The estates of parliament, haveing heard and considdered the act or instrumentis produced be the laird of Arniestoune of the daite the penult of Maii 1648 maid that day in the meeting of the committee of warr of the shirefdome of Midlowthean, bearand that the Lord Ramsay and remanent persones of the committee of warre of the shyre mentionat in the first pairt of the act haveing met in committee, it wes proponed be the laird of Arniestoune, ane of the said committee and president of the meeting of the foirsaid shire, that the committee and sick memberis therof as had formerlie accepted that charge and given ther oathes of faithfull administratioune sould mak choyse of a new president to this meeting, and that in the electioune of the president sick persones as were nominat to be upone that committee be the parliament sould ather remove or sitt still and not vote any till the oath foirsaid sould be administrat to thame be the president so to be choysen, conforme to ane act of the committee of estaites of the 16 of Maii lastbypast; and that the samyne wes altogither refuised and denyed be the lord advocat and haill persones of the said committee wha had not formerlie accepted, alledging they could not be debarred [fra haveing voice in the electioune of the president be the foresaid act of committee]†, seing they were elected to be memberis of the committee of the schire be the parliament, as the foirsaid act or instrument subscribed be Mr George Stratoune, clerk to the foirsaid committee, mair fullie beires. The saidis estates of parliament approves the foirsaid first constitute committee abovementionat specefeit in the first pairt of the foirsaid act and wha hes accepted the chairge and given ther oathes of faithfull administratioun theranent in maner specefeit in the said act, and ordaines and appoyntis these utheris persones nominat to be on the committee of warr of the foirsaid schire and wha took the oath apairt frome the foirsaid first constitute committee abonespecefeit to take the samen oath of new againe judiciallie befoir the said committee, conforme to the said act of the committee of estaites of the said 16 day of Maii 1648 yeeres, utherwayes the estates dischairges these that sall not take the samyne oath of new againe judiciallie as said is to sitt have place or voyce in the foirsaid committee of warr of the shirefdome of Midlowthean, whairanent the estates declaires thir presentis sall be an warrand.

The estates of parliament, haveing heard the supplicatioun of Sir Charles Erskene of Cambuskenneth, knyght, shewing that the parliament had granted warrand to him for possessing of himselff in the castell of Dumbartane, conforme to his gift for keeping therof, and that according therto he wes to repaire thither for that effect, and thairfore desyreing the parliament to signifie ther pleasor to him anent the gariesone of the said castell and what number of men they doe allow for keeping therof, as the supplicatioun beires, they doe heirby remitt the foirsaid supplicatioun and desyre therof to the committee of 33, and be thir presentis grantis power to that committee to determine anent the foirsaid supplicatioune and desyre therof, whairanent thir presentis sall be ane sufficient warrand.

The estates of parliament, haveing tane to ther consideratioune the reporte of the committee of 24 concerneing these magistrattis, counsellors and utheris of the burgh of Glasgow incarcerate in the tolbuith of Edinburgh, and heirwith also considdering that they be ther ordor of the thrid of this instant did inlarge James Stewart, Robert Finlay and Johne Fleming, thrie of the saides persones, out of the said tolbuith and confyned thame in ther ludginges and chalmeris in Edinburgh, the saidis estates ordaines the haill remanent magistrattis, counsellors and uthers of the toune of Glasgow wha yit remanes imprisoned in the tolbuith of Edinburgh, viz: Robert Mak, Johne Grahame and Williame Lightbodie, baillies, William Dunlope, deane of gild, Robert Hamiltoune, James Hamiltoune, Niniane Andersone, Peter Johnestoune, Thomas Allane, James Armor, Robert Hoggisyaird, Robert Wilsone, Walter Bryce, all counsellors of the said toune of Glasgow, and Mr Johne Spreull, ther clerk, to be inlarged and put to libertie furthe of the said tolbuith of Edinburgh whair they remane incarcerat, and confynes thame and everie ane of thame with the uther thrie persones abonespecefeit, viz: James Stewart, provest of Glasgow, Robert Finlay and Johne Fleming (wha were formerlie confyned within ther chalmeris and ludginges in Edinburgh) within the toune of Edinburgh and portis therof, and ordaines thame and everie ane of thame to remaine confyned within the said burgh of Edinburgh and portis of the samyne during the pleasor of parliament or committee of parliament. And for this effect the estates of parliament gives heirby power and warrand to the magistratis of Edinburgh to put the foirsaidis persones abonenamed to libertie furth of ther said tolbuith and waird, to the effect they may remane confyned within ther said toune and portis therof as is afoirsaid. And in the meane tyme the estates remittis to the foirsaid committee for consideratioun of the government of the toune of Glasgow and of the toune of Lanerk and all utheris who are of the lyk conditioune with these, and what farder is to be done in relatioune to the persones abonenamed ordained to be inlarged as said is; and ordanes the said committee to reporte to ther parliament thair thoughtis and opinion heiranent, that the parliament may tak sick farder course therefter concerneing the samyne as they sall think fitt just and reassonable. And the parliament liberatis the saids James Stewart, Robert Finlay and Johne Fleming fra ther former restraint and confynement within ther chalmeris and ludginges in Edinburgh, and confynes them within the said toune of Edinburgh and portis therof.

The quhilk day this act following: Edinburgh, 16 Maii 1648. Forasmuch as the committee of estates are informed that diverse persones nominat to be on the committee of warr of the severall shyres refuiseth to accept that chairge and trust and will not give ther oathes for the faithfull administratioun of what is therby intrusted to thame, and the comittee finding themselves obleidged to take such course as the publict service be not therby obstructed, doe therfoir ordaine and command all and sundrie the severall persones nominat be parliament to be on the committees of warr of the severall shires who have or sall accept that chairge and give ther oathes of faithfull administratioun, that they goe on be themselves in the dischairge of ther commissioune and dischairgeth such as dothe not accept and give ther oathes frome being admitted on the committees or haveing any voyce therin ay and quhill they give ther oath and accept or till the parliament take furder ordor therin. Extractum etc. Sic subscribitur, Archbald Prymrose. Being red in audience of the parliament, the estates of parliament ratifies and approves the samyne in all poyntis conforme to the tennoris therof, and ordaines the oath abonewrittin to be tane be each persone and member to be admitted in the severall committees of shires befoir they be receaved as memberis therof and have place and voyce therintill.
