Forsameikle as there being tuo commissiones produced in parliament for the shereffdome of Lanerke, the ane thairof granted to Sir Williame Carmichaell and James Hammiltoun of Dallserffe to be commissioneris from that shyre to the parliament, and the wther granted to Sir James Lockhart of Ley and [...] Hammiltoun of Woodhall to be lykewayes commissioneres from that shyre to the parliament, and bothe cleameing to be preferred to otheris, conforme to ther commissiones, wherwpoun the estates of parliament, now conveend in the second sessione of this first trienniall parliament be vertew of the last act of the last parliament haldine be his majestie and three estates in anno 1641, caused publictlie reid in audience of the parliament the saidis tua commissiones with sicke actes and protestationes as were produced be ather pairtie theranent. They, eftir consideratione therof and heiring of the said Sir James Lockhart and Sir Williame Carmichaell hinc inde viva voce in audience of the parliament anent which of the tua commissiones should be admitted, and efter voyceing the estates of parliament alloues and approves of the foirsaid commissione wherby the saidis Sir Williame Carmichaell and James Hammiltoun of Dalserfe are first elected and chosine to be commissioneres for the shereffdome of Lanerke to this parliament, and preferres them and ther commissione foirsaid to the other commissione and the commissioneris abovenamed therby elected. Quhairwpoun the said Sir Williame Carmichaell asked instrumentes.
Sir Johne Smythe, proveist of Edinburghe, in name of the burrowes, protested aganes the commissioner for the stewartrie of Kirkecudbryt that he should not have voyce in parliament and that no commissionar should be admitted for the stewartrie of Kirkecudbright to have place and voyce in parliament sieing there is commissionaris for the shereffdome of Wigtoun within the quhilke the stewartrie lyes, and desyred that the parliament would discuss the samene presentlie. Lykeas Johne Gordoune of Cardnes, commissioner for the stewartrie, opponit the rolles of parliament and custome of the stewartrie to have commissioners to voyce in parliament. To the protestatione and desyre abovewrittin, the estates of parliament ordeanes the stewartrie to be cited before the discussing of this mater and ordeanes the commissioner for the stewartrie to sit and voyce whill the samene be discust.
