Act l[aird of] Capringtoune

The estates of parliament, taking into thair consideration the fyne of auchtene thousand pundis Scotis imposed upon Sir Williame Cunynghame of Capringtoune according to the rule of classes prescryved be the act of parliament at St Androis for his delinquencie, and heirwith also considering the burden of his debt and inhabilitie to pay the said fyne, his whole land rent not being able to pay the publict burdens and the two pairt of his anuelrentis, togidder with the report and opinion of the committie for processes and moneyis concerning the laird of Capringtoune, his said fyne, burden of debt, inhabilitie to pay the fyne and formar cariage, with his constant attendance upon publict imployments since the beginning of thir troubles, testified be the committie of the schyre quher he lives, and that he sent out his narrest kinsfolkis and houshold servandis in the countries service with ther armie at Philiphauche, himselfe becomeing in the enemies power, quhilk hardlie he could eschew, the saidis estates of parliament, inrespect of the aforesaid premises, doe heirby dispense with the foresaid fyne and renuncis and quytes the samen unto him, and declares him quyte and frie off all payment therof and of the decreit and sentence given aganis him theranent with all that hes followit or may follow therupon for payment of the foresaid fyne of auchten thousand pundis abonementioned, quhilk they heirby discharge in his favours.

Act l[aird of] Grangehill

The estates of parliament, of consent of Alexander Brodie of that ilk, ordanis the declaration eftirmentioned to be insert in the ratification granted be the parliament in favors of the laird of Brodie, ratifieing the act of the committie of estates of the tuentie day of May jM vjC fourtie sex yeirs past in his favors, off the quhilk declaration the tenor followis, viz: The estates of parliament declares that the foresaid act and ratificatioune therof sall nowayis be extendit aganis Niniane Dumbar of Grangehill, nor his airis and successors, nor aganis anie richtis of multors, nor aganis anie uther richtis, indentors, actions or uther writtis or securities personall or reall perteining or competent to him for himselfe or as air or appeirand air to anie of his predicessors. Quherupon the said Niniane Dumbar of Grangehill askit instrumentis, and farder protested that the foresaid ratification, with all that might follow therupon, sould be without prejudice of anie just grund of persute and action that could be moved or intented be anie gentleman or heritor within the shirefdome of Elgine and Forres upon anie writ or evident aganis the said Alexander Brodie or his airs and successors, for himselfe or as air to anie of his predicessors, unprejudged be the foresaid act and ratificatioune therof. And the said Alexander Brodie of that ilk protested in the contrair of the foresaid protestatioune made for the schyre and that the act abonementioned past in his favors, with the ratificatioune therof, togidder with his and his predicessors fourtie yeirs posession of the landis, teindis and uthers therinspecefeit and act of prescription in anno 1617, sould be ane sufficient grund and richt to bruik and posses the saids landis and uthers foresaids.

The estates of parliament, haveing hard and considered the suplicatioune of Colonell Robert Home, desyring that he sould not be removed from his charge as governour of Innernes quhill first his bygane arrears be payed and he thanked aff for his bygane service, as the suplication at mair lenth proportis, they find the desire of the foresaid suplication just and reasonable, and therfore they doe heirby appoint and ordane the said Colonell Robert Home to continwe still in his charge as governour of Innernes untill his bygane arrears be payit and he thanked aff for his formar service, quheranent the estates declares thir presentis salbe a sufficient warrand.

Act creditors of James Grahame

The estates of parliament, taking in consideration the suplicatioune of Johne, erle of Wigtoune, David, erle of Southesk, David Grahame of Fintrie and Mr James Grahame of Monorgund, for themselfis and in name of the rest of the creditors of the late erle of Montroise, schewing that be actis of parliament and committie of estates the estate of James Grahame, late erle of Montroise hath bene appointed to be sauld for releife of his cautioners and payment of his debtis, and that notwithstanding therof warrande is given be the parliament to the erle of Tullibardine to sell the woode of Kincardine to his awne behove, quhilk will prejudge the sale of the landis more then the worth of the woode; and thairfore desyring that the warrand may be recalled and all execution therupon stayed till the generall ordor appointed for selling of the estate be first agried and concluded, as the suplication proportis. The saidis estates of parliament ordanis and allowis that what is alreadie cutt of the foresaid woode of Kincardine salbe disposed upon be the erle of Tullibardine for his awne use in payment to him pro tanto of the sowmes contenit in the act granted in his favors, and restraines and discharges the cutting of the foresaid woode of Kincardine intymcomeing in prejudice of the sale of the landis. Bot the estates declares that the landis being sauld and the marques of Argile satisfied, that the woode salbe hypothecat or pryce therof to the said erle of Tullibardine for his assurance and payment of the sowme of fyve thousand pundis Scotis as the pryce of the said woode, compting alwayis therintill as ane pairt therof that quhilk the erle of Tullibardine hes gottine or sall get for that quhilk is alreadie cutted of the said woode.

The estates of parliament, taking into thair consideration the suplicatioune of Jacob Bwiret, eldest sone to umquhile Jacob Buret, ane of the Gina companie, schewing that umquhile David Jonkine, merchand in Edinburgh, be his band of the tent of March 1638 obleist him to pay to the suplicant or his said umquhile father or either of them tua hundereth fourscore threttine pundis, ten pence sterling and tuentie pund sterling of penultie, and that the relict and executors of the said umquhile David Jonkine intendis to suspend the foresaid band; and thairfore desyring to discharge the passing of anie suspension or ellis to remitt the discussing therof to the commissars of Edinburgh, that the suplicant, who is ane stranger, be not delayed. The saidis estates of parliament, inrespect the suplicant is ane stranger and necessitat to goe out of the cuntrie, doe therfore heirby discharge the lordis of session to pas anie suspension aganis the band abonementioned and execution therof in favors of the relict, air or executors of the said umquhile David Jonkine except under the handis of thrie of the saidis lordis of session, and ordanis these lordis to caus warne the pairtie quhen the bill of suspension salbe presented to them, and therupon to heare the pairteis anent the ressones of the said suspension and to discuss the samen ressones albeit the session be not sitting. For doeing quherof the saids estates of parliament gives heirby power and warrand to the saidis lordis of session (or ony thrie of them) albeit the session be not sitting as said is, quheranent the estates of parliament be thir presentis dispenses.

