Legislation
Act discharging printing of any thing concerning religion or the kirk without license

The estates of parliament, now conveened in the fyift session of this first trienniall parliament, understanding from the generall assemblie the great abuse of printing and publishing buikis, letters and other papers concerning religion and the kirk without license, therfore, for remedie thairof, inhibits and discharges all and everie ane to preswme hereftir to print or reprint any declarations, protestations, covenantis, confessions, letters, actis or anie thing issueing from kirk judicatories or any bookis, treatises, histories, sermons, commentaries, disputs or other papers quhatsomevir treating of religion or any point of religion in doctrine, worship or discipline or concerning the kirk, the officers, government or condition of affaires therof without speciall licence and priviledge of the general assemblie or their commissionars, or suche as sall have power from them, and that under the pane of confiscation of the saids buikis and other paperis printed without license aforesaid and of the presses, types and other moveable guidis quhatsomevir belonging to the printers thairof, the one halfe quhairof sall belong to the kirk to be made use of and imployed upon pious uses, beside any further personall punishment of the saids printers that the lordis of secrete councell or the committies of parliament or convention sall think fitt to inflict; and the saidis estates ordaines the magistrats of burghes where the printers dwell, upon information from the generall assemblie, their commissionars or others haveing power from them, to arreist, tak and apprehend the saidis printers, contraveners of this act, with the bookis and other papers aforesaid to be presented to the lordis of counsell or committies of parliament or convention to underly the law for the said offence, that eftir tryell thairof the saids buikis and paperis and all the other guidis aforementioned may be confiscat in maner foresaid and the offenders further punished at the discretion of the said judges.

Act discharging the printing of bookis, chronicles or lybellis

The estates of parliament, now conveened in the fyifth session of this first trienniall parliament, haveing hard and considdered the act of the committie of estates of the 29 of November 1644, quherof the tenor followis: The committie of estates, taking to there consideration the prejudice that doe ensue through the uncontrolled libertie that printers tak to themselfis to print and publish bookis and paperis at thair pleasur without anie warrand, and that in all well governed kingdomes it is expreslie prohibited that anie subject tak upon hand to print or publish buikis of whatsomevir discipline or science, bot speciallie lybellis or chronicles concerning the state of the kingdome or ages past, without warrand or allowance for that effect, thairfore the committie of estates, according to the practise of the convention of estates in formar tymes, statutes and ordanes that no persones of whatsoevir rank, degrie or calling tak upon hand to print, publish or set out anie maner of book, lybell, historie or uthir paper; as also that no book being printed out of the kingdome be brocht in and sauld within the same quhill first they be sene and reveised be his majesties secretarie, certifieing them that does in the contrare they sall forfault thair saidis bookes and papers and there haill uthir moveable guidis and salbe further punished at the discretion of the councell or committie of estates. And this act to endure till the nixt session of parliament, and to be without prejudice of the act of the generall assemblie anent printing or any order to be given be the publict judicatories of the kingdome. The saidis estates renewis the foresaid act and doe heirby statute and ordane that no act, lybell, chronicle or anie maner of book, historie or uthir paper concerning the estate of this kingdome be printed or brocht in and sold without advyce and licence of some of the supreme judicatories within this kingdome or secretarie thairof, without prejudice alwayis of the act of parliament of the date of thir presentes made in favors of the commissionars of the kirk, and alse but prejudice to the clerk of registre, his power for printing of the actes of parliament.

Procedure: overtures from the general assembly
Overtouris from the commissionars of the generall assemblie, with the parliament's ordinance thairanent

1. That your lordships wilbe pleased according to the remonstrance represented to recommend to the generall officers of the armie to tak speciall notice of the insolences, oppressions and uthir enormities of the souldiors, that they may be restrained and exemplarlie punished.

2. To provyde some way how the supreame and inferior courtis and judicatories and publict offices in burgh and land and in our armies may be purged of malignantis and of suche as have made defection from the caus by corresponding or complyeing with the publict enemies of this kirk and kingdome, and that none be put in these places bot suche as wer of knawen and approven honestie and affection to the present caus.

3. That your lo[rdships] wald be pleased to considder how securelie excommunicat persones live, notwithstanding of the fearfull sentence of excommunicatioune as Mr Johne Guthrie, sumtyme pretendit bishop of Murray, and diverse uthiris scandalous and malitious malignantis, as also diverse obstinat papistes, that some way may be provyded quhairby the censures of the kirk may not be so vilepended and eluded and that the civill panes appointed by the lawis of the kingdome be reallie and severelie execute agains them.

4. That your lo[rdships], according to the frequent desires of this kirk tendered to everie parliament and almost everie session of parliament, wald be at lenth pleased to considder the actis of formar parliaments against adulterie and incest, that they may be in suche sort revived and renewed, as these odious sins, yit so ryise and growne to suche a hight of abominatioune as is horride to express, may be restrained and exemplarie punished; and when these lawis ar so established, that some course may be provyded how the ordinarie judges may be authorized and enabled for executing of them in all the pairtis of the kingdome.

5. That as your lordships will considder and restraine the power of papistis and malignants in the north, so also that ye wilbe pleased to tak some solide course how the south borders may be strenthned and secured against the plots of papistis and malignantis who ar of a considerable number and strenth thair and in the north of England, and how our borders may be also fred of the insolencies committed be thieves and moss troupers whiche still continwe and incresce thair.

6. That some way may be provided quhairby noblemens children may not be educat by papisticall or malignant parentis or tutours, bot that the care and trust of thair educatioune be committed to some religious and well affected friends, whiche will conduce verie muche bothe to the good of kirk and state.

7. That according to the frequentlie reiterat desires of this kirk, the act of his majesties first parliament concerneing schooles be enlarged and made effectuall for founding and manteining schooles in everie congregation, the want quhairof is the maine obstruction of pietie and vertue in this kingdome.

8. That as the estates have discharged weiklie mercats on Mononday and Settirday as occasion of prophanatioune of the Sabbath, so they wilbe pleased to dischairge faires on these dayis seing the Lordis Sabbath is prophaned no less upon these occasions.

