Act and declaratione in favours of James, duke of Hammiltoun and otheres peeres and subjectes of this kingdome imprisoned in Ingland

The estates of parliament, presentlie conveend by vertue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, taking to there consideratione the fundamentall lawes, liberties and independencie of this kingdome and the practeise of former tymes, which doeth requyre that all natives and inhabitantes accused for committing crymes in this kingdome or aganes the king or kingdome should be tryed and judged in a legall way by the ordinarie judicatories of this kingdome. And considdering the present imprisonement of James, duke of Hammiltoune, a native and eminent peer of this kingdome, and his so long restraint wpoun pretence of crymes alledged to have bene committed by him in this kingdome or aganes the king's matie or the kingdome without the least significatione or intimatione to the kingdome or judicatories therof, they cannot so fare forget the publict interest and just libertie of the subjectes (which they are obleidged to menteane) as not to be sensible of the wrong done to his maties honor and this natioune therby in its freedome and priviledges. As lykewayes considdering the dangerous preparative to them and ther posteritie which may ensue therwpoun if they should pas this over in silence, therfore the saides estates of parliament do declaire that if his matie be informed of any such challenge aganes the duke as deserves that he should be put to tryell, that he ought to be returned to this kingdome heir to abyd his tryell according to law and justice; and if there be ony crymes alledged aganes him for which [he] is ansuerable as a peer of England, that he be there tryed in a parliamentarie way according to the lawes of that kingdome. Otherwayes they are confident that his matie will wpoun bettir consideratione be gratiouslie pleased, according to his accustomed justice, to cause the said duke forthwith to be set at libertie and therby preserve the liberties of this kingdome, as he hes done to otheres [whose persons] wpoun sinister informationes hath formerlie bene restraned. Bot if the evill counselles of such as are enemyes to his maties honor and the publict libertie of this his maties ancient and native kingdome shall so farr prevaill as that the persone of the said duke be deteined ony longer or be proceedit aganes forth of this kingdome of Scotland, the estates of parliament declaires the just priviledges of this kingdome and freedome and libertie of the subject to be therby infringed and violat, and all courses and procedor to the contrary heirof to be unwarrantable and illegall, and that this kingdome will resent the same as a nationall wrong; and withall declaires all such persones of this kingdome as by there actiones, counsells, plotts, advyce or assistance are or shall be onywayes accessorie therto or ony such imprisonment, restraint and detentione of ony peer or frie borne subject of this kingdome without remanding them to abide the tryell in the laufull judicatories of this kingdome, to be enemyes to the king's honour, the laufull priviledges of this kingdome and the just liberties of the subject, and that they shall be punished accordingly; and if they be natives of the kingdome of England, they will earnestly desyre the honorable court of parliament there to doe justice wpoun them as they will be reddie in the lyke caises to render to the subjectes of that kingdome.

The estates of parliament, haveing harde and considdered the supplicatione of Katherine Kendell, Inglisheweoman, relict of umqhile Johne Young, somtyme servitor to umqhile James, erle of Home, and of William, Margaret and Marione Younges, his bairnes, desyreing ane recommendation to Sir Williame Scott of Harden, shereff of Selkirke, to put ther letters of captione aganes Walter Scot of Huntlie to executione, and to apprehend and put him in waird quhill he satisfie the supplicantes of the dewties of the landes of Hyndhope; and als to command the shereff to eject the said Walter Scot forth of the saides landes and to put the supplicantes in possessioune, as the supplicatione proportes. The saides estates ordeanes the supplicantes to goe one in ther actione of removeing aganes the said Walter Scot before the shereff, and recommendes the supplicantes to the said Sir Williame Scote of Harden, shereff, being personally present to doe them summar justice aganes Walter Scot in the said mater. As also ordeines the shereff to put the supplicantes lettires of captione to dewe executione, and, in the meanetyme, the estates dischairges the lordes of sessione to pas ony advocatione of the foirsaid actioune of removeing.