Forsamekle as the estates of parliament, taking to thair consideration the suplication of Archbald, marques of Argyle, schewing that the estates of parliament, be thair act of the date the [...] day of [...] 1644 yeirs and be ther uther act of the date the [...] day of March 1645 yeirs, upon consideration of the great sowmes of money than dew and adebted to him be the kingdome, did appoint some wayis for his payment and releife in maner mentioned in the saids actis, quherof he had not occasion as yit to ryipe the benefite therof; and thairfore desyring that the parliament wald declare the saids actis to stand and to be unprejudgit be anie actis granted in favors of anie persones since, and that the suplicant may enjoy what was allowed to him be the saids actis, conforme to the tenors therof, as the suplication beirs. The saidis estates of parliament findis the desire foresaid of the said suplication just and reasonable and grantis the samen, and therfore they ratifie and approve the foresaids tua actis abonementioned granted in favors of the suplicant of the dates abonewrittin in the whole headis, articles and clauses therof and conforme to the tenors of the samen in all pointis; and declares and ordanis the saids actis to stand in full force, strenth and effect, conforme to the tenors of the samen quhilks ar of the dates beforerehearsed, and to be unprejudged be anie act granted in favors of anie persone since, and that the suplicant may enjoy what was allowed to him be the saids actis, conforme to the tenors therof, but prejudice of prior assignementis before the dates of the tua actis abonewrittin heirby ratified.

The estates of parliament, taking to thair consideration that they be ther act at St Androis of the fourt of Februar 1646 yeirs ordanit the committie for the moneyis to mak payment to Alexander, erle of Eglintoune off the sowme of tuentie foure thousand, tua hundereth thriescore merks Scotis money and anuelrentis therof adebted to him be the publict, lykeas be ther act of the tuentie fourt of Februar lastbypast they had assigned to the erle of Eglintoune alse meikle of the laird of Drwm, his pane and fyne of contravention incurrit be him for breaking of the band given be him for his good behaveor as wald pay the erle of Eglintoune of his sowme abonementioned, reserveand to the relict and bairnis of umquhile Alexander Pearsone and uthers pretending interest thair richtis to the laird of Drwm's contravention; and heirwith also considering that the pane of contravention incurred be the laird of Drwm is sensyne utherwayis disposed upon, the saidis estates of parliament doe therfore heirby maist seriouslie recommend the erle of Eglinton for his payment of the foresaids sowmes and anuelrentis therof dew to him be the publict to the committie of estates, to tak some effectuall course for his satisfaction and payment of the saids sowmes principall and anuelrentis adebted to him be the publict as said is, conforme to the formar actis granted to him therupon for his said payment, quhilk as yit hes provine useles to him, but prejudice of the payment of the armie and of formar assignementis.

The estates of parliament, taking into thair consideration the suplicatioune of Margaret Crawfuird, relict of umquhile Lieutenant Colonell William Crawfuird, schewing that thair restis dew to hir as relict what is awand to hir umquhile husband for his monethis pay at Philiphauche and for his arrears dew for his service in England, and desyring ordor to Colonell Fraser to mak payment to hir of the foresaids arrears dew for hir umquhile husband's service, and that the parliament wald bestow upon hir what farder satisfaction they of ther bountie sould think good in consideration of the losse of hir husband. The saidis estates of parliament ordanis the said Colonell Fraser to pay to the suplicant what is dew for hir umquhile husbandis arrears for his service in England, togidder also with hir umquhile husbandis monethis pay for his service at Philiphauche, and remittis and recommendis the suplicant to the committie of estates for the uther pairt of the desire of hir suplication anent the consideration craved be hir for the loiss of hir husband in the cuntries service, to be tane in consideration be the said committie and with power to them to doe therintill as they sall find just and ressonable.

The estates of parliament, taking to ther consideration the report of that committie appointed for reveising of billis and suplicatiounes concerning the suplicatioune of Sir Gilbert Ramsay of Balmayne, for himselfe and in the behalf of his eldest sone and tennentis, schewing ther sufferingis and great loisses and craveing reparation therof, the saidis estates modifies and allowis the sowme of fyve hundereth pund sterling to be given to the suplicantis for ther present subsistence and towardis the reparatioune of ther loisses by the foure thousand merkis Scotis formarlie granted by the committie of processes to the said Sir Gilbert Ramsay for his subsistence, quhilk sowme of fyve hundereth pund sterling the estates of parliament ordanis to be payit to the said Sir Gilbert Ramsay, for himselfe and in name and behalfe foresaid, out of the last ane hundereth thousand pund sterling dew and payable be the parliament and kingdome of England to this kingdome. And for this effect the estates of parliament doe heirby grant right and assignement to the said Sir Gilbert Ramsay, for himselfe and in the behalfe foresaid, for the said sowme of fyve hundereth pund sterling to be payed out of the foresaid last ane hundereth thousand pund sterling abonementioned, but prejudice of formar assignementis therof, and be thir presentis grantis power, precept and warrand for payment of the said fyve hundreth pund sterling out of the said last ane hundereth thousand pund sterling abonewrittin to the said Sir Gilbert Ramsay, for himselfe and in the behalfe of his said sone and tennentis, or to anie haveand his power and warrand to ressave the said sowme upon his or ther discharges therof, whose discharges of the same the estates of parliament declares salbe ane sufficient exoneration theranent to the payers therof and to all that ar interest or may be concerned therintill. And alse the estates of parliament, considering that the sowme of ane thousand merkis of the formar foure thousand merks abonementioned was ordanit to be payit to the suplicant be Robert Pringle of Stitchell, wha hes suspendit the same or purchest act of this session of parliament delayeing the payment therof and all execution for that effect, the saidis estats doe therfore heirby rescind, discharge and mak voyid all actis and ordinances made in favors of the said Robert Pringle of Stitchell delayeing or stayeing the execution and payment of the said ane thousand merkis to the suplicant, and ordanis the formar decreitis and warrandis granted in favors of the suplicant for that sowme and for the uther thrie thousand merks abonespecefeit to have effect and to be put to farder execution against the persones and pairteis therinmentioned for payment of the saids sowmes respective therincontenit to the said Sir Gilbert Ramsay, suplicant, quheranent thir presentis salbe ane warrand.

