Procedure: lawfulness of the meeting of parliament

The estats of parlement, notwithstanding that at the last sessioun of parlement, quhilk was upon the thrid day of February instant, did adjorne the parlement till the 6th day of this instant moneth, yet the saids estats of parlement, being met this day, declairis this meeting and haill acts done therin to be laufull.

Proclamation: of King Charles II
Proclamation of Charles the second king of Great Britane, France and Ireland

[God save the King]

Forsomuch as the king's matie who lately reigned is, contrarie to the dissent and protestatioun of this kingdome, now removed by a violent death, and that by the Lord's blessing thair is left unto us a righteous air and laufull successor, Charles, prince of Scotland and Walles etc., now king of Great Britane, France and Ireland, wee, the estats of parlement of the kingdome of Scotland, doe thairfor most unanimouslie and cheerfullie, in recognisence and acknowledgement of his just right, title and successioun to the croune of these kingdomes, heereby proclaime and declare to all the world that the said lord and prince Charles is by the providence of God and by the laufull right of undoubted successioun and descent king of Great Britane, France and Ireland, whom all the subjects of this kingdome are bound humblie and faithfullie to obey, maintayne and defend according to the Nationall Covenant and the Solemne League and Covenant betuix the kingdomes with ther lyves and goods aganst all deadlie as their only righteous soveraigne lord and king. And becaus his matie is bound by the law of God and the fundamentall lawis of this kingdome to rule in righteousnes and equitie for the honour of God, the good of religioun and the wealth of his people, it is heereby declaired that before he be admitted to the exercise of his royall dignitie hee shall give satisfactioun to this kingdome in those things that concerne the security of religioun, the union betuix the kingdomes and the good and peace of this kingdome according to the Nationall Covenant and the Solemne League and Covenant, for the which end wee are resolved with all possible expeditioun to mak our humble and earnest address to his matie. For the testificatioun of all which wee, the parlement of the kingdome of Scotland, publish this our dew acknowledgement of his just right, title and successioun to the croun of these kingdomes at the mercat croce of Edinburgh with all usuall solemnities in the lyk cases, and ordaine his royall name, portrait and seale to be used in the publict wrytings and judicatories of the kingdome and in the mint house as wes usually done to his royall predecessors; and command this act to be proclaimed at all the mercat croces of the royall burghes within this kingdome and to be printed, that none may pretend ignorance theirof.

Followes the tennor of the instruments taken be his maties advocat upon the proclamatioun of the abonwrittin proclamatioun: Upon the croce of Edinburgh, the fyft day of Februar 1649 at tuelff hours of the day or thereby, the quhilk day compeired personallie upon the place foirsaid Sir Archibald Johnstoun of Waristoun, knight, his maties advocat and ane of the senators of the colledge of justice, and after reading of the proclamatioun whereby Charles the second is proclaimed king of Great Britane, France and Ireland, the said lord advocat asked instruments of me, Sir William Scot of Clerkingtoun, knyght, clerk of parlement (in quhose hands the saids instruments wer ordained be the parliament to be taken), upon reading of the proclamatioun forsaid, and that the said Charles the second was proclaimed king of Great Britane, France and Ireland. These things wer done day, yeir and place respective forsaids before thir witnesses, Johne, earle of Lowdoun, hich chancellor of Scotland, Archibald, marquis of Argyle and remanent noblemen, Mr George Wynrahame of Libbertoun, with the remanent of the commissioners of shyres, Sir James Stuart, provest of Edinburgh, and remanent commissioners of the burrowes then present and standing about the said croce, conforme to the ordors of parlement to that effect. In witnes quherof my subscriptioun manuall is heirto subjoyned. Sic subscribitur, W. Scot, clericus parliamenti.

Legislation
Act anent the solemnities to be keeped in reading and proclaming the proclamation abonwrittin

The estats of parlement, for the more solemne reading and proclaiming of the proclamatioun forsaid, ordaines the croce of Edinburgh to be all covered with hangings and the guard of the toune to stand in tuo ranks from the parlement house doore to the croce and about the samyne and the haill members of parlement to walk within the said guard to the croce forsaid in tuois, the last in the rolls going first in ranks, and to stand all round about the croce, the noblemen being in the middle, the commissioners for shyres being on thair right hand and the commissioners of burrowes being on ther left hand; and ordaines Johnne, earle of Lowdoun, lord high chancellor of Scotland, efter thryse sound of trumpet, to goe upon the croce and read the said proclamatioun, and ane herauld, accompanied with his brethrene heraulds, to proclaime the samyne; and gives warrant to Sir Archibald Johnnstoun of Waristoun, his maties advocat, to goe up lykwise upon the said croce for taking instruments upon the reading and proclaiming of the proclamation abonwrittin in the hands of Sir William Scot of Clerkingtoun, knyght, clerk of parliament, who is lykwise ordained to be upon the said croce; and for that effect ordaines the provest and baillies of Edinburgh to mak patent the doore of the samyne croce. And after reading and proclaiming of the forsaid proclamatioun, ordaines the haill members of parlement to return to the parliament hous after the same ordor as they goe there, and after reading and proclaiming of the proclamatioun forsaid, ordaines the haill bells to be tolled and the canons in the castle to be shot, quhilks haill premises wer accordinglie done. And whill the lord chancellor craved to enter the said croce, it was enquired be the provest and baillies of Edinburgh what his lo[rdship] was going about to doe, who answered: 'To proclaime Charles the second king of Great Britane, France and Ireland'. Immediatlie thairefter the provest and bailies of Edinburgh, most cheerefullie and willinglie, to testifie ther approbatioun therto, did open the doore of the said croce and caused ordor the way up therto. Act in favors of Jhon Campbell

The quhilk day Jhon Douglas, maisser, being commanded be the estats of parliament to put on ane of the heraulds coats and to goe to the croce of Edinburgh with the heraulds that were present, some of them being out of toune for the tyme, for proclaiming of King Charles the second king of Great Britane, France and Ireland, answered by desyring that some of the meassers of sessioun might be appointed for that effect and immediatly thairefter removed out of the parlement; who being called upon and not being present, the estats of parlement appointed Johne Campbell, servitor to the lord chancellor, to put on the said coat. In obedience quherof, the said Johne Campbell, having put on the samene coat, the said estats discharged and be ther presents discharges the said Johnne Douglas of his office and place of measser in all tyme comeing for his contempt and disobedience of the parliament's command for taking on the said coat of armes and going to the croce to the effect forsaid, and nominats and presents the said Johnne Campbell to the said place and office of measserie, and ordaines the said Jhon Campbell to exerce the same office in parlement, committee, counsall, exchequher and utherwayes in place of the said Johne Douglas, with all dignities, fies, casualities, liberties, priviledges, immunities, commodities, emoluments, profits and dewties pertayneing to the said office of measserie before the parliament, secreit counsall and otherwise as aforsaid, siclyke and als frielie and in the samene maner as the said Johnne Douglas had the samyne office before or as any uther measser had or held the said office and benefite therof in tyme bygane or shall have in tyme comeing.

Order: for the delivery of seals of the mint

The estats of parlement ordaines the keepers of the haill seals, cashet, signet and yrons of the cunyie hous to exhibite and delyver the samen to Johnne, earle of Lowdoun, high chancellor of Scotland, that therafter the saids estats may tak such ordor theranent for altering or changeing of the samyn as they shall think most fitting.
