The estates of parliament, now conveened in the fourt session of this first trienniall parliament be vertue of the last act of the last parliament haldine be his majestie and thrie estates in anno 1641, considdering that it is surmeised thair are diverse persones within the kingdom who is gone and is daylie goeing in for assisting of the present rebellione of some wnnaturall cuntriemen who will have the right of successione to titles of dignitie, landes, bandes, annuelrentes and otheres benefites within this kingdome, to the great prejudice thairof and encouragement of others to doe the lyke in tymecomeing, doe thairfore find and declair all such persones who hes allreddie gone in and does not returne and give in thair names to the parliament or committie of parliament betuixt and the fyfteine day of September nixtocome, as als all otheres who shall heireftir goe in and the aires procreate of thair bodies incapable of any successione quhatsomevir within this kingdome, ather of titles of dignitie, rentes of landes, bandes, annuelrentes or ony benefittes within the samene, and sicklyke findes and declaires that this shallbe sufficient for debarring of them fra the successione foirsaid, quhilke the saides estates ordeanes to be received alsweell be way of exceptione as reply; and whosoevir shall come in betuixt and the day foirsaid, the saides estates declaires them frie of all censure of parliament or other judicatorie quhatsomevir, they giveing satisfactione to the orderes appoynted or to be appoynted by the kirke judicatories, provyding allwayes, lykeas it is heirby provydit that the act foirsaid shall be nowayes extendit to ony persone quhatsomevir that shall be brought in be any that shall have warrand from parliament or committie of parliament eftir the day foirsaid. As alse excluding from the benefite of the said act or ony pairt thairof the particulare persones falloweing, viz: James Grahame, sometyme erle of Montrose, James Ogilvie, sometyme erle of Airlie, James Gordoun, sometyme lord Aboyne, Alester McDonnald, [...] Grahame, younger, of Inchbrakie, [...] Grahame of Gorthie, Sir Williame Rolloke [and] Nathaniell Gordoun. With power to the comittie of estates to give the benefite of this act to sicke other persones as are foirfaulted notwithstanding of thair foirfaultour. And declaires that the publicatione heirof at the mercate croce of Pearth shall be alse sufficient as if the samene had bene published at the mercate croce of Edinburgh and remanent burghes within this kingdome.