Scotis money, and in the meantyme to have ther landis exeamed fra all publict dewis, the saidis estates of parliament modifies and allowis the sowme of tuentie thousand punde Scotis to be given to the suplicantis for ther present subsistence and towardis the reparation of ther loisses, quhilk sowme of twentie thousand punds Scotis the saidis estates ordanis to be given and payed to the saids Johne Lindsey of Edgell and Margaret Wischart, relict of the said umquhile David Lindsey of Edgell, or to anie haveand ther power and warrand, out of the last ane hundereth thousand pund sterling dew and payable be the parliament and kingdome of England to this kingdome. The estates of parliament, taking to ther consideratioune the suplication of Mr Williame Dumbar, commissionar for the burgh of Forres, desyring his loisses and present hard condition to be tane in consideration and remeid provydit, being frequentlie plundered be the comoune enemie and takine captive be the capitan of the Clanronnald, quher he was keiped in waird and guarded quhill he contracted debt to ransome himselfe, as the suplication beiris, togither with the report of the committie for billis and suplications concerning the suplicant and his desire foresaid, the saidis estates of parliament modifies and allowis to the said Mr Williame Dumbar, suplicant, the sowme of ane thousand merkis Scotis to be given to him for his present subsistence and towardis the reparatioune of his loisses, and, for payment heirof, they doe heirby seriouslie recommend him to the committie of estates to tak some effectuall course for his payment out of the fynes of malignantis or by suche overtors as he sall give in and condiscend upon for his awne payment, with reservatioune of the mantenance of the armie and of the Lord Humbie's act and payment and uther formar assignementis.

The estates of parliament, haveing hard and considered the report of that committie appointed for reveising and fitting of the laird of Lawers, his regiment accomptis, they ordane the foresaid regiment to have presentlie payed to them the sowme of fourtie thousand merkis of the fourscore eighten thousand, tua hundereth fourscore ellevin pundis viij sh. Scotis, quhilk is fund sufficientlie instructed to be resting to the said regiment of ther two pairt pay. And for the remander of the accomptis of the said regiment, the estates ordanis them to be put in equall fitting with uther regimentis of England and Scotland with quhom they served in the saids two severall kingdomes. The estates of parliament, taking in consideration the suplicatioune of James, erle of Hartfell, schewing that Major Barras with his accomplices plundered and took away the suplicantis haill insicht and plenissing of his hous of Newbie, amounting to the value of tua thousand punds sterling and above, and therfore desyring the estates of parliament to signifie ther pleasur heiranent to the committie of Cumberland and to sie the suplicant restored to all was takine out of his hous, and lykewise that the samen might be recommended to the English commissionars by suche as ar appointed to treat with them, that they may use ther best endeavors in the suplicantis behalfe with the committie of Cumberland for the effect foresaid, as the suplication beirs, togither with the report of that committie appointed for reveising of billis and suplications concerning the suplicatioune abonementioned and desire therof, the saidis estates of parliament findis the desire of the foresaid suplication just and reasonable, and therfore they doe heirby seriouslie recommend the suplicant to the committie of Cumberland, desyring them to sie him restored to all that was takine out of his said hous of Newbie be Major Barras and his accomplices, and ordanis letters of recomendatioune to be writtin in his favors for this effect As also ordanis these formarlie appointed to treat with the English commissionars to deale with them in the behalfe of the suplicant, that they may use ther best endeavors for effectuating his desire foresaid.

Act anent the election of ane president of parliament for ilk session therof

The estates of parliament, taking into thair consideration the 50 act of our soverane lordis second parliament made anent the election of the president of parliament, quherin it is statut that in all succeiding parliamentis eftir the taking of the oathe of parliament by all the memberis therof they sould mak choise of the lord chancellor or anie uther the king or his commissionar and the estates sould appoint to be president of parliament, who sould remane and continwe president alsewell in that parliament quherin he is chosine as in the nixt parliament subsequent, untill the said oathe be takine and another chosine to be president in his rowme, as the said act mair fullie proportis, by the quhilk act it is not particularie expressed whither the president of parliament salbe changed ilk session of parliament or sall continwe during the rwning and severall sessions of a current parliament untill the indiction of a new parliament. For clearing quherof, the estates, upon good causes and considerations, statutis, ordanis and declares that in all tymcoming it salbe the first act at the beginning of ilk severall session of parliament eftir the taking of the oathe of parliament to proceid to the election and making choyse of a president for that session of parliament, who sall preceid in that session of parliament and whill the taking of the oathe and new election of ane uther president in the nixt session of parliament; so that in eache severall session of parliament, albeit the samen salbe current, thair salbe ane new election of a president for that session therof allanerlie and whill the oathe and new election in the nixt in maner abonewrittin.

