The erle of Eglintoune protested that the inrolling of the erle of Glencairne befoir him prejudge not him of his dew place, and, for qualifieing of his entres to quarrell the samyne, he gave in ane paper to the lord chancellour, whilk the estates appoynted to be taken in consideratioune efter publict bussines are at ane cloise.
The erle of Glencairne protested that when the foirsaid paper sall be red that he may be hard to object against the ingiveing therof and why it cannot be receaved efter sight.

The estates of parliament, taking to ther consideratioun that in ther debate anent the commissioune granted be the barronis and frieholderis of the shirefdome of Berwick to Sir Harie Home of Heirdrig and Alexander Home of Plandergaist to be commissioneris of parliament for that schyre, they have fund the said commissioune swa farr as the electioune is therby maid of the said Sir Harie Home to be gude and valide and ordaines the samyne to stand for him, conforme to the tennor therof; bot findis that Alexander Home of Plandergaist could not have bene electit commissioner for the schyre at the tyme of the foresaid electioune and daite of the said commissioune produced, not being thane at that tyme the kingis vassell, and thairfore the saidis estates of parliament ordaines the barrones and frieholderis of the said shirefdome of Berwick to mak choyse and electioune of ane commissiouner with the said Sir Harie Home for thair shire, and for this effect ordaines the haill barronis and the frieholderis of the said schirrifdome of Berwick to conveene at Dunce upone Fryday nixt, the tent of this instant, for electing of ane commissioner for thair shyre to be joyned with the said Sir Harie Home, for whome the former commissioune is sustained as said is; and for warneing of the saidis barrones and frieholderis to conveene at Dunce the day foirsaid to the effect abonementionat, ordaines publict proclamatioune to be maid heirof at the mercate croce of Dunce upone Tuysday nixt, the sevint of this instant, that nane pretend ignorance heirof, and ordaines the said Sir Harie Home to caus proclame this present act for conveeneing the saidis barrones and frieholderis the day foirsaid to the effect befoir reherst, whairanent thir presentis sall be ane sufficient warrand.

The estates ordaines this to be enacted and statute in all tyme cuming: that no nobleman nor uther persone who hath not voyce in the electioune of commissioneris of shyres as ane barrone or frieholder sall heirefter sitt or be present with the barronis and frieholderis at the electioune of the saidis commissioners, except the clerk of courte, with certificatioun that any electioune utherwayes maid sall be null and ineffectuall; and ordaines the clerk of register to draw up ane act heirupone.
