Forsameikle as the estats of parliament upon the thretteinth day of Januar instant, upon consideratioun of the quere offered to them be the earle of Cassills, viz: if any person guiltie of the crymes in the second classe of the act of classes might sit and vote in parlement, they then found that none guiltie of the crymes contayned in the forsaid second classe might sit or vote in parlement; quherupon the earle of Cassills desyred it might be moved to those members of parlement sua guiltie that they sould remove themselfis till they were cleared, otherwise he would name them be their names. Upon this Johne Diksoun of Hartrie, commissioner for the shireffdome of Peblis, understanding that the earle of Cassills was to questioun him as guiltie of the crymes in the forsaid second class, in all humility desyred the parlement to tak to ther consideratioun the decreet of the committee of proces quherin he is alreadie cleared and not only fred of censure upon the grounds contayned in ther decreet bot also thereby ordained to be gratified, and that the parliament had continowallie sensyne admitted and continowed him in his former service and trust in parlement, and that also hee hes bene admitted in the last synode of Edinburgh and other kirk judicatories. Heerupon the parlement the day forsaid appointed a committee and gave them warrant to tak the premises in consideratioun and accordinglie to reporte ther opinion to the parlement. Quhilk report, being produced in wryte under the hand of the president of that committee upon the fyfteinth day of Januar instant and then red in audience of the parlement, thay ordained the said Johne Diksoun, his declaratioun upon oath, to be takin in face of parliament upon such interrogators as sould be presented and given in be anie member of parliament. Quhilk being this day of new againe moved in parliament, the earle of Cassills produced a paper contayning such interrogators as hee desyred the said Johne Dikson to be interrogat upon and to declare upon oath; and these being red and considered be the parliament, they therupon called in the said Johnne Diksone in face of parlement and took him solemnlie suorne to declare, quhilk hee accordingly did, being punctuallie interrogat. And now the estats of parliament, having heard and considered his oath and declaratioun, with the forsaid decreet of the committee of processe and ratificatioun of parlement in March 1647 ratifying the proceedings of that committee, together with the said Johne Dicksoun, his cariage and grounds quherupon the said decreet of the committee of processes was graunted and remanent premises forsaids concerning him, they, after full debate theranent and voyceing, fand that the said Johne Dicksoun of Hartrie should be admitted to sit and voyce in parlement as comissioner for the said shirefdome of Peblis, and thairfor they doe heirby admit him to sit and vote as a member of parlement, conforme to his commission produced and oath of parlement already takin be him as not guiltie of the crymes conteinit in the second classe of the forsaid act of classes. Quherupon the president of parliament pronounced to the said Johnne Diksoun the determinatioun of parliament afoirsaid and ordained him to sit doun in parlement as a member therof.