Act toune of Bamff

The estates of parliament, haveing hard and considered the report and opinion of the committie for billis and suplications concerning the suplicatioune of the distrest burgesses and inhabitantis of the burgh of Bamff for reparatioune of ther loisses, extending to fyiftie ane thousand and sevin hundereth merks, and for ther uther desires and loisses mentioned in the said suplication, and heirwith also taking to ther consideratioune the overtors represented to the parliament be Gilbert Mair, commissionar for the burgh of Bamff, towardis ther satisfaction in some pairt concerning ther loisses and uther desires respective of ther suplication, the saidis estates of parliament modifies and allowis the sowme of ten thousand merkis Scotis to be given to the said Gilbert Mair for the use of the burgh of Bamff towardis the reparatioune and in pairt of payment to him and the remanent distrest burgesses and inhabitantis of the said burgh of ther saids loisses and for ther present subsistence. And for this effect the saids estates doe heirby assigne and dispone to the said Gilbert Mair, for himselfe and for the use foresaid, all and sundrie the fynes, forfaltors and panes of contravention for contravening good behaveor respective of the persones eftirnamed, viz: James Gordoun of Lettirfurie, Thomas Gordoun of Clashterim, Johne Gordoun of Litlemylne, [...] Gordounes, elder and younger, of Newcoundaw, [...] Gordoun of Cormellat, [...] Gordoun of Overhall, Johne Gordoun of Blelek, Robert Gordoun, baillie of Enzie, [...] Gordounes, his thrie sones, Johne Spence, herald, Jerom Spens, his sone, Mr James Kennedie, sumtyme wrytter in Edinburgh, Alexander and [...] Andersones, sister sones to Lettirfurie, [...] Andersone, generall commissar to the late marques of Huntlie, James Gordoune of Kirkinburne, Johne Gordoun of Gallachie, William Gordoun of Crakullie, Mr William Gordoun, advocat, Johne Gordoun of Fechill, [...] Gordoun of Oxbill, Alexander Innes of Davidstoune, Alexander Gordoun of Mwhorthies, Alexander Gordoune of Mwreaik, George Gordoun of Achannachie, Alexander Andersone in Dinmuie, Johne Gordoun of Avachie and Thomas Stuart of Drimenie, togidder also with the benefite of the forfaltor of anie of the persones abonenamed, if anie forfaltor salbe socht and obtenit aganis them, but prejudice alwayis of the formar assignementis of the saids fynes, contraventions or forfaltors of the persones abonenamed, if anie assignementis be formarlie granted therof prout de jure. And that this present assignement may be usefull to the end for the quhilk the samen is granted, the estates of parliament ordanis Adam Watt, wrytter and clerk to the committie in the north, to give up and delyver to the said Gilbert Mair all sick bandis as he hes in his power and custodie quhilks ar granted be the persones abonenamed or anie of them for ther good behaveor under the pane and sowmes respective contenit in the saids bandis, upon the said Gilbert, his ticket of recept therof, that he may mak use of the samen for himselfe and the remanent distrest burgesses and inhabitantis of the burgh of Bamff for getting payment of the sowmes and panes of contravention therinmentioned, to the use and for the effect foresaid. And alse the estates grantis heirby precept and warrand to messingers of armes to warne and cite the particular persones abonedesigned to compeir before the committie of estates at sick dayis and dyetis as the said Gilbert Mair sall designe and appoint under his hand to the saids messingers of armes, to heir and sie the forenamed persones censured, fyned and sentenced for ther complyance with the rebells and enemies of the kingdome, according to the rules contenit in the act of classes at St Androis; as also for contraveining the bandis given be them for ther good behaveor and thairby incurring the sowmes and panes of contravention therinspecefeit. And the estates ordanis the fynes, panes of contravention and sowmes respective that salbe decerned or imposed upon the persones abonenamed to be decernit be the committie to be payit to the said Gilbert Mair to the effect abonespecefeit, and ordanis him to doe diligence therupon for ingetting therof fra the persones aganis quhom the samen salbe decernit, and to apply the saids sowmes for payment of the aforesaid ten thousand merks Scotis allowed to him and the remanent distrest burgesses and inhabitantis of the burgh of Bamff for ther subsistence and towardis the reparatioune of ther loisses, and to be comptable to the publict for the superplus of the foresaids fynes and contraventions mair nor payis the said ten thousand merks abonespecefeit. And the estates putts it in the suplicantis option either to cite the foresaids persones before the committie of estates or before the parliament agane the nixt meitting therof as may be maist usefull for him. And alse the saids estates of parliament, taking into ther consideration that pairt of the desire of the said suplication and report of the committie theranent concerning the band of sex hundereth merkis given be the toune of Bamff to Colonell George Forbes of Mylnebowie for the pryce of certane cloathes and armes promitted be the toune to tuentie tua souldiors put out be them to the said colonell, his regiment, in August jM vjC fourtie sex yeirs, whilk regiment was casseired within few dayis eftir the granting of the said band and the saids souldiors returned bak to ther habitations, the saidis estates findis and declares the foresaid band to be voyid and null and doe heirby discharge the samen with all execution that hes or may follow therupon, and declares the suplicantis frie therof and of all payment of the foresaid sowme and haill obleismentis therincontenit.

Act Sir James Fraser and Johne Hay

Forsamekle as the estates of parliament, haveing tane in consideration the suplication of Sir James Fraser of Brae, schewing that he haveing ane wodset of the landis of Dollar fra Robert Cumyng of Alter for the sowme of tuentie thousand pundis, and that these landis wer burdened of before for the sowme of tuentie foure thousand merkis to umquhile Mr Johne Maxuell, sumtyme bishop of Ross, quherupon he and his wyfe was infeft in lyverent and his sone in fie in the saids landis, and that the said umquhile Mr Johne Maxuell, be ane bakband subscryved be him and registrat in the buiks of counsall, hes declared thair was nothing justlie restand to him bot onlie the sowme of ten thousand and fyve hundereth merks, quherof the said Robert Cumyng of Alter, as cautioner for the said umquhile Mr Johne Maxuell, hes payed to sundrie of his creditors the sowme of thrie thousand and fyve hundereth merks, so that thair is onlie restand the sowme of sevin thousand merks or therby; as also schewing that the suplicant took the wodset of the foresaidis landis with the burden of the said umquhile Mr Johne Maxuell's sowme, and that the anuelrent therof will belong to the publict inrespect of his rebellion and malignancie, and that the suplicant can find no more easier way for defrayeing a pairt of his loisses than to retaine the samen in his awne hand, and thairfore desyring warrand from the parliament for retaining of the foresaid anuelrent of sevin thousand merks be the suplicant in his awne handis in the first end of his loisses, as the foresaid suplication proportis. The saidis estates, upon consideration of the premises, doe heirby grant warrand to the said Sir James Fraser, suplicant, to reteane and keip in his awne hand the anuelrent of the foresaid sowme of sevin thousand merks perteining and adebted to the said umquhile Mr Johne Maxuell (the samen anuelrent being fund dew and payable to the publict), and ordanis the said Sir James Fraser, suplicant, to apply the tua pairt of the foresaid anuelrent to his awne use and behove towardis the reparation of his loisses pro tanto; and for the thrid pairt of the samen anuelrent the saids estates ordanis the said Sir James Fraser to mak payment therof to Johne Hay of Knokcawdie, to be applyed be him towardis the reparatioune of his loisses pro tanto. And the estates declares that thir presentis is alwayis but prejudice to the relict and creditors of the said umquhile Mr Johne Maxuell anent ther richtis respective prout de jure.