9. That according to thair humble desire in there remonstrance, speciall consideration be taken of the loisses of suche as have given testimonie of thair affection to the caus, and particularlie of poore ministeris who have susteaned the losses of all meanes of lyveliehood for themselfis, thair wyfes, children and familie.

10. That your lo[rdships] will give answer to the humble desire presented to the late session of parliament at Pearth concerning the planting of vacand places in the universities, seing it was delayed to this tyme.

11. That your lo[rdships] will provyde some way how the pensions granted to deposed and malignant ministers may be discharged.

Quhilkis particular overtors abovementioned being red in audience of the parliament and considdered be the estates of parliament, they approve the first overtour and agries thairto, and findis the second satisfied be the act of classes made for punishing and fyneing of malignants and delinquents. Item, for the thrid, the estates ordanes warrand to be given to the committies of warre of ilk shyre for secureing excommunicat persones in most sure places and the officers of the armie present in the shyre to be assisting. Item, for the fourt article against adulterie and incest, the estates ratifies the formar actis made thairanent. Item, concerning the fyift article against papistis, malignants, theifes and moss troupers, the estats ordanes the noblemen and gentlemen of the borders to meet and think upon overtors and thaireftir to represent the same to the committie of estats. Item, anent the sixt overtor, the estates agries thairto and ordanes the particulars to be condiscendit on and represented to the committie of estats. Item, for the sevint article anent schooles, the estates findis the same answered be the act made theranent this day. Item, anent the aucht article, the estates ordanes ane act to be extendit thairanent and ordanes Mr Robert Farquhar, commissioner to this session of parliament for the burghe of Abirdene, to sie the act formarlie past put to executioune in Abirdene concerning mercats in that toun. Item, as concerning the nynt article, ordanes the loisses of suche as have given testimonie of thair affection to the caus, and particularlie these ministers who have susteand the loiss of all meanes of lyvelihood, to be speciallie recommended to the committies of the moneyis for the south and north. Item, as concerning the tent article anent the planting of vacand places in universities, the estates findis the samen answered by the delyverance and act made upon the supplicatioune in favors of the universitie of Sanctandrois of the date of thir presentis. And for the ellevinth article anent the pensions of deposed and malignant ministers, the estats agries that course be tane how the pensions granted to deposed and malignant ministeris may be discharged.

Legislation
Act in favors of the universitie of St Androis

The estates of parliament, eftir reading and considdering of the supplication presented to them be the rector and remanent regentis of the universitie of St Androis, in the behalfe of the Old Colledge thairof, desyring that they may be permitted to fill the first masteris place within the said Old Colledge, vacand be the deceas of the late provest thairof, as they salbe answerable to the parliament or commissionars appointed be parliament for visitatioune of the universitie of Sanctandrois, notwithstanding of the act of parliament at Perth anent the filling of places in universities, for obedience quhairof they have forborne hitherto to fill the said place according to the order prescryved in the fundatioune of the said colledge and custome observed in tyme bygane, as the supplicatioune mair fullie beirs; and eftir debaitting anent the filling of the foresaid place and of the interest acclamed by the generall assemblie in the filling of places in universities and of the overtor given in be the commissionars of the assemblie theranent, the saids estates of parliament, eftir voyceing, ordaines the rector and remanent members of the universitie of St Androis to proceid to the filling of the foresaid vacand place of the late provest within the Old Colledge of the said universitie according to thair fundatioune, right and posession as they wilbe answerable to the parliament and generall assemblie of the kirk, but prejudice of anie right perteining to the generall assemblie for the presentatioune or admission to any places in the universities. And the estates of parliament remittis to the visitors of the universitie of St Androis to tak cognition alsewell of the right and interest of universities in their fundatioune for thair right of presentatioune and filling of the saids places as of the generall assemblie, thair rightis, interest, overtor and desyre that the pryme places of universities may be planted and filled with thair consent, and ordanes report to be made thairof to the nixt session of parliament.

Act against keiping of faires upon Settirday and Mononday

The estates of parliament, considdering that the prophanatioune of the Sabbath is occasioned by keiping faires upon Settirday and Mononday as it was by keiping weiklie mercatis upon these dayis, doe thairfore inhibite and discharge all burghes and tounes to keip faires upon Mononday and Settirday under the pane conteaned in the act past in June 1640 against keiping weiklie mercatis on these dayis; quhilk act the estates doe heirby extend against keiping of faires upon these dayis in the whole tenor and effect thairof.

Act anent noncovenanting patrones

The estates of parliament, taking to thair consideration the nynt act of his majesties second parliament in the yeir 1641 anent noncovenanting patrones and other noncovenanters therinmentioned, think it verie reasonable that the same be extendit in maner following, and thairfore declare that presbitries shall not onlie have right proprio jure to plant and provyde all and sundrie kirks of the patronages belonging to anie persone that hes not subscribed the Nationall Covenant but also all kirkis of the patronages belonging to any persone that hes not subscryvit the league and covenant of the thrie kingdomes or that is or salbe excommunicat, and that from the tyme of the publict enjoyning the covenant by the kirk and of pronuncing the sentence of excommunication ay and quhill they subscribe the saids covenantis and be relaxed from excommunicatioune respective. And it is also declared and ordaned that all kirks of the patronages belonging to anie persone that is or salbe forfaulted for whatsoevir cause be provydit and planted heireftir by presbitries within whose boundis they ly, and that the right of planting thairof shall belong to presbitries pleno et proprio jure intymcomeing, declaring also heirby that the planting and provyding of all and sundrie the kirkis abonementioned shall alwayis be according to the propositions of ordinatioune of ministers agried upon by the assemblies of bothe churches and ratified by the parliament of this kingdome. And further the estates extendis the act of parliament abovementioned against the refusers of the league and covenant of the thrie kingdomes and excommunicat persones in the whole tenor and effect thairof, ordaneing the same to be alse effectuall in all pointes against them as against the refusers of the Nationall Covenant therinexpressed.

