The estates of parliament, haveing hard and considered the petition of Lieutenant Colonell William Hamiltoune schewing that Major Generall Crawfuird at the tyme of his death was justlie adebted to him ane hundereth threttie ane pund sterling upon accompt, and that sieing thair was no judicatorie sitting that hathe power to determine so great a sowme and that the suplicant is upon leaving the kingdome and his witnesses ar upon ther removeall into diverse remote pairtis, bothe into this kingdome and in England, quherby the suplicant is lyiklie to be deprived of the benefite of ther testimonie, therfore desyring the parliament to give authoritie to the commissaris of Edinburgh, or anie other wha salbe thocht fitting, to heare and determine anent the foresaid sowme, as the suplication subscryvit be the suplicant and be Cornelius Crawfuird, tutor to Laurence Crawfuird, the sole air of the said umquhile Major Generall Crawfuird, proportis and beiris. The saidis estates of parliament doe heirby grant power, authoritie and warrand to the commissaris of Edinburgh to be judges to the action to be intentit before them for the sowme abonementioned, notwithstanding the samen sowme be greater and of ane uther nature than is competent to be persewit before that judicatorie. With power to the saidis commissaris of Edinburgh to heare, considder and discus the foresaid action with the defenses and answers hinc inde to be given in or alledgit be either of the pairteis theranent, and to admitt and receave all laufull and legall probation that salbe used be either pairtie in the said matter, and thaireftir to advyise the caus and probation therof, and accordinglie to give out and pronunce decreit and sentence in the said mater. And for this effect the estates grantis dispensation to the saids commissars of Edinburgh to sit and decyde in the said action notwithstanding of the sitting of the parliament and of the feriot and close tyme of vacance, quheranent the estates declares thir presentis salbe a sufficient warrand.

Act for some heritors of Stirlingshyre

The estates of parliament, haveing hard and considered the petition of the erle of Mar, the Lairdis of Keir, Polmaiis, Carden and William Grahame of Hiltoune beirand that in the first expedition to England in anno 1640 they, at the desire of the heritors of the shyres of Stirling and Clakmannan, did borrow the sowme of fyve thousand merks Scotis for payment of the officers who war than imployed for the use of the saids shires and for payment of the whole officers of the regiment lifted out of these shires thair fourtie dayis loane, and that they have payit the anuelrent therof evir since and ar now distrest for the principall sowme, notwithstanding of a decreit of the committie for comoune burdingis in anno 1642 ordaneing the haill heritors of the shyres to meet and stent themselfis for releife and payment to the suplicantis of the principall sowme and anuelrentis therof, wha ar therupon chargit and denuncit, and yit the suplicantis lyis under the burden of the sowme and anuelrentis, and therfore desyring letters of horning charging the committies of warre of the shirefdomes of Stirling and Clakmannan to stent the haill heritors of the saids shyres for the foresaid principall sowme of fyve thousand merks and bygane anuelrentis therof (seing to charge the haill heritors to meet and stent wald put the suplicantis to a great daile of charges); as also desyring a warrand for sending of a pairtie of horse throw the saidis shyres for ingathering of the said stent eftir the samen is set doune be the committies of warre, as the suplicatioune beiris. The saidis estates of parliament doe heirby ordane and give warrand to the committies of warre of the shyres of Stirling and Clakmannan and quorums therof to meet and conveene and to lay on the foresaid principall sowme of fyve thousand merks with the byrune anuelrents therof equallie and proportionallie upon the haill heritors of the saidis tua shyres, according to the valuation of the samen shires, and thairupon to set doune a stent roll conteining everie severall heritors pairt and proportion of the foresaid principall sowme and anuelrents therof equallie and proportionallie according to the valuation foresaid, including the suplicantis awne proportionable pairtis, conforme to the said valuation, to the effect the suplicantis may be thereftir accordinglie payed and releived of the said principall sowme and anuelrentis and of the band granted be them theranent, with the letters and charges usit and execute aganis them therupon, deducing ther awne proportionall pairtis, conforme to the said valuation. And ordanis letters to be direct heirupon charging the committies of warre of Stirling and Clakmannan to the effect beforerehearsit, and alse for payment and releife to the suplicants of the principall sowme and anuelrentis respective foresaids, conforme to the stent roll to be set doune be the saids committies of warre.