Act Lieutenant Generall David Leslie and Major Generall Midletoune

The estates of parliament, haveing hard and considered thir desires following represented to them be Generall Major Midletoune, viz: first, inrespect of his chargeable way of liveing, nevir haveing takine frie quarters, that a considerable pairt of his arrears may be presentlie advanced and the rest payed out of the fynes and forfaltors in the north, and these fynes and forfaltors may not be disposed of till he be payed if anie uther way sall not be thocht upon. 2. That he may be payit for the moneth of Januar, haveing bene still in charge, and in that respect that what he getis of the money comes to the armie in England may not be accompted anie pairt of his arrears. The saidis estates of parliament approves and allowis the desires and overtors abonewrittin and grantis the samen, and declares that the sowmes and arrears dew to Major Generall Midletoune sall beare anuelrent and interest therfore, payable be the publict to him quhill his payment of the samen sowmes, and doe heirby obleidge the estates of the kingdome to him for that effect. And alse the estates of parliament, heirupon taking to ther consideration the sowmes and arrears dew and adebtit be the kingdome to Generall Lieutenant David Leslie, they doe thairfore heirby grant and declare the lyke in his favors as is granted in favors of Generall Major Midletoune, and that the sowmes and arrears dew to the said Lieutenant Generall David Leslie sall lykewyse beare anuelrent and interest to him quhill the payment therof, lykeas they obleidge the estates of the kingdome to him for that effect.

The estates of parliament, haveing hard and considered the report of that committie appointed for hearing of the suplications and fitting of the accomptis of the burgh of Abirdene and uther distrest burghes and schyres, concerning the suplication and accomptis of the said burgh of Abirdene for payment of ther quarteringis, the Fleymis money and other sowmes furneist and lent be them for the use of the publict by order of the committie of estates, they find that thair is justlie restand awand be the publict to the toune of Abirdene, of Fleymis money advanced be them in anno 1641 and of uther moneyis furneist and lent be them and payed to Johne Denholme, commissar for the north, in anno 1644 be order of the committie of estates, the sowme of threttie nyne thousand, fourscore foure punds 10 sh. 8 d. money of principall sowmes and anuelrentis at Candlemes lastbypast jM vjC fourtie sevin yeirs, by uther great sowmes of money borrowed from severall persones, inhabitantis of the burgh of Abirdene, and not compted nor comprehendit in the sowme abonewrittin, quhilk sowme of threttie nyne thousand, fourscore foure punds 10 sh. 8 d. abonementioned the estates of parliament declares to be ane publict debt adebtit be the kingdome to the burgh of Abirdene, and grantis heirby to them the publict securitie and publict faith for payment therof to them with anuelrent for the Fleymis money and lent moneyis foresaid since Candlemes last and whill the payment, and doe heirby obleidge the estates of the kingdome for that effect and ordanis the foresaid Fleymis money and anuelrentis therof, with the anuelrent of the said lent moneyis, to be payit out of the excise of the kingdome eftir the sowme appointed out of the excise for mantenance of the armie beis first compleit and made up to the armie. And alse the saids estates of parliament findis by the foresaid report that thair is restand awand to the burgh of Abirdene and inhabitantis therof be the publict for quarteringis of horsse and foote, officers and souldiors their from tyme to tyme at frie quarters preceiding the tuentie of Februar jM vjC fourtie sevin yeirs, and for uther incident necessar charges debursed be them upon warrandis instructed, the sowme of twa hundereth tuentie ane thousand, threttie sex pundis, fyve schillingis Scotis money, and that it is the opinion of the foresaid committie that suche restis as is yit unpayit be the toune of Abirdene of ther awne mantenance of the first sevintene monethis sould be allowed to them in pairt of payment of ther saids quarteringis. Quhilk article of the foresaid report concerning the foresaids quarteringis and uther incident charges debursed be the toune of Abirdene, amounting to the foresaid sowme of two hundereth tuentie ane thousand, threttie sex punds 5 sh. Scotis money, with the alloweing of these rests of the toune of Abirdene mantenance of the first sevinten monethis, suche as is unpayed therof to them in pairt of payment of the saids quarteringis, the saidis estates of parliament, inrespect of the singular caise and condition of the toune of Abirdene, remittis to the committie of estates to be tane in consideration be them, and with power to them to determine theranent and tak some effectuall course for the tounes releife therof as the committie sall find just and reasonable, but prejudice of the payment of the armie and with reservatioune of the Lord Humbie's act and payment and of formar assignements, and that no assignements be granted of anie of the money dew be the parliament of England to this kingdome.