Act in favoures of the erle of Lanerk againes Sir James Gallouay and Sir Robert Spotswoode

Anent the supplicatione givine in to the estates of parliament, presentlie conveened by verteue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, quherof the tennor fallowes: To the right honorable the lordes and otheres, commissionares of the estates of the highe court of parliament, the humble petitione of Williame, erle of Lanerke, humbly sheweth whereas his matie and last parliament wer pleased to nominat and elect your petitioner secreetarie of state for this kingdome of Scotland and to entrust him with the custodie of the signetes therof, as his patent wnder the great seale confirmed in parliament at lenth beires, notwithstanding heirof, Sir James Galloway, maister of requeists, hath usurped the title of secreetarie and dischairged the said office and procured diverse letters from his matie to the lordes of privie counsell desyreing them to acknowledge the said Sir James secretarie in all the rightes and priviledges therof, alledgeing ane difference betuixt ane secretarie and ane secretarie officer of estate, wherby he hath done what in him lyeth to stirre wp his matie, to violat or at least delude that act of parliament concerneing the electione of the officers of estate, which so neerlie concernes this kingdome; and notwithstanding that the lordes of privie counsell fund that the said Sir James, his proceeding heirine, his usurpeing the tytle and exerceing the office of secretarie and procureing of letters from his matie to them to the effect foirsaid wes a great wrong done in prejudice of the foirnamed act of parliament, and therfore remitted the same to be censured by your lords in this present parliament, and, in the meanetyme, dischairged him to usurpe or exerce the title or office of secretarie, as there act theranent at mair lenth proportes, wherwpoun the said Sir James did protest that this there proceeding might not prejudge him in his right and possesione of the said office; nevertheles, the lordes of privie counsell adhered to ther former act and ordaned the protestatione to be keeped and presented to the nixt parliament as ane agravatione of the said Sir James, his pertinacious cariage in usurping the title and office of secretarie contraire to the late actes of parliament. Notwithstanding of all which the said Sir James hath still usurped the said title and diverse tymes dischairged the said office, wherby he hath not only contraveened the saids actes of counsell, bot violated the foirmentioned act of parliament. Therfore your petitioner doeth humbly desyre that your lords would be pleased to declair whither ther can be ony secreetary for this kingdome bot such as is or shall be nominated and elected according to the foirsaid act of parliament, and to dischairge the place of secretarie wnder [the said Sir James Galloway or any others] (to the prejudice of your petitioner) to usurp the title or dischairge the place of secreetarie wnder what paines your lords in your wisdomes shall thinke fit. As lykewayes that sieing the court signet delyvered be his matie in oppine parliament to your petitioner was in Januarie last (whilst he wes wnder a most strike restraint at Oxfoord) requyred from him in his maties name by the Lord Dickbie and Sir Edward Nicolas, secreetaries for England, and (as your petitioner is sure informed) delyvered to Sir Robert Spotswood, whoise affectioune to this kingdome hath bene much doubted, and that sieing your petitioner is and shall be still reddie to ansuer according to the lawes of this kingdome for his faithfull dischairge of that trust, he doeth therfor humbly petitione that your lords would be pleased to declare that the takeing of the said court signet from your petitioner (whill he wes wnder the afoirsaid restraint) shall not prejudge him as sole secretarie for this kingdome, which he shall no longer wish to enjoy then with fidelity and affectione he hath dischairged that trust; and your lords answer he humbly craveth, as the supplicatione proportes. Quhilke supplicatione being red in audience of the parliament and the same, with the desyre therof, hard and considdered be the estates of parliament with the foirsaid act of counsell and protestatione abovespecified produced be the erle of Lanerke, the estates of parliament findes the supplicatioune and desyre therof reassounable, and therfore they find and declaire that there can be no secreetary for this kingdome bot such as is or shall be nominated and elected according to the foirsaid act of parliament; and in respect heirof, the estates dischairges the said Sir James Galloway or ony otheres (to the prejudice of the erle of Lanerke) to usurpe the tytle or dischairge the place of secreetarie. As also the estates declaires that the taking of the said court signet from the said erle of Lanerke whill he wes wnder the afoirsaid restraint at Oxfoord and delyverie therof to the said Sir Robert Spotswood, or to ony other, shall not prejudge the said William, erle of Lanerke as sole secretarie for this kingdome. And als the estates findes and declaires that the censure of the said Sir James Galloway and Sir Robert Spotswood, usurperes of the foirsaid place of secreetarie, to be as brekeres of the actes of parliament and that therthrow they have amitted and tint, lykas the estates declaires them to amitt and tyne there present places for this kingdome and to be uncapable to bruike any other place for this kingdome intymecomeing.