Act for founding of schooles in everie paroche

The estates of parliament, considdering how prejudiciall the want of schooles in manie congregations hathe bene and how beneficiall the founding thairof in everie congregation wilbe to this kirk and kingdome, doe thairfore statute and ordane that there be a school founded and a scholemaster appointed in everie paroche (not alreadie provyded) by advyse of the presbitrie, and to this purpose that the heritors in everie congregation meet amongst themselfis and provyde a commodious hous for the schole and modifie a stipend to the schole master, whiche sall not be under ane hundereth merks nor above tua hundereth merkis, to be payit yeirlie at tuo termes, and to this effect that they set doune a stent upon everie ones rent of stock and teind in the paroche proportionallie to the worth thairof for mantenance of the schoole and payment of the scolemaster's stipend, whiche stipend is declared to be dew to the scholemasters by and attour the casualities whiche formarlie belonged to the reidaris and clerks of kirk sessions; and if the heritors sall not conveene or being conveened sall not aggrie amongst themselfis, than and in that caise the presbitrie sall nominat tuell honest men within the boundis of the presbitrie who sall have power to establish a schoole, modifie a stipend for the schoolmaster with the latitude before exprest and set doune a stent for payment thairof upon the heritors, whilk salbe alse valide and effectuall as if the samen had bene done be the heritors themselfis. And becaus the proportions imposed wilbe verie small, thairfore and for the better and more readie payment thairof, it is further ordaned that if tuo termes proportions run in the thrid unpayit, then these that so faill in payment salbe lyable in the double of that proportions than resting and in the double of everie termes proportion that salbe resting thaireftir ay and quhill the schoolemaster be compleitlie payit, and that without anie defalcatioune, and that letters of horning and all uthir executoriells necessar be directed at the instance of the schoolmaster for payment of the double of the proportions in maner foresaid, dischargeing heirby anie suspension to pas against the schoolmasters without consignatioune. And it is declared that lyverenters during thair lyiftyme salbe lyable in payment of the proportion imposed upon the landis lyfrented and execution in the maner before exprest shall pas agains them for that effect, and the heritors salbe alwayis frie of the same during the lyfrentars lyiftyme; and if anie persones find themselfis wronged by inequalitie of the proportions imposed, it salbe laufull for them to seik redress thairof before the lordis of secrete counsall or session within yeir and day eftir the imposing of the stent and no otherwyse.

Act for the shereff of Bervick

The estates of parliament, taking to there consideration the petition presented to them be the commissionars to this parliament for the shireffdome of Bervick, desyring that the parliament wald nominat and appoint ane shireff for the shireffdome of Bervick for administratioune of justice, causing obedience to be given to publict orders and doing everie uthir thing incumbent to that place and office, and heirwith lykewyse considering the list given in of these out of whome the electione is to be made, the saidis estates doe heirby nominat, elect and appoint Johne Home of Blacader to be shireff of the shireffdom of Bervick for this yeir jM vjC and fourtie sex, and makis and constitutis him shireff of that shyre for the said yeir, to whome the estates of parliament be thir presentis gives and grantis full power and commission to exerce and discharge the said place and office of shireff of the shireffdome of Bervick in administratioune of justice to the lieges, causing publict orders be obeyed and in doeing everie other thing incumbent to the place and office of the shireff of the shireffdome of Bervick within the haill boundis and jurisdiction thairof during the space foresaid sicklyik and alse frielie in all respectis as anie shireff of that shyre did or might laufullie doe in ony tyme bygane. Lykeas the estates of parliament gives and grantis to the said Johne Home of Blacader and shireff of Bervick all power, priviledge, libertie, immwnitie and uthir casualities quhatsumevir perteining, dew or competent to the said place and office during the space abonementioned to be peaceablie bruiked, exerced, possest and uplifted be him as shireff during the said space. With power to the said Johne Home of Blacader to nominat, elect and choose his awne deputtis, for quhom he salbe answerable, for his helpe and assistance in the administratioune of justice to the lieges and discharge of the foresaid office and charge of being shireff of the shireffdome of Bervick during the space abonementioned sicklyik and alse frielie in all respectis as anie uthir shireff principall of the said shyre did or myght have done in ony tyme bygane, quhairanent thir presentis salbe ane sufficient warrand.

Act for the comissar clerk of Wigtoun

Anent the petition given in to the estates of parliament, quhairof the tenor followis: The humble petition of James McDowell of Garthland, in name of the shyre of Wigtoun unto the estates of parliament, shaweth that wheras by deceis of umquhile William Dumbar, commissar clerk of Wigtoune, the said office of clerkship is vacand wherby the subjectis of that shyre are prejudged for want of the sitting of that judicatorie, thairfore my humble desire to your lo[rdships] is that ye wald nominat and appoint Johne Dumbar, younger sone to the said umquhile Williame, who is sufficientlie qualified for the said charge, to be clerk to the said office, and your lo[rdships] answer, as the supplicatioune beirs. Quhilk being red in audience of the parliament and the desire thairof hard and considdered be the estates of parliament, they, to remeid the prejudice sustenit be the subjects by the want of the sitting of the judicatorie of the commissariat of Wigtoune occasioned by the decease of the late commissar clerk, doe heirby nominat and appoynt the said Johne Dumbar, younger sone to the said umquhile William Dumbar, to be comissar clerk of Wigtoune and to exerce the charge and office of commissar clerk their with all fies and dewis laufullie belonging to the said office, quheranent thir presentis salbe a sufficient warrand.

Act in favors of Mr Patrik Pitcairne

The estates of parliament ratifies and approves the act of the committie of estates at Glasgow, of the fyift of November 1645 in favors of Mr Patrik Pitcairne, advocat, ordaneing him to exerce the office of commissar of Dunkell and shireff deput of Perth in alse ample maner as Mr Gilbert Stuart, commissar of Dunkell and shireff deput of Perth (wha is now joyned with the rebells), or ony uthir before him did till farder order be tane anent the saidis offices, and discharges all otheris from exerceing the samen offices and appointing the courts thairof to be haldin within the burgh of Perth in the haill headis and clauses of the samen act, and declares this present ratificatioune thairof to be alse sufficient as if the foresaid act wer verbatim insert heirintill. And alse the estates of parliament doe heirby discharge Mr James and Mr Gilbert Stuartis off all farder exerceing of the foresaidis offices and alse the lieges from resorting to thair pretendit courtis or ressaveing confirmatioune of testaments fra them intymecomeing, and declares all confirmatiounes of testaments and decreits to be made and given respective be the saids Mr Gilbert and Mr James Stuartis to be null and ineffectuall. And doe heirby grant power to the said Mr Patrik Pitcairne to nominat, appoint and admit clerks and uthirs members of court necessarie for the said commissariat, and heirby recommendis the said Mr Patrik Pitcairne to the shireffis principall of Pearth to admitt him yeirlie to the office of shireff deput of Pearth, and ordanes the said Mr Patrik to exerce the saids tua offices of commissar of Dunkell and shireff deput of Pearth conforme to the foresaid act ay and quhill he be discharged be the parliament or committie of parliament, and ordanes publicatioune to be made heirof at the mercate croce of Pearth and uthir places neidfull within the diocie of Dunkell.