Act erle of Mortoune and toune of Edinburgh for the schyres of Orkney and Zetland

The estates of parliament, taking to there consideration the suplication of William, erle of Mortoune and of the provest, baillies and counsell of Edinburgh, for themselfis and in the behalfe of the haill heritors and inhabitantis of Orkney and Zetland, schewing that be the late act of excise thair is tuentie shillingis of excise ordanit to be payit for ilk boll of malt within the haill kingdome, quhilk if it be extendit to Orkney and Zetland will wtterlie rwine the maist pairt of the inhabitantis therof inrespect these ylelandis produce almost no other graine but beare and that so base and small stuff quhilk, eftir it is transported to Leith and uther sea portis in the south pairt of this kingdome, the transporters therof, eftir they have endured the hazard of the sea, doe ordinarlie sell it for fyiftie shillingis the boll, quhilk is not the halfe pryce that beare in Fyiff and Lothian gives; and therfore desyring to mitigat the foresaid excise imposed upon beare so farre as it may be extendit to the foresaids ylelandis of Orkney and Zetland and to the haill beare that sall happine to grow upon anie of them, as the suplication proportis. The saidis estats of parliament doe heirby seriouslie recommend the suplicantis, with ther suplication and desire therof foresaid, to the commissionars for the excise, to be tane in consideration be them and to grant ane ease for the excise of the beare in Orkney and Zetland as the saids commissionars, eftir consideration and tryell theranent, sall find just and reasonable.

Act Sir Waltir Murray of Livingstoune

The estates of parliament, haveing hard, sene and considered the suplication of Sir Waltir Murray of Livingstoune, knyght, schewing that the committie of processes had fyned him in the sowme of ellevin thousand and foure hundereth merks and that the samen as he conceaves was mainelie becaus he did neglect to informe that committie anent the trueth of his cariage, whilk neglect was occasioned be this, viz: he not being conscious to himselfe of anie neglect of dewtie quhilk might procure fyneing, and therfore desyring the parliament to discharge his whole fyne and to ordane James Stuart, merchand, who is assigned to the suplicantis fyne, to redelyver to him his band of sex thousand merks given to the said James Stuart and to repay to the suplicant the sowme of thrie thousand merks alreadie payed be him to the said James, as the suplication beirs. The saidis estates of parliament doe heirby exoner and simpliciter discharge the said Sir Waltir Murray off the sowme of tua thousand and foure hundereth merks as the rest and superplus of his whole fyne of ellevin thousand and foure hundereth merks abonespecefeit, by the sex thousand merks and thrie thousand merks respective alreadie payed and for the quhilk the suplicant hes given band to the said James Stuart as is aforesaid, and the saids estates declares the suplicant frie off all payment of the said sowme of tua thousand and four hundereth merks and of the decreit and sentence of fyneing given aganis the suplicant theranent with all that hes followit or may follow for that sowme upon the said decreit, but prejudice of the payment alreadie made of the foresaid thrie thousand merks to the said James Stuart be the suplicant and of the band of sex thousand merks also given be him to the said James, quhilk is declared to remane unprejudged heirby.

Act Johne Campbell of Dundurne

The estates of parliament, haveing hard and considered the suplication of Johne Campbell of Dundurne, schewing that his whole landis, houses, cornis, cattell, guidis and geir wer burnt and distroyed and tane away be the rebells, and that his loisses therby wer tryed and approven to extend to fyve thousand, foure hundereth tuentie foure pundis Scottis, and desyreing some reparatioune therof and meanis of subsistence for himselfe and his children, as his said suplication beirs, the saidis estates of parliament modifies and allowis the sowme of fyiftie pundis sterling to be given to the said Johne Campbell for his present subsistence and towardis the reparatioune of his loisses foresaids, quhilk sowme they ordane to be payed to him, or to anie haveing his power and warrand to ressave the same, out of the last ane hundereth thousand pund sterling dew and payable be the parliament and kingdome of England to this kingdome. And for this effect the saids estates of parliament doe heirby grant richt and assignement for payment to the said Johne Campbell of Dundurne off the foresaid sowme of fyiftie pundis sterling, to be payed to him or ony haveing his power and warrand as said is, out of the said last ane hundereth thousand pund sterling dew and payable be the parliament and kingdome of England to this kingdome as said is. And, for the more readie and tymeous payment of the aforesaid sowme, the saids estates of parliament be thir presentis grantis precept and warrand for payment of the foresaid sowme of fyiftie punds sterling to the said Johne Campbell of Dundurne, or to anie haveand his power and warrand to receave the same, out of the aforesaid last ane hundereth thousand pund sterling dew and payable be the parliament and kingdome of England to this kingdome as said is, and that upon the said Johne Campbell, or anie haveing his power foresaid, thair or either of ther discharges upon the recept of the said fyiftie pund sterling, whose discharge therof the saids estates declares salbe a sufficient warrand and exoneration to the payers and to all others interest or who may be concerned therintill.

Act Lord Elibank

The estates of parliament, taking into thair consideration the suplication of Patrik, lord Elibank, schewing that thair is dew to him be the estates of the kingdome of lent money and anuelrentis therof at Candlemes last 1647 yeirs instant the sowme of auchten thousand, two hundreth fourscore fourten pundis Scotis money, conforme to the actis and bandis granted to him be the committie of estates for payment therof, and desyring order and warrand that he may be payed of the aforesaid sowme, as the suplicatioune beirs, the saidis estates of parliament ordanis the sowme of ane thousand pund sterling of the sowmes foresaids adebted to him be the estates to be payed to the said Patrik, lord Elibank out of the remander of the brotherlie assistance dew and payable be the parliament and kingdome of England to this kingdome and yit unpayed and not formarlie assigned, and for the rest and superplus of the sowme abonementioned, by the said ane thousand pund sterling, the estates ordanis the samen rest and superplus to remane and be as lent money be the suplicant to the publict and to be dew and payable by the publict to him as lent money for the use of the publict, conforme to his formar actis and bandis therof. Act annulling bandis tane be the officiars of cassiered regimentis and companies

