Ratification of the act anent the distribution of the 5,000 lib. sterling to lame souldiors, weidowis and orphans of dead souldiors

The quhilk day Sir Adam Hepburne of Humbie, for himselfe and in the behalfe of the remanent commissionars sent from the parliament to Newcastle to the kingis majestie for representing to his hienes the particulars contenit in the commission and instructions given to them, and for distributing with advice of the generall officers of the armie and governor of Newcastle of the tuo hundred thousand pund sterling that come doune from London to the armie, conforme to the commission and instructions given to them theranent, producit and exhibite in parliament the act underwrittin, quherof the tenor followis: At Anick, the sext of Februar 1647. Forsamuche as we ar entrusted and authorized by the parliament for distributing the tuo hundred thousand pund sterling come from London proportionablie amongst all the regimentis of the armie, horse and foote, who have served in England, alsewell these who have bene brokine in the service as these who ar yit standing; and being also entrusted and authorized to give proportionable share not onlie to the leiving bot to the weidowis and orphans of the deade who served in England, therfore, haveing alreadie appointed a dew proportion for all the dead officers and taking to consideration how we might best acquyte ourselfis in the discharge of that duetie, whiche in appointing some proportionable payment for the lame and widowes and orphans of the dead souldiors, eftir speciall advyse had with the generall officers of the armie theranent, have nominated and appointed the sowme of fyve thousand punds sterling to be distributed amongst the lame souldiors and the weidowes and orphans of the deid; and considering that it is impossible to atteine to a just and exact accompt of the names and number of the forenamed souldiors and of ther widowes and others haveing interest in them, doe, eftir serious pondering of the lame and slayne of the regimentis come from the severall shyres, nominat and appoint the proportion following, viz: for the shirefdomes of Abirdene and Banff - 120 lib. Sterling; shirefdome of Mearnes - 100 lib. Sterling; shirefdome of Forfar - 250 lib.; shirefdome of Pearth - 600 lib.; shirefdomes of Fyiff and Kinross - 750 lib.; shirefdomes of Stirling and Clakmannan - 200 lib.; shirefdome of Lanerk - 300 lib.; shirefdomes of Renfrew and Air proportionallie amongst them tuo - 900 lib.; shirefdome of Wigtoune and stewartrie of Kirkcudbryght - 350 lib.; shirefdome of Drumfreis - 200 lib.; shirefdome of Peblis - 50 lib.; shirefdome of Bervik - 200 lib.; shirefdome of Roxburgh and Selkirk - 350 lib.; shirefdome of Hadington - 260 lib.; the burgh of Edinburgh - 50 lib.; shirefdome of Linlithgow - 60 lib.; shirefdome of Edinburgh to landward - 260 lib.; summa - 5,000 lib. Whiche proportion we ordane to be delivered unto the present commissionars of the parliament or anie of them of each shyre and burgh who upon the receipt therof sall give notes to the effect eftirspecefeit and give warning to the severall presbitries in ther respective boundis for causing everie minister of ther number to bring in to the presbitrie from ther several sessions ane exact roll of all comoune souldiors belonging to ther severall paroches of the abovenamed regimentis, companies, trowpes of horse or foote that have bene lamed or ar deid in the service, and that this roll salbe testified by ony of the officers of the field, capitan or rootmaster under quhom they served, to be reveised and approvine by the severall presbitries respective and made use of as eftir followeth: that is to say eache presbitrie of everie shyre sall choyse a reuling elder of ther number to whome the same salbe delyvered, whiche reuling elders ar heirby authorized to meet with the commissionars of parliament of the severall shyres and burghes at the head burgh of the shyre or stewartrie of Kirkcudbrycht upon a day appointed be the saidis commissionars immediatlie eftir the recept of the presbitries diligence made unto these commissionars, and in the said meitting, one or mae, as they sall find expedient, of the commissionars of the shyres and burghes and these elders sall distribut the sowme appointed for ther shyres proportionablie amongst the severall presbitries according to the number conteined in the rolls; and the rewles of the proportion to be as followeth, viz: ilk souldior as he served on horse or foote to have proportionablie according to his standing in the service, alloweing alse muche for the first sex monethis fra Januar 1644 to the moneth of Junii thereftir as for fyiften monethis thereftir; and although we trust and be confident that in a bussines of this nature everie man wilbe faithfull and diligent as he wald shun the curse of the almightie God and procure his blessing, who is a defender of the poore, fatherles and widow, yet for observing ordor and regulating enormities (if any salbe) it is heirby appointed that all the committies and presbitries aforesaid sall mak report of thair diligence unto the parliament or committie of estats or anie nominat by them to that effect. And we doe heirby further declare that nane wha wer runawayis or who have at ony tyme joyned with the enemie sall have the benefite of this article. Sic subscribitur, Leven, Balcarras, David Leslie, J. Hepburne, Ruthven of Frieland, James Holburne, William Glendonyng. Quhilk act, being publictlie red in audience of the parliament and the samen, with the particular division and distribution therinmentioned, hard and considered be the estates of parliament, they ratifie, approve and allow the samen in the haill particular headis and articles therof in all points conforme to the tenor of the said act with the procedor of the committie theranent, and doe heirby interpone the authoritie of parliament therto and ordanis the samen to have the force, strenth and effect of ane act of parliament; and returns heirby publict thankis to the armie; and this present act to be printed and published.