Anent the supplicatione givine in to the estates of parliament, now presently conveend by vertewe of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, wherof the tennour falloweth: Wnto the estates of parliament, the humble supplicatione of James, erle of Home shewes that quher I haveing petitioned the kinges matie and estates of parliament in anno 1641 to take in consideratione the heavie prejudice and loose susteined by me be the lamentable accident that fell out at my house of Dunglas occasioned by the publict service of the kingdome, which lose wes be diverse gentlemen apprysed, haveing commissione from the committie of estates, to the soume of fourtie thousand, ane hundreth therttie thrie pundes, conforme to the report heirwith produced. Nather can the said valuatione be thought bot to be farr short of the reall lose and prejudice susteined by me, sieing the sowme wes apprysed wpoun oath be some of the workemen that was builderes of the house to the soume of ane hundreth and thriescoir jM merkes. Quhilke supplicatione wes remitted be his matie and estates of parliament to the committy for the commoun burdings as ane mater deserveing to be takine to ther serious consideratione, and haveing diverse tymes supplicat the said committie for the commoune burdings, they be diverse actes and minuts declaired to grant me ane publict act for the repayment of my lose, as is knowne to diverse of the lordes and otheres of this present parliament. Heirfore it is my humble desyre, according to justice, consience and our covenant, that my sufferinges and loses be condishendit wpoun be ane present act and for payment therof when the effaires of the kingdome shall permitt, and your lords ansuer humbly I desyre. Quhilke supplicatione, being first presented to the committie appoynted be the parliament for bills and supplicationes, and the samene, with the report of the committy for the commone burdings, hard and considdered be the said committie of the bills and reported be them with ther thoughtes and opinione theranent to the estates of parliament, and therwpoun the foirsaid supplicatione being publictlie red in audience of the parliament and the samene, with the desyre therof, tane in consideratione be the estates of parliament, the saides estates findes the desyre of the foirsaid supplicatioun reassounable and grantes the samene for the soume of fourtie thousand pundes Scotts money, and declaires that soume of fourtie thousand pundes Scots to be ane publict debt of the kingdom and to be payed when the effaires therof shall permitt.