The estates of parliament, now conveened in this sext session of the first triennial parliament, taking to there consideration the desire of the suplication of the burgh of Bamff presented to them be Gilbert Mair, commissionar for that toune, craveing that they may be fred of ane band of sex hundereth merks given be them to Colonell George Forbes of Mylnebowie for the pryces of certane clothes and armes promitted be the toune to tuentie two souldiors put out be them to the said Colonell George Forbes in August 1646 inrespect the said colonell and his regiment was discharged and cassiered by warrand of the committie of estates within few dayis eftir the granting of the band and the souldiors return to ther awne habitations; and heirwith also considering that thair is diverse and sundrie uther bandis granted be diverse of the good subjectis of the kingdome to colonells and uther under officers for payment to them of diverse sowmes of money, whilks albeit the bandis beare borrowed money, yitt the trew caus of the granting therof was onlie for putting out of souldiors and for the pryce of clothes and arms to them to the severall regimentis and companies, quherof the colonells and uther under officers, ressavears of the saids bandis, wer commanders, quhilkis wer also within few dayis eftir the granting of the saids bandis casseired be warrand and ordor of the committie of estats. And the estates of parliament, finding it unjust that the foresaids bandis of the nature and qualitie abonementioned, not being trewlie for borrowed moneyis, sould stand obligator aganis the granters or that they sould be lyable to the payment of the sowmes therincontenit, thairfore the estates of parliament, for remeid heirof, findis and declares and heirby statutes and ordanis that the foresaid band granted be the toune of Bamff to the said George Forbes of Mylnebowie for payment to him of the sowme of sex hundereth merks abonespecefeit, with all uther bandis of that nature granted be anie of the good subjectis of the kingdome to anie colonells or under commanders of regimentis or companies for payment of the sowmes respective contenit in the bandis as borrowed money (albeit the same wer trewlie granted for putting out of souldiors and for clothes and arms to the souldiors of ther regimentis and companies quhilks wer shortlie eftir the granting of the bandis casseired and disbanded by order and warrand of the committie of estates) ar and salbe voyid, null and ineffectuall fra the date therof, sensyne and intymcomeing. Lykeas the estates discharges the samen with all execution that hes followed or can follow therupon against the granters therof, and declares them and everie ane of them frie of ther obleismentis in the foresaids bandis and of all payment of the sowmes of money therinmentioned for evir.

Act of approbatioune to the committie of estates

The quhilk day the report eftirspecefeit of that committie appointing for reveising and considering of the register and actis of the committie of estates, off the quhilk report the tenor followis: The committie appointed for reveising the publict registers have observed in the register of the committie of estates ane decreit of the date the [...] day of Maii 1646 past in favors of the laird of Brodie upon a sumondis and charge given be oppen proclamatioune at the mercate croces of Innernes, Nairne and Elgine to all and quhatsomevir persones within the cuntrie pretending them to have bandis, obligatiounes, contractis, writtis or other securities of whatsoevir kynd or nature quherby they may crave action or execution against the said laird of Brodie or his airs for payment to them of whatsoevir sowmes of money or performeing to them of whatsoevir other deidis, to have compeired before the estates of parliament or committie of estates at ane certane day bygane, with continwatioune of dayis, bringand with them all bandis, obligations, contractis etc. of whatsoevir date or dates preceiding the fyiftenth day of Februar then lastbypast, togither with a note of all actions and pleyis under ther handis quhilk they may lay to the charge of the said laird of Brodie for himselfe or as air or executor to anie of his predicessors, with certificatioune to them if they failzied, that the estates of parliament or committie of estates or either of them would find the said Alexander Brodie, his airis or successors to be frie from all action or execution quhilk might be clamed or execute against them therupoun by quhatsomevir persone or persones within the cuntrie. This charge was execute upon the 22 and 26 dayis of October 1645 at the foresaid thrie mercate croces respective, by whiche decreit, inregaird of the not compeirance of anie persones within the saids thrie schyres to produce ther bandis, obligatiounes etc. quherby they might crave action or execution against the said laird of Brodie, the said committie did find the said laird of Brodie, his airs and successors to be frie from all action or execution whiche might be clamed or execute against them be quhatsumevir persones within the cuntrie dwelling within the foresaids thrie schyres. Against the whiche decreit, that it be not ratified in parliament, thair is a suplication given in be Niniane Dumbar of Grangehill, for whose securitie it is thocht fitting by the committie and agried unto by the laird of Brodie that the following exception or qualificatioune be subjoyned to the laird of Broddie's ratificatioune if the parliament think fitting to ratifie the samen decreit: The estates of parliament, with consent of the laird of Brodie, declares that the foresaid act and decreit and all that hes followed or may follow therupon with this present ratification of the samen sall nowayis be extendit against Niniane Dumbar of Grangehill, his airs or successors, nor against anie richtis of multors, nor against anie other richtis, indentors, actions or other writtis or securities personall or reall perteining or competent to him, for himselfe or as air or appeirand air to anie of his predicessors, with this provisioune alwayis: that this present exception sall nawayis prejudge Alexander Broddie in the reall bruiking and enjoyeing of his landis and heritages with all priviledges perteining therto, conforme to the ancient richtis and evidentis whiche the said Alexander and his predicessors had before the granting of this act and ratification, and conforme quherunto he and his predicessors have bene in use and laufull posession of thir fourtie yeirs bypast, whilk right and posession sall nowayis be prejudged be the said exception, bot baithe pairteis richtis and posessions respective salbe of that same force and power as they wer before the obtaining of the said act or decreit purchest before the committie of estates and before this present ratification of the samen. Reserveand also to the said Niniane Dumbar of Grangehill and his foresaids the richtis of his multors and uthers writtis and evidentis quhilks ar formarlie excepted, conforme to his posession thir fourtie yeirs bypast. And because the rest of the lieges in these thrie schyres (alsewell as the laird of Grangehill) may be prejudged by that decreit, they remitt to the parliament to tak what course they think fitting for ther securtie, that nane of them be prejudged therby especiallie intymcomeing. Ther ar also in the register of the committie of estates thrie warrandis for sumondis at the instance of the Lady Broddie, the laird of Letham and Mr Joseph Brodie, in whiche, for proving of the tenor of ther burnt evidentis, thair is dispensatioune allowed either of affinitie [or] consanguinitie of the wittnesses to be used, provyding the persones be fide digni et bonae famae, and the lordis of the session ordanit to admitt suche witnesses whiche the said committie thocht necessarie to represent to the parliament. Being red in audience of the parliament and the samen hard and considered be the estates therof, they doe heirby ratifie and approve the foresaid report conforme to the tenor of the samen in all pointis and interpone the authoritie of parliament therto.

