The estates of parliament, now conveened in the fourt sessione of this first triennial parliament be vertue of the last act of the last parliament haldine be his majestie and thrie estates in anno 1641, takeing to thair consideration the good service done to the publict be Williame, Erle Marshell and his great sufferings for his constant affectione to the caus in hand, quhairin no course hes bene yit takine for his reparatione and recompence, thairfore, for his further encouragement to continow in his former resolutiones, they have givine power and warrand and by thir presentes gives power and warrand to the said Williame, Erle Mershell, his factores and chalmerlandes in his name to mell, intromet with, wplifte and receive all debtes, soumes of money, rentes of landes and otheres goodes and geir whatsoevir perteaneing to the persones eftirmentionat, viz: off the landes perteaneing to James Ogilvie, sometyme erle of Airlie, lyand within the sherrefdome of Banff; the landes of Hearthill, with thair pairtes and pendicles, lyand in the said sherreffdome or in the sherrefdome of Aberdene perteaneing to [...] Leith of Harthill or his sone; the lands of Foruell to Robert Irwing in take or wedsett, lyand with[in] the sherreffdome of [...]; the landes of Brysett, lyand within the sherreffdome of Aberdene or Kincairdine, all which perteanes to malignantes or foirfaulted persones who have joyned with the Irish rebelles and wnnaturall cuntriemen in this present rebellione within this kingdome and have bene accessorie thairto; and ordeanes the foirsaides persones, thair chalmerlands, tennents, subtennentes, cotteres, debtours and otheres quhatsomevir to reddilie ansuer, obey and make thankefull payment to the said Williame, erle of Mershall and his foirsaides of all soumes of money, debtes, rentes of landes and otheres goodes and geir quhatsomevir restand be them to the saides persones joyned in rebellione or accessorie thairto as said is wpoun his or thair dischairges thairof, quhilke the estates of parliament declaires to be alse sufficient to the receiveres for thair full exonoratione as if the samene wer granted be the persones, heritours of the saides landes, before the committing of the cryme, the said Erle Mershall being allwayes comptable to the parliament or thair committies for thair intromissione, for which effect ordeanes them to give band and securitie. With power to him and his foirsaides to holde courtes wpoun the saides landes, creat officeres of court etc., appoynt baillies, outputt and inputt tennentes, call and convene debtouris before judges competent and generallie all and sindrie other things to doe, wse and exerce wherby the full benefite of the saides lands and debtes may accres to the said Williame, Erle Marshall als freelie and amplie as evir the same pertenit to the saides persones and heritores of the saides landes before the committing of the said cryme of rebellione foirsaid; and ordeanes lettires of horneing, poynding, arreistment and all executione necessarie to be directed heirwpoun at the instance of the said Williame, Erle Marshell and his foirsaides aganes the debtores of soumes of money, tennentes and possessoures of landes for compelling them to reddilie ansuer, intend, obey and make payment thairof sicklyke and als freelie as if the said Williame, Erle Marshall, his name, wer insert in the saides bandes or that he wer heritour of the saides landes. And the estates declaires that this present comissione is granted for the reparatione of the loises susteened from the begining of thir troubles be the said erle of Marshall, and that the samene comissione shall indure ay and quhill the parliament or comittie of estates shall recall and dischairge the samene.