Act in favoures of the Old Colledge of St Androis for ane regent of humanity

Anent the supplicatioune givine in to the estates of parliament, presently conveend by vertue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, quherof the tennor fallowes: My lordes of parliament, wnto your lords humblie meanes and shewes, we, Johne, erle of Cassilles, Mr George Merteine, provest in the Old Colledge of the wniversity of St Androis, Mr Johne Barroun, minister, James Wood, professour, Mr George Merteine, William Tuedy, Thomas Greige [and] Robert Keith, regentes there, that wheras it hath pleased your lord to grant the desyre of my Lord Scottstarvett's petitioune anent his professor of humanitie in Leonardes Colledge, alloweing him to have a teacher [of a] privat class of humanity therin (wnto which your lords ordinance we all in due humility submitt our selfes); and we, the saides erle of Cassilles and master of the said Old Colledge, considdering that unles that there be a professour of humanity in the Old Colledge also, the class of philosophie therin will become desolat, have alloted for makeing wp a provisione and mentenance for the lyke professour in the said Old Colledge fourteine prebendaries, which for the present is imployed in no publict use, ten of theme belongeing to us, the said erle, viz: the prebendaries Rattray primo, Rattray secondo, Rattray tertio, Souleingwordfeild, Eister Ballbuithie, Wester Ballbuithie, the Reuuell chaiplanrie of St Andro [...], the other foure of them belonging to the maisteres of the Old Colledge [...], that it would please your lords to ratifie this erectione made by us. And becaus this is not ane competent mentenance for ane able and qualified man, therfore your lords, out of the tender caire of the standing of that ancient seminarie to the credit and publict good of the kingdome, would pas ane act that the said professour may have ane proportionable pairt with other regentes of the wniversity as my Lord Scottstarvet hath allowed wnto him out of that pairt of his maties late munificence to the said wniversity, which resteth yet, over and above all which by devisione is applyed to the publict use, whilke will be nothing prejudiciall to ane professor in the wniversitie. As also it will please your lord to declaire that the professour erected be us shall enjoy and be capable of all priviledges and dignities of the wniversitie eftir the samene maner as it is granted be your lords to my Lord Scottstarvets professor, and als that your lord would declaire and enact that the said erle (who is patroun allreddie of ten of the prebendaries abovewrittin and to whom his aires and successours we maisteres of the Old Colledge have dispoinit the other four prebendaries, to the effect the samene and the benefit therof with his owne ten may be imployed to the foirsaid use[)], his airs and successores of the name and armes of Kennedy shall in all tymecomeing have the right of the presentatione of the persone to be nominat to the foirsaid professioune and to the whole profites of the saides fourteene prebendaries and the successores to the said professioune in all tymecomeing, and your lords ansuer. Quhilke supplicatione being red in audience of the parliament and the samene and desyre therof hard and considdered be the estates of parliament, the saides estates findes the said desyre reassounable and grantes the same, and therfore they ordeine the professour of humanitie in the said Old Colledge to have ane proportionall pairt with the other regentes of the wniversitie (as the Lord Scotstarvets hath allowed him of that pairt of his maties munificence[)] to the said wniversity which resteth yit, over and above all which by devisioune is applyed to publict use, which will be nothing prejudiciall to ane professour in the wniversitie; and declaires that the said professour erected be the supplicants shall enjoy and be capable of all priviledges and dignities of the wniversity eftir the same maner as is granted by the estates to the Lord Scotstarvets professour. And als the estates declaires that the erle of Cassilles, who is patrone allreddie of ten of the prebendaries abovewrittin and to whom his aires and successores, the maisteres of the Old Colledge hes disponit the other four prebendaries, to the effect the samene and benefite therof with his owne ten prebendaries may be employed to the said use, his aires and successores of the name and armes Kennedy shall in all tymecomeing have the right of presentatione of the persone to be named to the foirsaid professioune and to the haill proffeits of the foirsaid fourteine prebendaries and of the successor to the said professioune in all tymecomeing.