The estates of parliament, taking to there consideration the desire of the suplication of Major Thomas Weir craveing payment of the sowme of sex hundereth merks dew to him be ane act of the committie of estates of the sevintene of December 1644; as also craveing payment for his service as major of the erle of Lanerk's regiment be the space of tuell monethis and for his service in Ireland as ane capitan lieutenant in Colonell Robert Home, his regiment, be the space of nyntene monethis; and that the parliament wald ordane Johne Achesone, keiper of the magasine, to redelyver to the suplicant the band given be him to the said Johne upon the recept of ane thousand weight of powlder, tua thousand weight of match and ane thousand weight of ball sent with the suplicant to Drumfreis for furnishing that pairt of the cuntrie; and that the suplicant sould either report and delyver to Johne Achesone bandis of these of the cuntrie that sould buy the said ammunition or than sould pay to him the pryces therof contenit in the said band, as the suplication beirs. The saidis estates remittis and recommendis to the committie for the moneyis to sie and considder the instructions of the foresaid suplicatioune concerneing the foresaids sowme of sex hundereth merks and band abonespecefeit, with the suplicantis service within the kingdome, and accordinglie to ordane the foresaid either to be redelivered to the suplicant or he discharged simpliy therof as the committie sall think just; as also to provyde and tak some effectuall course for the suplicantis speidie payment of the said sowme of sex hundereth merks.

Forsamekle as the Lord Lea and laird of Cowdoune declared that they have agried with Allan Dunlop, younger, of Craig that he sall furneis nyne hundereth bollis of meale to the erle of Lothiane, Lord Sinclare and laird of Lawers regimentis in Ireland at Carrikfergus with all diligence, wind and weather serving, for the pryce of ellevin merkis for ilk boll and vj sh. viij d. for the transport money of ilk boll to Carrikfergus, the estats alwayis bearing the sea risk; lykeas the saidis Lord Lea and laird of Cowdoune, personallie present, undertook and promeist that the said Allan Dunlop sould furneis the foresaids nyne hundereth bolls meale in maner and at the tymes abonespecefeit, by and attoure the ane hundereth bolls meale formarlie appointed to be furneist at Stranrawer and quhilk ane hundereth bolls meale is ordanit to be payed out of the first monethis mantenance of the shirefdome of Wigtoune and stewartrie of Kirkcudbryt at the rates of these pairtis. Therfore the estates of parliament ordanis the generall commissar and his deputtis and gives heirby warrand to him and them to pay and delyver to the said Allan Dunlop the pryces abonewrittin of the saidis nyne hundereth bolls meale at ellevin merks for ilk boll and vj sh. viij d. for the transport money therof out of the first end of the first monethis mantenance of the shirefdomes of Air and Renfrew, and to pay the said Allan Dunlope compleitlie of the pryce of the said meale and transport money therof; and alse ordanis the shireff of Gallaway to pay the pryces of the formar ane hundereth bolls meale with the transport money of the regiments from Stranrawer to Carrikfergus in Ireland, and ordanis him to be repayed therof upon compt out of the first monethis mantenance of the shirefdome of Wigtoune or stuartrie of Kirkudbryght. And alse the estates ordanis fyve hundereth bolls of the foresaid meale to be presentlie sent to Ireland with the erle of Lothian and Lord Sinclares regimentis to Carrikfergus, and ordanis the uther foure hundereth bolls to be given to the laird of Laweris regiment quhen they sall goe to Ireland, quheranent thir presentis salbe a warrand.

The estates of parliament, haveing hard and considered the report of that committie appointed by them for considering the suplicatioune of the Scotis captives at Argiers, they ordane ane letter to be written from the parliament to ther commissionars at London to deale earnestlie with the tuo houses of the parliament of England for advanceing foure thousand pund sterling out of the first and readiest of the brotherlie assistance yitt dew be the parliament of England to this kingdome for releife of the suplicants. And, for the better effectuating heirof, ordanis that committie appointed be the parliament to meet with the English commissionars now resideing heir to represent the desire aforesaid to the saidis English commissionars, that they may recommend the same to the tuo houses of parliament of England; and alse ordanis ane letter to be writtin to the commissionars at London to deale earnestlie with the parliament of England that they wald give warrand and command to ther agent who is to deale for the friedome of the English that he wald also negotiat for forbeirance to the Scotis nation, upon condition that the kingdome sall, eftir sight and advyisement of the articles of agriement, be content to accept the same. And siclyik the estates doe heirby recommend Mr Alexander Riddoch, suplicant, who hes suffered long inprisonement in Argier and now latelie the loiss of his wyfe and familie by the visitatioune this last yeir to the committie of moneyis, that he may presentlie have payed to him ane hundereth pund sterling for his extraordinar loisses and charges in agenting the releife of his fellow prisoners and thrie hundereth dollors for his awne ransome, quheranent thir presentis salbe a sufficient warrand.

