Act in favours of the liedges who have purchassed brieves and other writs befor or after our late soveraigne, his death, and befor the knowledge theirof

The estats of parlement etc., haveing taken to thair consideratioun that such of the liedges and subjects of this kingdome who ather before the death of our late soveraigne or who after his death (bot before certane knowledge) theirof have purchassed and raised breives and commissions for serving of breives furth of the chancellarie for serving and retouring thame airs to thair predicessors, or any other breives, presentatiounes or precepts furth of the chancellarie, or anie commissions under the great or privie seals, signet or other publict sealls, and such as have purchast and raised letters of comprysing and all who have raised letters of horning and inhibitioun, and generallie all who have raised letters or summonds of all sorts in our said late soveraigne lord's name, ather before his death or since his death and before the date heirof, may suffer prejudice in thair just rights and diligence be the sad, unexpected and sudden death of the king's matie in whose name and authority the saids breives, commissions, presentatiouns, precepts, hornings, inhibitiounes, letters and summondses of all sorts wer raised and impetrat, or utherwayes may be put to unnecessar charges in renewing of the saids breives, commissiones and others writs forsaids and diligence used theron. And the saids estats of parlement, being willing to prevent the damnage quhilk the liedges may sustaine by disappoynting and frustrating the dyets of ther saids breives or letters of comprysing or be renewing of the forsaids writs, summondses and letters of all sorts abonewrittin or any of thame in our soveraigne lord's name who now is, thairfor the saids estats of parlement declaires that it was, is and shall be laufull to the liedges and subjects of this kingdome to proceed in the executioun of all breives and letters of comprysing raised and impetrat be thame before the date heirof, and to deduce the services upon the said breives and commissions, and to prosequute the processes of comprysing upon the saids letters, and to execute and use the forsaids commissions, presentations, precepts, hornings, inhibitiounes, letters and summondses of all sorts abovementionat notwithstanding of the death of our said soveraigne lord; and that it is and shall be laufull to all judges, members of court, inquests and all other pairties interessed in the foirsaids writs particularlie and generallie abovementionat to proceed in the executioun therof as thay might have done before the death of our said late soveraigne lord, notwithstanding that his matie be now deceast. Lykas the saids estats of parlement be thir presents dispenses with the not renewing of the forsaids writs abonespecefeit and any of thame and ordans thir presents to be a sufficient warrant to all persons concerned heirin to the effect abonespecefeit. It is alwise provyded that this present act shall not be extended to anie commissions of publict trust graunted to anie persons who be the act of classes made in this present parlement of the date the tuentie thrid day of Januar last are debarred and secluded from publict trust, and ordaines the samyne to be published at the mercat croce of Edinburgh and therafter to be printed.

Instructions from the parlement to their commissioners at London

As yow have hitherto faithfullie prosequute your instructiounes in useing all means for preventing the king's death, so shall yee tak speciall care and use the lyk diligence that ther be nothing done to the prejudice of the king's majestie that now is and that thair be no change in the fundamentall government. And whill yow hear any thing to be done to the contrarie, yow shall according to your former instructions enter your dissent and protestatioun in name of this kingdome. The maner and right tymeing therof is left unto yourselffis as upon the places yow shall think fit.

And seing your longer stay there in this present constitution of effairs is conceaved no more necessarie, yow are heereby warranted after the fulfilling of the afoirsaid instruction to come away in what way and tyme and in what maner yow think good.