Anent the supplicatione givine in to the estates of parliament, presentlie conveind by vertue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, quherof the tennour fallowes: The humble petitioune of George Buchanane, appeirand of that ilke, to the honorable lordes and remanent estates of parliament, sheweth wheras the committie of estates be ther act the 18 day of Aprille 1644 yeeres gave power and commissioune to me with my freendis and falloweres with all diligence to repaire to the house and fortalice of Magdocke, entir therin and intromet with the cannone, poulder, ball, match and other warlike furnitor being therin for the use of the publict, and to make opine doores, breake doune the iron yets or any other strong yets therin, that it be not keeped aganes the cuntrie, with power to doe everie thing that might procure the executione of my commissione, ordeaneing my expenss wpoun just accompt to be payed to me. According to the quhilke commissioune, I wpoun the nynteene day of Apryle last went from Edinburgh and conveind ane company wnder the command of Patrike Buchanan of Auchmnar, and wpoun the tuentie day of Apryle came to the hous of McDocke at night, and finding the yets fast, brake them wp and stayed ther that night and the 21 day, being Sonday, and wpoun Monday made search of the house, conforme to my commissioune, and fand no armes nor ammunitione ther bot some few pickes that hade bene removed the day before and put in the officeres house, with some few musketes which wer bigged wp in the wall of the hous, and I causit take doune all the gaites and irone windowes, and thereftir I did acquant the lord chancellor with what wes done, who therwpoun did signifie to me that the committie fand it not necesar that ony farder should be done at that tyme. Wherwpoun I caused remove the saides pickes and muskets with all the iron workes and gaits that were tane doune to the house of Duntraith, quher they now are; quhilkes premiss I did for obedience of my commissioune foirsaid. Heirfore I humbly beseike your lords to take the said commissione, with my report what is done be me in obedience therof, in consideratione, and according as your lords shall find my cariage, diligence and caire heiranent to deserve, that accordinglie the samene may be approvine and I exonered as my just accompt of my expenss allowed in prosequtioune of my commissioune theranent as it shall be givine in, and your lords ansuer, as the supplicatioune beires. Quhilke supplicatioune being hard and considdered be the estates of parliament, the saides estates approves the supplicantes proceidings in the commissioune abovewrittin and remitts the consideratione of his accomptes and expenss to the committy of parliament.

Anent the supplicatione givine in to the estates of parliament be John Shew of Grenocke, quherof the tennor fallowes: Wnto the Lordes and otheres the estates of this honorable court of parliament, humbly meanes and shewes I, your servitor, Johne Shew of Grenocke, that quher wpoun the 2 day of Merch 1635 yeeres the lordes and otheres his maties commissionares of parliament for tyme appoynted for surrenderes and teyndes did decerne and ordene me and my successours to content and pay to Mr Johne Layng, then minister at Grenoke, and his successores ministeres ther the soume of fourscoire pundes Scots money yeerlie out of the reddiest of my proper rentes, notwithstanding the commissioune gave them only power to modifie ministeres stipendes out of teyndes and that I had no teyndes at all, bot payed my rentall bolles according to the commissars feires, and yit does yeerlie to the titulare or his takesman. The saides lordes and otheres commissioners foirsaides, pretending for ther warrand ane act extracted furth of the bookes of assignationes of ministeres stipendes, quhilke act wes nather obligatorie nor wes ever I nor any my predicessours in use of payment of the said 80 lib. to any minister, and it is only exprest in the said decreet that be the act produced the said eightie pundis wes probably in use to be payed be the laird of Grenocks, guidsir to the minister, and farder (which makes the injust therof more evident) declaires that incaise the said Johne Shaw of Grenocke opose the payment of the saids fourscoire pundes and put the minister to the trouble of a suspensione, in that case he to be lyable to the payment of ane thousand pundes at the sight of the saids commissioneres, quhilke decreet nevertheles I did suspend and the suspensioune lyes yit undiscussed. Wherfore my humble desyre is that your lord would be pleased to recommend to the commissioneres now to be appoynted for plantatione of kirkes (either into the commissioune or in a severall act) to considder of the foirsaid decreet and ather ramverse or approve the same, as to your lords shall seeme most just and equitable, to the effect the minister may be setled with a constant stipend and all occasioune of outcast removed betuixt him and me, his parochiner; and your lords answer, as the said supplicatioune beires. Quhilke supplicatioun being red in audience of the parliament and the samene supplicatioune and desyre therof hard and considdered be them, the saides estates of parliament recomends and remitts the consideratioune of the foirsaid supplicatioune and desyre therof to the commissioune for plantatioune of kirkes.