Act of approbatioune to the committie of processes and moneyis for the southe

The quhilk day the report eftirspecefeit of that committie appointed for reveising and considering of the register and actis of the committie of processes and moneyis, of the quhilk report the tenor followis: The committie appointed to reveise the publict registers have observed in the register of the committie of estats some actis concerning the laird of Brodie, Lady Broddie, the laird of Letham and Mr Joseph Broddie, quherof they have givene ther opinion in a paper apairt. They have also observed some difference in two actis of the committie of estates concerning the election of the magistrats of Glasgow, one of the nynt and another of the 19 of September, and the lyke difference also betweene tuo actis of the same dates concerning the election of the magistrats of Abirdene, off whiche the opinion of the committie is that the parliament by ther order alreadie hes satled the diference, and, if the parliament think it fitting, those who wer in the respective sederunts when these actis wer made may be ordaned to give ane accompt of the reasons of ther proceidingis to them. The committie have not in that register observed anie other thing whiche to them appeares a sufficient grund for delayeing a ratificatioune therof, and therfore in ther judgement thinkis they sould be approven. For the register of the committie of processes and money in the south, they have perused the same also and in ther severall decreitis of fynes or borrowed money or anie other ther actis they have not observed anie particular quherin they have not walked according to ther commission, onlie they find the execution of some sentences suspendit till this parliament, whiche they gave in a note to the committie for processes, whiche now is who have reported manie of them to the parliament quher they have receaved ther determinatioune. As for the book of preceptis drawen be that committie upon the generall commissarie and his deputtis, they have perused the same also, bot becaus either all these preceptis hes bene answered and payed by the generall commissarie and consequentlie ar alreadie approven by the approbatioune of the commissaries accompts or otherwayis ar not answered and payed by the commissarie, therfore they conceaved ther particular observatioune of eache of these preceptis unnecessarie. The opinion of the committie is that the said committie of money and processes in the south sould also have the parliament's approbatioune to ther proceidingis. Sic subscribitur, Southesk, I.P.D. Thair is also a petition presented to the committie in name of the laird of Blindlie against a decreit pronuncit by the committie of processes against him, whiche they desire to be red with ther opinion upon it. Sic subscribitur, Southesk, I.P.D. Being red in audience of the parliament and the samen hard and considered be the estates therof, they doe heirby ratifie and approve the foresaid report abonementioned conforme to the tenor of the samen in all pointis and interponis the authoritie of parliament therto.

The whilk day the report eftirspecefeit of that committie appointed for reveising and considering of the register and actis of the committie of processes and moneyis for the north, off the quhilk report the tenor followis: The committie for reveising the registers have perused the registere of the committie of the money and processes in the north and in it have observed ane act ordaning tuo thousand pund, as the pryce of tuelve shalbottomed boats, to be payed out of the mantenance of the shirefdome of Forfar; whiche in ther opinion is not agrieable to the act of parliament, seing therby the quarteringis of the schyre ar first to be allowed before the mantenance be otherwise disposed of, and that is the rather takine notice of that the said committie did daylie by borroweing and fyneing get in moneyis quherby suche incidentis might and sould have bene defrayed for the decreitis of fynes or borrowed money contenit in ther registere. They find not anie mention of a citatioune in most of them, nor doeth it appeare by the register whither these decreitis war given against pairteis compeirand or absent, and in the decreitis of fynes oftentymes thair is no mention of the maner of probatioune used against the pairteis, so as the committie can give no opinion whither they have observed the rules prescryved at St Androis or no, onlie they find manie decreitis for lending against persones in Angus, bot few or nane against anie in the Mearns. They have observed also that the said committie hes granted to some persones suspensions from payment of mantenance, not onlie for ther burnt and waisted landis bot even for suche of landis as ar not burnt and waisted, whiche in opinion is not agrieable to the act of parliament. They have observed a letter from that committie to the committie of estates anent Mr James Kennedie, quherin they expres thair expectatioune that he will discover to them manie thingis, as being a wittie fellow and James Graham's secretarie, and, for that purpose, that they had sent him to the committie of estates prisoner. Yit in the register of the said committie of estatis they find nothing concerning him of his liberatioune out of prisone. Sic subscribitur, Southesk, I.P.D. Being red in audience of the parliament and the samen hard and considered be the estates therof, they approve the report abonementioned for the outgiving of the moneyis given out and debursed be order of the foresaid committie, conforme to the tenor of the samen report theranent, and interponis the authoritie of parliament to the said report for that pairt therof sua approven as said is, and for the remanent pointis of the report the estates reservis the samen to be tane in farder consideration be them as they sall think fitting.

Act for revaluatioune of the schyre of Peblis

The estates of parliament doe heirby adde the persones eftirnamed to the formar valuers and committie for valuatioune of the shirefdome of Peblis, viz: the laird of Prestoungrange, Davick, elder, Mr Johne Hay, Thomas Nasmyth, Walter Murray, William Tweidie of Wrae, Johne Diksone of Hairtrie, James Russell, Mr James Lawsone, George Tait of Pirne, Sir Johne Vaitche, William Broune, George Cranstoune, William Lowis, commissionar for Peblis, Cardronna, Kirkurde, Mr Alexander Burnet [and] Johne Broune of Cleugh, to whome, with the formar valuers of that schyre, or to the greatest pairt of bothe, the saidis estates of parliament be thir presentis grantis power to revalue or rectifie the formar valuations of the haill shirefdome of Peblis and to mak the samen equall and proportionall to all according to the rent and dewtie of the schyre for the haill landis, teindis and uthers within the samen for the quhilk mantenance hes bene, is or salbe payed, to the effect that nane be undervalued or overvalued in the said schyre, bot that everie ane may beare burden and pay the mantenance and uther publict dewis in ane equall and proportionall way. And the estates declares that the foresaid revaluatioune or rectifieing of the formar valuatioune of the said schyre is and salbe alwayis but prejudice to the publict and without diminition anent the payment and quantatie of the monethlie mantenance and uther publict dewis of that schyre.