Act concerneing the Erle Marshell and Cragivar

Forsamekle as the estates of parliament, having hard and considdered the report of that committie appointed be them for hearing and considdering the Erle Marshell, his desires concerneing the moneyis acclamed be him as dew to him be the publict, togither with the supplicatioune of Sir William Forbes of Cragivar, craveing that in regaird of his posession of the hous of Drwm and manteining the garisone thairin by warrand from Lieutenant Generall David Leslie, the parliament wald grant commission to him for uplifting of the laird of Drwm, his rentis lyand contigue about the hous of Drwm, quhilk according to the valuatioune will not exceid thrie thousand merks or thairby and that for his payment and subsistance of the debt dew to him be the publict, he being comptable to the estates for his commission, as the suplicatioune and report respective abonewrittin mair fullie proportis. The saidis estates, inrespect of the extremitie the Erle Marshell is brocht to through the want of these moneyis and charges he hes bene at in the publict service, besydes the extraordinar loisses he hes suffered for his affection to the caus, whilk is not now to be taken in present consideration, ordaines that for the said erle, his present subsistance, he have a commission granted to him for intrometting with and uplifting the rentis of the landis of the barronie of Drwm belonging to the laird of Drwm, quhilk in the report ar declared to be valued to six thousand merks per annum, with the posession of the hous of Drwn, and thairfore the estates doe heirby grant warrand and commission to the Erle Marshell to the effect forsaid sa far as concernes the hous and landis of the barronie of Drwm, bot in respect of the said Sir William Forbes of Cragivar, his sufferingis and of his present posession of the hous of Drwm, landis and barronie thairof, the estates ordanes that committie appointed for the north to provyde to the said Sir William Forbes of Cragivar ane sufficient garison hous and rent answerable to the desire of his supplicatioune, and in the meantyme quhill the samen be done to him the estates hes suspendit and heirby suspendis the said Erle Marshell, his posession of the foresaid hous and landis of the barronie of Drwm, and ordanes the said Sir William Forbes of Cragivar, his posession thairof, to be continwed; and alse the estates ordanes the generall commissar and his deputtis to compt with the said Erle Marshell as colonell of his regiment in England and to put him in ane equall footting with uthir collonells of the Scotis armie in England, quhairanent thir presentis salbe ane sufficient warrand.

Scotis money, and for the said James, erle of Findlater, his payment and satisfaction of the foresaid sowme, the saidis estates of parliament be thir presentis ordanes the generall commissar and his deputtis to mak payment to the said erle off the foresaid sowme of aucht thousand, four hundereth fyiftie tua punds j sh. j d. out of the first and readiest moneyis that salbe raised for the use of the publict within the shireffdome of Banff, ather fynes, forfaltouris or borrowed moneyis, and the estates declares that the samen fynes, forfaltours and borrowed moneyis within the shireffdome of Banff salbe imployed for no uthir use whill first the said erle of Findlater be compleitlie satisfied of the sowme abonementioned dew to him and annuelrent therfore till the payment, and for this effect the estates doe heirby assigne and dispone to and in favors of the said James, erle of Findlater all the saidis fynes, forfaltors and borrowed moneyis perteining to the publict within the said shireffdome of Banff quhill the said erle be compleitlie payit furth thairof of the foresaid sowme of aucht thousand, four hundereth fyiftie tua punds j sh. j d., with the annuelrents thairof whill the payment, and thaireftir the superplus of the saidis fynes, forfaltors and borrowed moneyis to accresce to the publict and the erle of Findlater to be comptable thairfore to the parliament or committie of parliament for the use of the publict sa far as he intromettis with anie more nor payis himselfe of the sowme abonewrittin dew to him and annuelrents thairof till the payment. And farder, for the said erle of Findlater, his greater assurance and better securitie for payment, the saidis estates be thir presentis renewis the formar commission granted to him be the parliament at Pearth upon the [...] day of August 1645 yeirs for intromission with the rentis, sowmes of money and uthirs guidis and geir perteining and adebtit to the persones eftirspecefeit, and doe heirby of new grant full power, warrand and commission to the said James, erle of Findlater, and to his factore and chalmerlanes in his name for his use and for whome he is to be anserable, to medle, intromet with and uplift the rentis and dewteis of quhatsumevir lands perteining to George Adamsone of Floores, viz: the lands of [...] lyand within the shireffdome of Banff; item, the rentis and dewteis of the lands of Pethnik and uthirs perteining to Thomas Innes of Pethnik and [...] Innes, his eldest sone; item, the rentis and dewteis of the landis of Lessindrwm perteining to Alexander Bisset of Lessindrwm; item, the rentis and dewteis of the landis of [...] perteining to Harie Gordoun; and the rentis and dewteis of the landis of Mureck perteining to Alexander Gordoun, with the rentis, maills and dewteis of the landis of Auchannatie perteining to Alexander Phin, with the pairtis, pendicles and pertinents of the haill landis beforerehearsit, all lyand within the shireffdome of [...]. As also to intromet with and uplift all and sundrie sowmes of money, insight, plenishing and uthir guidis and geir quhatsomevir perteining and adebtit to the persones abonenamit and ilk ane of them ay and quhill the said erle of Findlater be compleitlie payit of the sowme abonewrittin dew to him and annuelrents thairof whill the payment, and ordanes him to be comptable for the superplus of his intromission mair nor payis himselfe to the parliament, committie of parliament or to the generall commissar, thesaurer of the armies. And incaice the persones abonenamit or ony of them sall happine to be fyned or forfaulted, in that caice the estats declares that thair fynes and benefite of thair forfaltor sall pertene to the erle of Findlater and be imployed to his use whill he be compleitlie payit of his sowme foresaid dew to him with the annuelrents thairof. Lykeas the estates, now as than and than as now, assignis and disponis the samen to him to the effect foresaid and the superplus of the fynes and benefite of the forfaltors to pertene to the publict, with power lykewyse to the erle of Findlater to hald courtis upon the foresaidis landis, mak and constitut baillies and creat clerks and uthirs members of court necessar and to doe everie uthir thing necessar and requisite heiranent; as also to give discharges upon the recept of the dewteis, sowmes of money and uthirs to be uplifted be him and his factors and chalmerlanes for his use, quhilk the estates declares salbe alse sufficient to the ressavears as if the samen wer granted be the parliament, committie of parliament or generall commissar and his deputtis. And this power and commission to endure ay and quhill the said erle of Findlater be compleitlie payit of the sowme abonespecefeit dew to him and annuelrents thairof or that the samen be discharged be the parliament or committie of parliament.

