to have been procreated of his own body, which failing, to James Fraser, his uncle, and the male heirs lawfully procreated or to have been procreated of his body, which failing, to John Fraser, brother to the said Alexander, and his male heirs whatsoever bearing the surname and arms of the house of Philorth, and their assignees whatsoever heritably, of all and whole the lands and barony of Philorth, comprehending therein the particular towns, lands, mills, mill lands, woods, fishings and others particularly mentioned, inserted and contained in the said infeftment, with the castles, towers, fortalices, lochs and stanks of the same, with the whole liberties, immunities, privileges, profits, easements and commodities mentioned in the said infeftment pertaining and belonging thereto, all lying within the sheriffdom of Aberdeen; which infeftment proceeds upon the resignation of the said late Sir Alexander Fraser of Fraserburgh, knight, grandfather to the said Alexander, and upon the resignation of the late Simon [Fraser], lord Fraser of Lovat, the late George Ogilvie of Carnousie, Sir George Ogilvie of Carnousie, his son, and William Forbes of Tolquhon, to be held of our said sovereign lord and his highness's successors in fee and heritage for ever, as in the said charter and infeftment of the date at Holyroodhouse, 15 March 1628 at more length is contained, together with the precept of sasine directed forth of his highness's chancellery upon the said charter, under his highness's quarter seal, together with the instrument of sasine following thereupon of the date the [...] day of [...] 162[...], in all and sundry the heads, points, clauses, articles, circumstances and conditions contained in both the said charters and infeftments, precepts of sasine and instruments of sasine following thereupon and after the forms and tenors thereof in all points, with the special provisions and conditions contained in the same infeftments and no otherwise. Likewise our said sovereign lord, with advice and consent of the said estates of this present parliament, wills and grants and, for his highness and his successors, perpetually decrees and ordains that this present ratification is and shall be as valid, sufficient and effectual to the said Alexander Fraser and his foresaids as if the said charters and infeftments, with the whole privileges and donations therein contained, with the said precepts of sasine and instruments of sasine following thereupon, were herein at length word for word specially and particularly inserted and contained; concerning which, our said sovereign lord, with advice and consent foresaid, for his highness and his successors, has dispensed and, by this act, dispenses for ever.
