Act in favors of the laird of Lawers

The estats of parlement etc., having heard the supplicatioun givin in to thame be Colonell James Campbell, sonne to umquhill Colonell Sir Mungo Campbell of Lawers, with the report therof made unto thame be the committie appointed for that effect anent the soume of fourscore eightene thousand pounds Scottish monie dew to him for the tuo part of his arriers for his service in the kingdome of Scotland, and instructed to thame be productioun of the acts and papers mentionat in the same supplicatioune; lykwise anent the sowme of fourscore saxteine thowsand, eight hundreth fyftie fyve pounds, eight shillings also dew to him for his losses sustained throw burning and waisting, which losses are seene and approvin be the committee of parlement in anno 1646 years; and farder anent the soume of sevintene thousand, fyve hundreth pounds sterline dew for his service in Ireland, and that the wholl former arreirs and soumes of mony were contracted be the lairds of Lawers and are owing to thame for thair faithfull service to the kingdome and in the cause, and therby the said Colonell James Campbell now of Lawers, his estate (unles he be speedilie supplied) is altogether ruined, and that his said umquhill father sealled his affectioun and fidelity to the cause with the losse of his lyfe; and inregaird that the great soumes awing to him for his service in Ireland and the soume assigned to him for his losses to be paied be the parlement of England are ineffectuall and desperat, and that thair was precept givin of before be the parlement in anno 1647 and renewed againe in anno 1648 for payment of the soume of fourtie thousand merks in the first end of the forsaid soume of fourscore eightene thousand pounds Scottish dew to him as his arreirs for his service in this kingdome, and in regaird of the said laird of Lawers, his urgent necessity and lying out of the soume forsaid and present conditioun, being under great burthens and disabled, hee craved the said parlement ther supplie and ordors for that effect, as at more length is contained in the said supplicatioun and report made therupone. Quhilk supplicatioun and report abovementionat being takin to consideratioun by the said parlement, the said estats doe thairfor and in regaird of the said laird of Lawers, his present conditioun, being under great burthens and disabled, heereby appoint and ordaine the forsaid soume of fourtie thousand merks quherfor precept was givin and renewed in maner forsaid, with the soume of tuentie thousand merks farder, extending the saids tuo soumes to the soume of fourtie thousand pounds Scottish, to be paied to the said Colonell James Campbell now of Lawers; and that in the first end of his forsaids arriers dew for his service in this kingdome, extending to the said soume of fourscore eightene thousand pounds. And for the remainder of the said soume, extending to fyftie eight thousand pounds, the saids estats declaires the same to be a publict debt of the kingdome and thairfor binds and obleises thame to mak payment therof and of the annualrent of the same so long as the samyne shall be restand awand unpaied fra the terme of Candlemas 1649 years, and ordaines that this present may be als sufficient in all respects to the generall comissar and his deputs or any other intromettors or receivers of the publict dewis in tymecomeing for paiment to the said Colonell James Campbell of Lawers of the annualrent of the said soume of fyftie eight thousand pounds as of thair wer particular precepts or warrants drawne yeirlie or termelie be the saids estats of parlement or their committeis on the said generall commissar or his deputs or the intromettors with the publict dewis for that effect. And farder the saids estats declaires the said Colonell James Campbell of Lawers, his discharges, to be als valide and sufficient to the said generall commissar and his deputs or any others intromettors or receivers forsaids for payment to him of the annualrent of the said soume fra the said feast and terme of Candlmas lastbypast and in tymecomeing ay and whill hee be compleetlie paied of the forsaid principall soume of fyftie eight thousand pounds as ofthair were particular precepts drawne on thame or ather of thame for that effect. And to the effect the said laird of Lawers may have the more speedy and effectuall payment of the forsaid soume of fourtie thousand pounds, the saids estats doe heereby ordaine precepts to be drawne and assignments to be made of any bygane maintenance, taxt, loane, fynes [and] contraventiounes restand awand preceeding October 1648 or anie other publict dewis restand to the publict, and lykwise doe heereby appoint and ordaine such persons, according to a particular list givin in to the saids estats upon the day and date heirof be the said laird of Lawers, or that shall be givin in be him to the saids estats or thair committeis and shall come under the compas of the act made in this present parlement anent the persounes from whom monyes shall be borrowed or shall be fyned of the date the [...] day of [...], shall lend mony not exceeding the half of a yeirs rent dew to them upon the publict faith, and the lyk band for thair securitie as shall be given to uthers from whom mony shall be borrowed; and what shall be gottin from the saids persons listed or to be listed as said is, the ane half therof to appertayne to the publict, and the other half to the said laird of Lawers for his payment of the forsaid soume of fourtie thousand pounds; and that hee shall be paied of the same out of the first and readiest monyes to be borrowed. And what shall happin to be unpaied to the said Colonell James Campbell be the wayes abonewrittin, the saids estats appoints and ordaines the said laird of Lawers to be answered of the remanent out of the tak duty of the excise of the wynes to be set to the marquis of Argyll and Sir William Dick equallie betuix thame, according to the act of parlement made to that effect in favors of the saids marquis of Argyle and Sir William Dik of the date of thir presents.

Therafter thair was presentit and produced in face of parlement in name and behalff of Colonell James Campbell, sone to umquhill Colonell Sir Mungo Campbell of Lawers, ane particular list and roll of persons from whom monyes are to be borrowed and fyned, conforme to the act of parlement the [...] day of [...]. Quhilk list and roll of the fornamed persons aftermentionat the estats of parlement having heard red, they ordaine the same to be subscribed be the lord chancellor and have remitted the same to the committe to be appointed for borrowed monyes, quhom thay ordaine to give out precepts for warning the saids persons contenit in the said roll to compeir before thame to a certan day, to heir and sie thame ordanit be sentence of the said committee, such of thame as they shall find lyable, conforme to the act of parlement anent persons from whom mony is to be borrowed and are to be fyned of the date the [...] day of [...]. And the saids estats declaires that what shall be gottin aff the persons forsaids by borrowing or fyning, the ane halff of the samyn shall pertayne to the publict and appoints that part therof to be paied to Sir James Stuart, generall commissar, and the other halff of the samyn to be paied to the said laird of Lawers in part of paiment to him of the soume of fourtie thousand pounds Scottish appointed be the saids estats to be paied to him for his present supplie, conforme to ane act of the date of thir presents.
