Procedure: opening of session

Whilk is the day appoynted be the last act of the last parliament holden at Edinburgh, beginand the thrid of November 1646 and endand the 27 of Merch 1647, to be the day of meiting of the estates of parliament in this second trienniall parliament.

Prima dies parliamenti

Parliamentum quartum excellentissimi principis Caroli dei gratia Scotie, Anglie, Francie et Hibernie Regis fideique defensoris, holden at Edinburgh be the estates of this kingdome, viz: the noblemen, the commissioneris for the barrones and the commissioneris for the burrowes, this day conveened in parliament be vertew of the last act of his maties second parliament holden be his hienes and the thrie estaites in anno 1641 and be vertew of the foirsaid last act of the last parliament of the twentie sevint of Merch 1647.

Procedure: protests over precedency

The erle of Eglintoune protested that the calling and ranking of the erle of Glencairne befoir him prejudge not him of his dew place of precedencie prior to the erle of Glencairne.

The erle of Glencairne protested in the contrair, and that the erle of Eglintoun can have no entres to quarrell the same efter the decisioune betuixt thame of the precedencie in favoris of Glencairne.

The erle of Callender protested that the calling of the erle of Levin befor him should not prejudge him of his dew place of prioritie as erle.

The erle of Rothes for the erle of Levin protested in the contrair.

The commissioneris for the schirrifedome of Fyff protested that the calling of the comissioneris for the shirefdome of Edinburgh first doe not importe ane acknowledgment of prioritie, and that it be but prejudice to the schire of Fyff of thair dew place.

The commissioneris for the schirrifedome of Edinburgh protested in the contrair.

The commissioneris for the shirefdome of Perth protested against both the saidis protestatiounes, and that the calling of these twa shires befoir Perth doe not prejudge that shire of its owne dew place.

Mr Robert Meldrum protested against any commissioune given in for the shirefdome of Clakmannane except that given in be him, and that nane uther be respectit for the ressounes given in be him.

Sir Charles Erskene protested in the contrair.

Archbald Sydserff, in name of the burrowes, protested that the calling of any comissioneris for the stewartrie of Kirkcudbright in the rollis of parliament prejudge not the libertie of the frie royall burrowes.

Procedure: controverted election in Inverness-shire

Sir James Fraser of Bray for the schirrifedome of Innernes protested against the electioune of any other commissioner for that shire, and that no uther comissioune sould be respected bot that given in and produced be him inrespect of the protestatioune produced be him in writt.

Procedure: oath taken

It is statute and declaired be the estates of parliament that notwithstanding any wha hes produced comissiounes to this parliament sall take the oath of parliament, yeet notwithstanding it sall be laufull to quarrell thair saidis commissiounes eftir thair taking of the oath of parliament and notwithstanding therof.

Efter calling of the rollis the oath of parliament, appoynted to be taken by all the memberis of parliament at the beginning of everie parliament or sessioune of parliament, was publictlie red in audience of the parliament, and therefter tane be the haill memberis of parliament present ut supra.

Act anent the electioune of the erle of Lowdoun, chancellour, to be president of parliament

The estates of parliament, now conveened in this second trienniall parliament, taking to thair consideratioune the fyftie act of the kingis maties second parliament holden at Edinburgh in anno 1641 intitulat 'Act anent the electioune of the president of parliament', togidder with the 42 act of the last sessioune of the first trienniall parliament of the daite at Edinburgh, the 27 Merch 1647 yeeres intitulat 'Act anent the electioune of ane president of parliament for ilk sessioune of parliament', explaineing the former act concerneing the tyme of the indureance of the president of parliament, and according heirunto Johne, erle of Crawfurd Lindsay, president of the last parliament, haveing ministred the oath of parliament to the haill memberis of parliament present and represented to thame the foirsaidis twa actis of parliament abonementioned, whilkis wer red in audience of parliament, the saidis estates of parliament, efter voyceing, did elect and choyse Johne, erle of Loudoun, high chancellour of Scotland, to be president of this sessioun of parliament, and to preceid thairintill as president of parliament during this sessioune of parliament and whill the taking of the oath of parliament and electioun of another president in the nixt sessioune of parliament, quhilk nixt sessioune of parliament is to be appoynted be the last act of this sessioune of parliament when this sessioune sall dissolve, conforme to the foresaid 42 act of the last parliament of the 27 of Merch 1647 yeeres.