Act in favors of the laird of Newwark

The estates of parliament, haveing hard and considdered the supplication of Patrik Maxuell of Newwark, desyreing that the estates of parliament wald give and dispone to him the right of superioritie of the landis of Strathardill, lyand within the shireffdome of Pearth, haldin be him of the late erle of Nithisdale, with all uthir right of the samen landis competent to the estates by the forfaltour of the erle of Nithisdale to be haldin be the supplicant of the kingis majestie in the same maner as the erle of Nithisdale held the samen; as also to give warrand to the director of the chancellarie and his deputtis to give, subscryve and delyver to the supplicant ane precept for infefting of him in the saidis landis haldin of the king, as the supplicatioune mair fullie beiris; the saidis estates of parliament be thir presentis gives, grantis and dispones to the said Patrik Maxuell of Newwark the right of superioritie of his saidis landis of Strathardill, with all uthir right thairof competent or perteining to them by the forfaltor of Robert, sumtyme erle of Nithisdale, superiour to the supplicant of the samen landis, to be haldin be the said Patrik Maxuell of the kingis majestie sicklyik and alse frielie in all respectis as the late erle of Nithisdale held the samen, and ordaines the said Patrik Maxuell of Newwark to be infeft in the foresaids lands of Strathardill, lyand as said is, by ane precept out of the chancellarie to be granted to him heirupon, and for this effect the estates ordanes and heirby grantis warrand to the director of the chancellarie and his deputtis to give out, subscryve and delyver to the said Patrik Maxuell of Newwark, supplicant, ane precept for infefting of him in his saidis landis of Strathardill, with the pertinents, lyand within the shireffdome of Pearth, to be haldin of the kingis majestie siclyik and alse frielie in all respectis as the late erle of Nithisdale held the samen and with the same tenendas and reddendo contenit in his infeftments thairof. Lykeas the estates heirby dispenses with all uthir solemnities and formalities requisite heiranent and ordaines the said Patrik Maxuell of Newwark, supplicant, to give satisfaction to the creditors of the late erle of Nithisdale at the sight of the committie of estates, conforme to the act of parliament made thairanent, that the saids creditors be not prejudged by the richt abonementioned heirby granted to the said Patrik Maxuell of Newwark.

Reference for the erle of Lothiane

The estates of parliament, haveing hard and considered the desyre of the supplicatioune presented to them by Williame, erle of Lothiane, craveing that the parliament wald recommend him to the erle of Crawfoord, commissionar of the thesaurarie, that the supplicant may be payit of the remander of that sowme granted to him be the parliament in the first session thairof for his charges in the service of this kingdome to and fra France, to have bene payit out of the kingis rentis and customes of this kingdome, quhairof he hes onlie ressaved a small pairt; as also desyring to be takine in consideration for his payment as ane collonell in the first expedition at Newcastle for the tuell monethis pay whiche uthir collonells gat, and for his constant attendance during that space of the charge and command of the toun of Newcastle committed to him, and lykewyse to tak in consideration that his regiment and he as colonell ar behind of uthir regiments in the foresaid imployment, sieing they nevir gat proveant as uthirs did but brocht thair awne provisions out of Teviotdaill, for whiche they gat bot now and then money; lykeas be haveing tuo companies of his awne tennents in the regiment (about tua hundereth and fourscore men) they wer compleitlie payit by him during the service by the reteining be thair fathers and freinds, there pay in the first end of the erles dewtie, as his chalmerlanes accomptis will testifie; and farder he furneist considerable quantaties of cornis and sowmes of money when the erle of Callender lay with his armie in Teviotdale and border of England besydes diverse quarteringis upon his landis and loisses by the rebells in Lothian and Roxburgh shyres; and lastlie representing that his Irish regiment was whollie cut doune in the service and was fourtene monethis in the service of this kingdome without ressaveing anie proportionall pay and intertinement and nothing at all ather appointed or payit to the erle as collonell or capitan, albeit he was present with them upon some occasions. Quhilkis premisses be the foresaid supplicatioune ar represented by the erle of Lothiane to the consideration of the parliament, that they may doe thairin as they think fitt, as the supplicatioune at mair lenth beiris. The saidis estates of parliament remittis and recommendis the first pairt and member of the foresaid supplicatioune anent the payment to the erle of Lothiane of the remander of the sowme granted to him be the parliament for his charges in his employment to France in the service of the kingdome to the erle of Crawfoord, commissionar of the thesaurarie and commissionars of exchecker, that some effectuall course may be tane for his payment, conforme to the act granted be the parliament to him thairanent, and alse the estates remittis and recomends the remanent members and desires of the foresaid supplicatioune to the committie for the moneyis, to be tane in consideration be them for the supplicant's satisfaction as the said committie sall think fitt.

