The quhilke day in presens of the estates of parliament compeired Sir Johne Smyth, proveist of Edinburgh, in name of the toune of Edinburgh, and produced the declaratione wnderwrittin, quherof the tennor fallowes: Wee, William, erle of Mortoune, lord Aberdoure etc. be thir presentes declaire that the contract past betuixt his matie and ws anent the erldome of Orknay and Zetland and my infeftment falloweing therwpoun past the great seale and ratificatioune therof in parliament shall nowayes be extendit to ony landes, teyndes, superiorities, right, offices and otheres quhatsomevir belonging to the lait beshoprike of Orknay the tyme of the lait abolitione of bishopes past in parliament 1640 and 1641 yeeres and conteyned in the rightes and infeftmentes granted be his matie of the said beshoprike and rentes therof to and in favoures of the toune of Edinburgh, nor to the take of the samene granted be his matie to Robert Leslie, nor to the assignatione of the said take be the said Robert to the said toune of Edinburgh, nor to the landes, offices and otheres quhatsomevir perteaneing to the said beshoprike the tyme of the abolitione therof as said is and conteyned in the signatour granted to the toune of Edinburgh off the saides rentes, offices and otheres perteaneing to the said beshoprike as said is, quhilke signatour is suprascryved be his matie and docked be the erle of Lanerke, of the daite the [...] day of [...] the yeere of God jM vjC and fourtie [...] yeeres, and but prejudice of the generality foirsaid to the commissariot of Orknay and Zetland, quhilke at no tyme did belong to the erledome bot allwayes perteaneing to the beshoprike; quhilke signator foirsaid and infeftmentes to fallow therwpoun in favores of the toune of Edinburgh shall nowayes be prejudged be the foirsaid contract, infeftment and ratificatione in any sort; and for the maire securitie we are content that thir presentes be registrat in the bookes of counsell and sessione, that executoriells may be directed heirwpoun in forme as effeires, and for that effect constitutes [...], our procuratores, in witnes quherof we have subscryved thir presentes quhilkes are writtin be Alexander Keith, servitour to Mr Robert Gillmour, wryter to his maties signet at Edinburgh, the tuentie tuo day of Junii 1644 yeeres befoir thir witness: sic subscribitur, Morton, George Douglas, witnes, Williame Cockeburne, witnes; and therwpoun asked instrumentes and desyred that the foirsaid declaratione might be ordeaned to be insert and registrat in the bookes of parliament of this day and daite, with the foirsaid ratificatione this day granted be the estates of parliament in favoures of the said William, erle of Mortoune. Quhilke desyre the estates of parliament findes reassounable and therfore ordeanes the foirsaid declaratioune to be insert and registrat in the bookes of parliament as is above desyred.