The estates of parliament, taking to there consideration the suplicatioune of these noblemen, barrones and burgesses who have given band to Sir William Dick for tua hundereth thousand merkis Scotis and have accordinglie payed ther proportionall pairtis therof, desyring that so muche of the fyiftie thousand pund sterling of the second 200,000 lib. sterling payable be the kingdome of England may be ensured and allowed for ther satisfaction and releife, and heirwith also considering that the aforesaid 200,000 merks is ane publict debt, they therfore statute and ordane that the last ten thousand pund sterling of the foresaid fyiftie thousand pund sterling of the second 200,000 lib. sterling payable be the parliament of England to this kingdome salbe allowed and destinat for satisfaction and releife of the saids noblemen, barrones and burgesses wha ar bund for the foresaid 200,000 merks and hes accordinglie payit ther proportionable pairtis therof; and for this effect the estates doe heirby insure, allow and destinat the ten thousand pund sterling abonementioned for ther satisfaction and releife aforesaid, and findis and declares that the samen sowme of ten thousand punds salbe no utherwayis imployed nor disposed upon bot for the releife and satisfaction of the said 200,000 merks Scotis. And incaice satisfaction and releife sall not be purchased be the ordour abonewrittin, the saids estates in that caice ordanis the samen to be payed out of the first ten thousand pund sterling of the second 200,000 lib. sterling payable be the parliament of England to the estates of this kingdome.

The estates of parliament, haveing hard and considered the suplication of James Campbell of Lawers, schewing that umquhile Sir Mungo Campbell of Lawers, knyght, his father, haveing by warrand of the estats leveyed and transported ane regiment of foote to Ireland in March 1642 quher they continwed in the service till March 1644, sen the quhilk tyme they have bene imployed in the service of this kingdome and of the kingdome of England; and that the committie of estates by ther act of the tuentie thrid of May 1644 did declare that they wald repone the said regiment to ther said service in Ireland quhenevir they could be spaired fra the service of the publict heir, and that ther interest in Ireland for ther bygane service and intymcomeing sould be alse inteir to them as anie uther regiments that is in actual service their, and that they sould be in equall fitting with the rest of the regimentis their and immediatlie thaireftir transported, and no uther regiment in this kingdome sould goe from this before them in that service; and incaice the same sould fall weake in the service of this kingdome, that they wald mak them up alse strong as they come from Ireland and to transport them with competent arms on the charges of the publict, as the said act beirs; and thairfore desyring that since it hath pleased the estates to appoint the suplicant colonell of the foresaid regiment in place of his umquhile father, and that they have reformed the armie of this kingdome quherby they ar carseired from the service to repone the said regiment to ther service in Ireland and to mak them up alse strong as they come therfra and to transport them with compleit arms upon the charges of the publict, conforme to the said act, and to fitt ther regiment accomptis and that some course may be takine for ther satisfaction of some pairt of ther arrears, and the rest to be assured as the parliament sall think fitt, or utherwise to continwe them in the service of this kingdome and to approve and renew the foresaid act of the committie of estates, as the suplication mair fullie beirs. The saidis estates of parliament ratifies and renewis the foresaid act of the committie of estats made in favors of the laird of Lawers and his regiment, and declares that they will repone the foresaid regiment to ther service in Ireland and recrute that regiment and transport them with compleit arms to Ireland, and ordanis all this to be done be the authoritie of the parliament and upon the expenses of the publict; and quhen the said regiment sall come fra that place quher they presentlie ly, the estates ordanis provision to be made be the publict for ther intertinement from thence in ther way to Ireland; and ordanis the Lord Burghlie, the laird of Bogie and Mr Johne Hay to heare and fitt the accomptis of the said regiment and report the same with ther opinion how they may be best satisfiet and payit to the parliament.