Act in favors of Sir Williame Dik

The estates of parliament, taking to their consideration that they upon the supplicatioune of Sir Williame Dik of Braid, desyreing some effectuall course to be tane for his payment of the great sowmes of money adebtit be them to him for the caus contenit in his supplicatioune, beirand his uthir desires thairinmentioned that he be not rwined for his affection to the good caus and estates of the kingdome, as the suplicatioune beirs, did upon the ellevint day of December last appoint ane select committie to tak the foresaid supplicatioune and desires thairof, with the supplicant's instructions, in consideration and to think upon some effectuall wayis and meanes for the supplicant's satisfaction, payment and securitie of the sowmes adebtit be the estates of the kingdome to him, and heirwith also considdering the report of the foresaid committie concerneing the said Sir William Dik, his suplicatioune and desires thairof producit and red in audience of the parliament, the saidis estates of parliament doe heirby ratifie and approve the haill formar rightis, bandis and actis granted to the said Sir William Dick for payment and securitie to him of the sowmes adebtit to him be the estates of the kingdome sua far as the samen sowmes ar as yit unpayit, and farder and but derogatioune therto the saidis estates, for the said Sir William Dick, his present supplie of his great burdingis, ordaines him to have the sowme of fyve hundereth thousand merke Scotis payit to him out of the just and equall thrid pairt of all fynes, forfaltors and penulties incurred through contraveining the actis of good behaveor decernit and to be decernit be the parliament or committies of parliament eftir the dissolving thairof upon malignantis and forfaulted persones since the field of Philliphauche and out of ilk terme or severall termes payment thairof respective, with reservatioune alwayis of the particular assignements for ane monethis pay furth thairof for the ten regimentis of horse and dragounes under Lieutenant Generall David Leslie at the foresaid field of Philliphauche, conforme to the act of the committie of estates at Glasgow in October last; as also with reservatioune of the sowme of ane hundereth and fourtie thousand merks Scotis to be uplifted out of the foresaids fynes, forfaltors and penulties for contraveining the actis of good behaveor for transporting of the forces fra Ireland to this kingdome, and lykewyse reserving the sowmes assigned be the committie of estates to Lieutenant Generall David Leslie and Major Midletoune and the sowme of tuell thousand, thrie hundereth and tuentie merkis Scotis restand to the erle of Leaven, lord generall, of the ane hundereth thousand merks granted to him in the parliament anno 1641, quhilk sowmes sua reserved ar first to be payed out of the foresaid haill fynes, forfaltors and penulties respective decernit and to be decernit upon malignants and forfaulted persons since the said field of Philliphauche. And for the said Sir William Dick, his farder assurance anent the payment of the foresaid sowme of fyve hundereth thousand merks Scotis abonespecefeit, the estates of parliament be thir presentis assignis and disponis to the said William Dik all and haill the just and equall thrid pairt off all fynes, forfaltors and penulties of actis incurred for break of good behaveor decernit and to be decernit be the parliament or committie of parliament eftir the dissolving of the parliament upon malignantis and forfaulted persones sen the said field of Philliphauche, to be payed to the said Sir Williame Dik at the terms respective conteined and to be conteined in the sentences given or to be given be the parliament or committie of parliament thairanent, reserveand alwayis the foresaid particular assignements given to the saids regiments of horse and dragounes abonementioned for ane monethis pay to them and the sowme of ane hundreth and fourtie thousand merks Scotis for transporting the forces from Ireland, with the saidis sowmes assigned to Lieutenant Generall David Leslie and Major Midletoune and the foresaid sowme adebtit to the erle of Leivin, lord generall, quhilks sowmes sua reserved ar first to be payit to the regiments and persones abonenamit, to quhom the samen ar dew in maner beforerehearsit. And the estates doe heirby establish and put the said Sir William Dik in the full right, title and place of the foresaid just and equall thrid pairt of all fynes, forfaltors and penulties of actis for break of good behaveor to be ressaved, uplifted and intrometted with be him (with reservatioune foresaid) ay and quhill he be compleitlie payit of the foresaid sowme of fyve hundereth thousand merkis Scotis. With power to him and his factors for his use to uplift and ressave the just and equall thrid pairt of all the saidis fynes, forfaltors and penulties of actis and to call and persew thairfore and to give discharges therupon with reservatioune ut supra, quhilkes discharges salbe alse valide to the ressavears as if the samen wer granted be the parliament and thair committies or be the generall commissar and his deputtis, and ordanes the said Sir William Dik to be comptable for quhatsumevir sowmes he or his factors sall ressave be vertue of thir presentis or be vertue of his formar rightis, preceptis or warrandis. Lykeas the estates be thir presentis assignis to the said Sir William Dik the decreitis alreadie given for the fynes, forfaltors and penulties of actis sa far as concernes the thrid pairt of the samen, and ordaines the just and equall thrid pairt of the fynes, forfaltors and penulties of actis to be decernit heireftir to be ordaned be the samen decreitis to be payit to the said Sir William Dick, with reservatioune alwayis of the assignement and sowmes before reserved. And the estates heirby discharges the generall commissar and his deputtis, or ony uthir persones quhatsumevir, to medle and intromet with anie pairt of the foresaid thrid of anie of the forfaltors, fynes and penulties of actis abonespecefeit, reserving alwayis ut supra. And siclyik the estates of parliament grantis heirby warrand to the auditors of the comoune burdingis and thair clerk for making of the said Sir William Dik, his accompts sen Lambmes 1643, and alse ordaines ane letter of recommendatioune to be writtin fra the parliament of this kingdome and subscryved be the president of parliament to the parliament of England in favors of Sir William Dik for payment to him of ten or tuell thousand punds sterline to compt ather of the brotherlie assistance dew be the parliament of England to this kingdome and formarlie assignit to Sir William Dick, or ellis to ane accompt of his awne propper moneyis dew be the parliament of England to him for the service of his ship, togither with ane uthir letter to the Scotis commissionars at London for thair concurrance to the effect abonespecefeit.

Act prorogating the commission of exchecker

The estates of parliament, taking to there consideration that the commission for the exchecker did become voyid by the meitting of the estates in this session of parliament, and heirwith also considering how necessar it is that the said commission be renewed for the good and dispatche of the lieges, they doe heirby renew and prorogat the formar commission for the exchecker granted be the estates of parliament to the persones thairinmentioned in the second session of this first triennial parliament, of the date the first of Februar 1645 yeirs, and ordanes the samen to stand in full force, strenth and effect conforme to the tenor thairof in all pointis quhill the nixt session of this parliament and longer ay and whill the samen be discharged be the parliament or committie of parliament; and in the meantyme ordanes sick of the persones contenit in the said formar commission as ar under suspition to forbeare the exerceing of thair charge thairin whill they be cleared of the samen suspition.

