The estates of parliament, presentlie conveend by vertew of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, considdering that his matie, be his chartour and infeftment wnder the great seale of the dait at Oxfuird, the tuentie eight day of November jM vjC and fourtie tuo yeeres, gave, granted and disponed to his maties dailie servitor, Patrike Maule of Panmure and to his aires and assigneyes quhatsomevir heritablie and irredeimablie all and haill the landes, lordships, barrony and regalitie of Abirbrothok, with the pertinentes and otheres belonging to the lait abacie therof, comprehending the burghe of barronie and regalitie of Abirbrothoke with the particulare landes, barronies, annualrentes, mylnes, multours, wodes, fishings, patronages, kirkes, teyndes, maner places, houss, biggings, yairdes, orchyairdes, annexis, connexis, dependences, tennentes, tennendries, service of frie tennentes therof and otheres mentionat in the said chartou and infeftment, with the right of nominatione of the baillies of Abirbrothoke, ane or ma, and place of vote and sufferage for electing of the rest of the baillies and othere office beireres with[in] the burghe of Abirbrothoke, with the few and blench deutyes, teynd dewties and other dewties, customes and casualities of the saides landes, lordship, barrony and regalitie of Abirbrothoke, conteyneing also ane gift de novodamus with ane unioun of the haill in ane frie lordship, barronie and regalitie and diverse other priviledges and liberties to be haldine of his matie and his successoures in frie barronie and regalitie for payment of the soume of tuo hundreth punds usuall money of Scotland yeirlie at tua termes in the yeir, Whitsonday and Mertimes be equall portiones, in maner specified in the said chartor and infeftment and precept and instrument of seasing falloweing therwpoun; quhilke infeftment proceides wpoun the resignatione of his maties daylie serveand, Williame Murray, ane of his maties bedchalmer, who wes also infeft in the saids landes, lordship and barronie of Abirbrothoke and otheres abovespecefeit, with the pertinentes, be vertue of ane precept of seasing wnder the quarter seill proceiding wpoun ane chartour wnder the great seale granted be his matie to the said William Murray therwpoun of the dait at Whythall, the fyfteine day of December jM vjC and fourtie ane yeeres. Lykeas in both the foirsaides chartors and infeftments his matie hes promeist to ratifie them and ather of them in his maties nixt parliament thane ensueing and to dissolve and cause dissolve the saids landes, barrony and regalitie comprehending as said is from his maties croune and patrimony therof to be holdine of his matie and his successoures in few ferme and heretadge in maner foirsaid. Therfore the estates of parliament hes ratified and approvine and be the tennour heirof ratifies and approves the foirsaid tua chartoures and infeftmentes and ather of them, with the preceptes and instrumentes of seasing falloweing therupon, in all and sindrie heides, articles, clauss and circumstances therof, and wills and grantes and als declaires, decernes and ordeanes that the foirsaid confirmatioune shall be als valied, effectuall and sufficient to the said Patrike Maule of Panmure and his foirsaides as if the saides chartours, infeftmentes, preceptes and instrumentes of seasing and everie ane of them wer word be word exprest heirin (albeit the samene be not sua done), quheranent and with all that may fallow therwpoun the estates of parliament hes dissolved and be thir presentes dissolves all and haill the foirsaides landes, lordships, barrony and regalitie of Abirbrothok, with the pertinentes, and few mailles and fewfermes of the samene, kirkes, patronages, teyndes, annualrentes, mylnes, multores, wodes, fishings, tennentes, tennendries and service of frie tennentes therof and otheres respective belonging or annexit therto and conteyned in the foirsaides chartours and infeftmentes or ather of them from his maties croune and patrimonie therof, and from all annexationes connexing the samene or ony pairt therof therto, and als from all benefices quhatsomever wherwnto the samene perteined or wes anexit to of before; and gives, grantes and dispones the samene to the said Patrike Maule of Panmure, his aires and assigneyes quhatsomevir heritablie and irredeamablie to be holdine of his matie and his successores in few ferme and heritadge for payment to his matie and his successores of the foirsaid soume of tua hundreth pundes money foirsaid yeirlie at Whitsonday and Mertimes be equall portiones in name of few ferme, and, if neid beis, ordeanes ane new infeftment to be past therwpoun wnder his maties great seale in favours of the said Patrike Maule of Panmure and his foirsaids to be holdine of his matie and his successores in fewferme and heritadge as said is. It is allwayes provydit and declaired that this present ratificatione and dissolutione therincontenit and this haill present act and infeftmentes to fallow heiron shall onlie be extendit to the few maills, few dewties, fewfermes, kaines, customes, teyndes and teynd dewties and otheres dewties contenit in the infeftmentes granted to the fewares and takesmen of the said lordshipe, and also to samany of them allenerlie as wer wndisponed at the dait of the infeftmentes granted to the said laird of Panmure and the said Williame Murray, his author, and that the samene nor no pairt of this present ratificatione nor infeftmentes to fallow therwpoun shall nowayes be extendit to the superiorities, nor to the right of the regalitie of the said lordshipe of Abirbrothoke, nor to the right of the lordshipe or of the barrony therof, nor burght of barrony of Abirbrothoke, nor to the libertie of nominatione or voting to the electing of the magistrates or baillies, ane or ma, or other office beireres within the burghe of Arbroth, nor to the right of advocatioune and donatione of the patronage of the kirkes, quheranent the said Patrike Maule of Panmure, his aires and assigneyes shall be in the same caise as they wer before the dait of thir presentes and no other wayes.
