Act Lord Balcarras

The estates of parliament grantis heirby warrand to the generall commissar to receave in fra the Lord Balcarras his accomptis of the fyve hundereth pund sterling debursit be him upon his regiment in maner contenit in his accomptis therof and quhilk was borrowed for the than present necessities of that regiment upon securitie given be the Lord Balcarras, the Lord Barganie and laird of Cesnok for the samen, and the generall commissar finding the samen accompts instructed for the said sowme of fyve hundereth pund sterline, the estates ordanis him to charge himselfe with the samen sowme in his accomptis, and upon the generall commissar's report therof to the committie for the moneyis, the estates doe heirby ordane the said committie to find out some way for releife and payment of the said fyve hundreth pund sterling or to give publict suretie thairfore, quhairanent thir presentis salbe ane warrand.

The estates of parliament etc. be thir presentis gives full power, warrand and commission to Williame, erle of Lothian and Alexander, lord Balcarras for the nobilitie, James McDowell of Garthland and Sir Thomas Ruthven of Frieland for the barrons, Eduard Edger, baillie of Edinburgh, and Williame Glendonyng, provest of Kirkcudbryt, for the burrowis and to Sir Adam Hepburne of Humbie, ane of the lordis of session, supernumerarie in this commission (or to anie foure of them, ane being of everie estate) to repaire to the kingis majestie at Newcastle with all convenient diligence betuixt and the fyift day of Januar next, and thair to joyne with sick of our comissionars at London as sall come to Newcastle, and they bothe to joyne with these wha salbe sent thither from the parliament of England if anie sall come; and if none come from the parliament of England, with power to the saidis commissionars abonenamed or ther quorum and sick of our commissionars at London as sall come to Newcastle; and if none come, with power to the commissionars abonenamit or ther quorum by themselfis alone to represent to the kingis majestie the articles and instructions heirwith delyverit to them be the parliament and to deale earnestlie, frielie and faithfullie with his majestie theranent for obteining ane satisfactorie answer to what is desired in the saidis instructions and conforme therto. As also to acquent his majestie with what the parliament hes writtin or sent in instructions to thair commissionars at London concerning the samen. And sicklyck the estates gives heirby full power and warrand to the commissionaris abonenamed or quorum therof, with sick of our commissionars at London as sall come to Newcastle, and if none come to themselfis or ther quorum alone, with advyce of the lord generall, generall officers and governor of Newcastle, to condiscend and set doune orderis and wayis for receaveing of the tua hundereth thousand pund sterling, distributing therof, removeall of the armie and slighting of Bervick and Cairlell conforme to the instructions heirwith delyverit to them, quhilkis instructions and haill articles therof they ar heirby ordaned carefullie to prosecute according thairto in all pointis. And the estates declares that this commission sall onlie endure whill the removeall of the armie out of England or shorter as the parliament sall think fitt. As also the saidis estates declares that they heirby hald and sall hald firme and stable all and quhatsumevir thingis the saidis commissionaris or quorum therof sall doe anent the premises conforme to this thair commission and to the instructions respective abonementioned heirwith given to them as said is.

Committie for Abirdene, Stirling, Glasgow and uthers distressed burghis and shyres

The estates of parliament upon the reading of the suplicatiounes presented to them in the behalfis of the burgh of Abirdene, Stirling, Glasgow and shirefdome of Pearth, craveing to be relieved or eased of ther miserable and sad condition of the garisone and quarteringis in thair tounes and shyres, nominatis and appointis the erle of Southesk and Lord Burghlie, the lairdis of Hartwodburne and Bargattoune, James Robertsone and Johne Kennedie, provest of Air, (or ony foure of them, ane being of everie estate) to consider the foresaidis suplicatiounes with the suplicatiounes of all uther distrest burghes and shyres, and to think and condiscend upon the wayis and remeidis therof, and thereftir to report the samen with ther opinion theranent to the parliament that therupon the parliament may tak sick course as they sall think fitt. And addis Major Generall Midletoune to be supernumerarie in the foresaid committie. And the estates addis to the power abonementioned, viz: to heir and fitt the comptis of the foresaids shyres and burghes.

Declaration of parliament in favors of the Lord Humbie

The estates of parliament, taking to thair consideration the desire represented to them be the Lord Humbie as followis: It is desired be the Lord Humbie that sieing he was commanded to goe to Newcastle with the rest of the commissionaris that goes thair, and that he is now stayed throw the not ending of the report made to the parliament be that committie appointed be them for his arrears, that thairfore the parliament wald declare that his stayeing heir is not in his awne default, and that whatevir sould follow therupon throw his absence at Newcastle he may be declared frie therof; they find the foresaid desire just and reasonable and grantis the samen.