Act in favors of James Stuart and James Hamiltoune

The estates of parliament, haveing hard and considdered the report of that committie appointed by them for reveising and footting of the accomptis of James Stuart, baillie of Edinburgh, and James Hamiltoune of Boigis, with the instructions and verificatioune thairof, they find that the said James Stuart and James Hamiltoune hes furneist and delyvered the full number and quantaties of victuall that they did undertak to furneis for the use of the Scotis armie in Ireland, quhairof some small proportion was imployed for the forces within this kingdome, and that the furnishing and delyverie thairof is instructed be the receptis of the commissaries and thair deputtis, except onlie a recept of thrie hundereth fourscore sex bolls meale quhilk they ar to instruct more clearlie; and alse findis be the foresaid report that thair haill advance of victuall and money, with thair receptis of suche money as they have gottine payment of, being compared, there remanes dew and aweing to the saidis James Stuart and James Hamiltoune be the publict the sowme of fyve hundereth fourscore sevin thousand, nyne hundereth tuentie tua merks, ten shillingis, aucht pennies Scotis money, conforme to the report subscryved be these persones upon the foresaid committie, quhilke sowme of fyve hundereth fourscore seivin thousand, ixC xxij merks x sh. viij d. the saidis estates of parliament findis and declares to be ane publict debt dew be the estates of the kingdome to the saidis James Stuart and James Hamiltoune and doe heirby obleige the estates of the kingdome for payment of the foresaid sowme to the saidis James Stuart and James Hamiltoune, with anuelrent thairfore till payment of the same, and for thair further securitie the estates ratifies and approves the formar actis, preceptis and warrands granted to them be the estates of parliament or thair committies sa far as the samen concernes or may be extendit for thair payment and securitie of the foresaid sowme abonewrittin and anuelrent thairof. And becaus the foresaid haill sowme can not now be gottine payed inrespect of the necessities for manteining the armies and supplieing of uthirs, the publictis creditors, yitt the estates of parliament, for preserving the saidis James Stuart and James Hamiltoune and thair cautioners and creditors fra rwine, ordaines the equall halfe of the foresaid sowme of fyve hundreth fourscore sevin thousand, nyne hundereth tuentie tuo merks 10 sh. 8 d. dew to them to be payed to them equallie betuixt them, and for this effect appointis them to be payed thairof out of the fynes and forfaltors of Sir Johne Dalzell, Samuell Drummond and the Lord Jonstoune and out of the superplus of the penultie of ane hundereth thousand punds Scotis incurred be the erle of Hartfell and his cautioners by contraveining the act for his good behaveor, sa far as that ane hundereth thousand punds is not assigned and decerned to be payit to the erle of Lanerk and his regiment and out of anie farder fyne or forfaltor, if any beis, agains the erle of Hartfell; and what they sall not ressave by these fynes and forfaltors, ordaines them to be payit thairof out of suche borrowed moneyis as is alreadie decernit to be lent for the use of the publict and not yit payit, and out of suche moneyis as salbe decernit to be lent for the use foresaid be anie persones of quhatsomevir qualitie within the shyres of Lanerk, Air, Renfrew, Drumfreis and Gallaway; but prejudice alwayis to the assignatioune formarlie granted to Robert Gordoun and Johne Fergussone, burgessses of Air, for payment of the sowmes dew to them be the publict out of the borrowed moneyis of the foresaides shyres or ony of them, quhilk is declared to be unprejudgit heirby. And for the saidis James Stuart and James Hamiltoune, thair further assurance of the payment of the halfe of thair haill sowme abonementioned presentlie ordaned to be payit to them as said is, the saidis estates be thir presentis assignis and disponis to the saidis James Stuart and James Hamiltoune equallie betuixt them the foresaids particular fynes and forfaltors abonementioned, with the superplus of the penultie of ane hundereth thousand punds abonewrittin by sick thairof as is assigned and decerned to the erle of Lanerk and his regiment, togither with the foresaid borrowed moneyis within the fyve shyres abonedesigned; but prejudice ut supra. With power to them to persew for and uplift the samen fynes, forfaltors, penultie and borrowed moneyis and to give discharges thairupon whill they be compleitlie payit of the equall halfe of the foresaid sowme abonewrittin adebtit to them and to give discharges upon thair receptis, quhilk the estates declares to be alse sufficient to the ressevears as if the samen wer granted be the parliament, committie of parliament or be the generall commissar and his deputtis. And alse the estats doe heirby recommend to the committie for the moneyis to assigne the saids James Stuart and James Hamiltoune equallie betuixt them to ane fyne equivalent in quantatie and qualitie to the laird of Keir's fyne and to ordane the samen to be payit to them equallie betuixt them, sieing his fyne was formarlie destinat to have bene assigned to them bot was uthirwayis disposed upon be the estats.

Act laird of Kelhead

The estates of parliament, taking to there consideration the desire of the supplicatioune presented to them be Collonell Williame Douglas of Kelhead, governour of Carelell, craveing that the formar commission granted to him for leveying ane hundereth horses to attend the garison at Carelell might be enlarged for ane squadroun of horse, and that the estates wald grant thair approbatioune to the thrie troupis alreadie leavied be him, and ane new warrand for the fourt to compleit the squadroune, and to caus the suplicant be answered of the fyve hundereth pund sterling advanced be him in leveying of the saidis troupis lifted be him for attending the said garisone at Carelell, as the suplicatioune beirs; togither with the opinion of the committie of dispatches anent the foresaid suplicatioune and desire thairof, the saidis estates ordaines the foresaid ane hundereth troupers whiche the supplicant did lift by warrand from the committie to be framed in ane troupe and appointis the supplicant to be rootmaster thairof, and for his charges in levieing of these horses and for the uthir good services performed be him, the saidis estates doe heirby give precept and warrand to the generall commissar and his deputtis to mak payment to the said Colonell William Douglas of Kelhead, governor of Carelell, off the foresaid sowme of fyve hundereth punds sterline to be payed to him out of the readiest moneyis that can convenientlie be had perteining to the publict, quheranent thir presentis salbe ane warrand.

Ordinance anent the memberis of parliament

The estates of parliament, taking in consideration the prejudice that the publict may susteane by the awaygoeing of the members of parliament before the dissolveing of the parliament, they doe thairfore statute and ordane that no member of parliament leave nor desert the parliament without leive asked and granted under the panes following, viz: ilk nobleman under the pane of thrie hundereth merks, ilk barrone under the pane of tua hundereth merks and ilk burges under the pane of ane hundereth merks.

Act in favors of the Erle Marshell

The estates of parliament, haveing hard and considered the suplicatioune of Williame, Erle Marshell, lord Keith and Altrie, desyreing that the estates of parliament wald give to him the right of superioritie of his landis of Torterstoune and Ravinscraig, lyand within the shireffdome of [...], and sick uthirs landis as he and his predecessors formarlie held of the late marques of Huntlie, with all uthir right of the samen landis competent to the estates by the forfaltor of the late marques of Huntlie, to be haldin be the suplicant of the kingis majestie and his hienes successors in the same forme and maner and alse frielie in all respectis as the Erle Marshell and his predicessors and authors held the samen of the said late marques of Huntlie; as also to give warrand to the director of the chancellerie to grant and direct furth ane precept for infefting the supplicant, his airs maill and assigneyis in the saide landis of Torterstoune and Ravinscraig and sick uthir lands as he formarlie held of the late marques of Huntlie, to be haldin ut supra, and that the precept beare the particular designatioune of the saids landis according to the saids infeftments formarlie granted thairof, as the suplicatioune mair fullie beirs. The saidis estates of parliament be thir presentis gives, grantis and disponis to the said William, Erle Marshell, his airs maill and assigneyis the right of superioritie of the foresaids landis of Tortorstoune and Ravinscraig and of sick uthir landis as he formarlie held of the said late marques of Huntlie, with all uthir right thairof competent or perteineing to the publict and estates of this kingdome be the forfaltor of George, sumtyme marques of Huntlie, superior to the supplicant of the samen landis, to be haldin of the kingis majestie and his hienes successors in the same forme and maner of halding and alse frielie in all respectis as the Erle Marshell or ony of his predicessors and authors held the samen of the said late marques of Huntlie, and ordanes the said Erle Marshell to be infeft in the samen landis sua haldin by ane precept out of the chancellarie to be granted to him heirupon, and for this effect the estates of parliament gives heirby warrand and commandis the directour of his hienes chancellarie to grant, give out, subscryve and delyver ane precept for infefting the said William, [Erle] Marshell, his airs maill and assigneyis in the saidis landis of Torterstoun and Ravinscraig and sick uthir lands as he formarlie held of the late marques of Huntlie, with the pertinents, to be haldin of our soverane lord and his hienes successors in the samen forme and maner of halding and alse frielie in all respectis as he or ony of his predicessors and authors held the samen of the late marques of Huntlie, and ordanes the said precept to beare the particular designatioune of the saids landis according to the infeftments formarlie granted thairof and with the same tenendas and reddendo conteinit thairintill. Lykeas the estates heirby dispenses with all uthir solemnities and formalities requisite heiranent, and ordanes the said Erle Marshell, supplicant, to give satisfaction to the creditors of the late marques of Huntlie at the sight of the committie of estates, conforme to the act of parliament made thairanent. Anent the quhilks premisses the estates declares thir presentis to be ane sufficient warrand.

Act for the shireff of Selkirk

The estates of parliament, taking to thair consideration the desire motioned in parliament for appointing ane shirref of the shireffdom of Selkirk for the yeir 1646 and that the lieges be not prejudged through want of ane shireff, they doe heirby nominat, elect and appoint [...] Pringle of Torwodlie to be shireff of the shireffdome of Selkirk for this yeir 1646 and makis and constitutis him shireff of that shyre for the said yeir, to whome the estates of parliament be thir presentis gives and grantis full power and commission to exerce and discharge the said office and place of shireff of the said shireffdom of Selkirk in administratioune of justice to the leiges, causeing publict orders be obeyed and in doeing everie other thing incumbent to the place and office of the shireffdome of Selkirk within the haill boundis and jurisdiction thairof during the space foresaid siclyik and alse frielie in all respectis as anie shireff of that shyre did or might laufullie doe in ony tyme bygane. Lykeas the estates of parliament gives and grants to the said [...] Pringle of Torwodlie as shireff of Selkirk all power, privilege, libertie, immwnitie and uthir casualities quhatsumevir perteining and dew or competent to the said place and office and shireff of Selkirk during the space abonementioned, to be peaceablie bruiked, exerced, possest and upliftit be him as shireff during the said space, with power to the said [...] Pringle of Torwodlie to nominat, elect and choose his awne deputs, for quhom he salbe answerable, for his helpe and assistance in the administratioune of justice to the lieges and discharge of the foresaid office and charge of being shireff of the said shireffdome of Selkirk during the space abonewrittin siclyik and alse frielie in all respectis as anie uthir shireff principall of the said shyre did or might have done in anie tyme bygane, quhairanent thir presentis salbe ane sufficient warrand.

Ordinance anent fortifieing of houses

The estates of parliament, taking to thair consideration the desires of some presented to them, craveing warrand to fortifie thair houses for keiping out thairof aganis the rebells and enemies of the kingdome, they doe heirby give warrand to the lord register to give out and extract actis to anie who ar well affected and ar for the service and safetie of the cuntrie and wha sall give in the names of thair houses craved be them to be fortified for fortifieing of the samen houses and keiping out thairof against the rebells and enemies of the kingdome and for the good of the caus in hand, safetie and service of the cuntrie, notwithstanding of anie formar actis of parliament prohibiting the fortifieing of houses, quheranent the estates of parliament heirby dispenses to the effect foresaid. Anent the quhilks premisses the estates declares thir presentis salbe ane sufficient warrand.