Anent the supplicatione givine in to the estates of parliament, presently conveend by vertew of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, quherof the tennor fallowes: My very honorable lordes and otheres of the estates of parliament, wnto your lords humbly meanes and shewes I, your lords servant, Johne Grahame of Panholles, that quher in the moneth of Junii 1636 yeeres my maynes of Panholles, with the places, houss, yairdes, orchyairdes and parke of the samene being wedset to Androw Grahame of Panhalls, servitor to the erle of Montrose for the soume of sevine thowsand merkes and presently possest be the said Andro be vertue of the said wodset and continowallie sensyne be the space of eight yeeres, the redemptioune of the wodset being suspendit be the contract of wodset for the space of sevine yeeres to the time of [...], as the said contract heir present to show to your lords will testifie; and the said soume of sevine thowsand merkes [...] being thereftir arreisted in my handis in Januar 16[...] yeeres long before the expyreing of the sevine yeeres, dureing whilke yeeres the redemptioune wes suspendit as said is, and at the instance of Mr Johne Adamsone, principall of the colledge of Edinburgh, the said Mr Johne, in the moneth thereftir, haveing lykewayes obtenit ane decreet befor the lordes of counsell and sessione for payment of the soume of thrie thousand, tua hundreth and thriescoire merkes aganes me for not compeirance, and als aganes the said Androw who wes lykewayes sommondit to the said decreet and who onlie should have defendit the said actioune and had promised to imploy procurators for him and me to compeir therine for that effect, b[ut] he being ane malignant in service with the erle of Montrois and privatlie and secreetly imployed be him out of and in the cuntrie, and als being in possessioune of my landes, not caireing quhat should be done therin, the debt being just, off purpoise suffered ane decreet to pas aganes himselfe and me, knoweing that I onlie wes to susteine the prejudice; bot I being advysed to suspend the said decreit be reasoune that the samene wes heritable and sua not arreistable, and the decreit nether did beare nather could be ane warrand to me to get the samene allowed to me in pairt of payment of 7,000 merkes conteyned in the wodset, and quhill I wes using all meanes to get ane suspensione quhilke be no meanes I could get aganes the said Mr Johne without consignatioune, and the said Mr Johne being adverteised of the samene did purches captioune aganes me, be vertue quherof I wes apprehendit and incarcerat in the tolbooth of the Cannogait, wher I remained to the space of thrie monethes to my great and havie chairges and hurt of my persone, haveing contracted ane longsome desease and fever efter my liberatioune, quherin I lay be the space of sex weikes. Sua at last wpoun the [...] day of [...] lastbypast I wes forced to suspend and consigne for obteyneing ane sufficient warrand of the lordes of sessioune for payment of these moneyes for getting the samene to be allowed in the sevine thousand merkes conteined in the contract of wodset, and my landes declaired to be laufullie redeemed in sua far as conserned the thrie thousand, tua hundreth and thriescore merkes. Quhilke suspension being discussed, the saides lordes of counsell and sessioune wpoun the [...] day of [...] lastbypast fand the lettires orderlie proceidit and ordeinit the soume consigned to be givine wp to the said Mr Johne, and that notwithstanding of the reasones therof in respect of the decreit standing unreduced, reserveand to me reductione of the samene and ordeinit Mr Johne to find cautione to refound if I should prevaill in my said reductioun. Quhilke reductioune I haveing thereftir intentit and the said Mr Johne, heiring the event, therof intentit ane new proces aganes me wpoun ane posteriour arreistment usit be him since the first arreistment eftir the expyreing of the sevine yeeres, and eftir ane requisitioune made be Lillias Grahame, spous to the said Androw, as haveing power and ane factorie to requyre me for payment of the said soume of sevine thousand merkes; and to the quhilke proces the said Lillias as factrix foirsaid, not only be hir selfe bot lykewayes be Mr Johne Gillmor compeiring and consenting for hir and hir said husband to the said decreit, lykeas the said Lillias furnished to the said Mr Johne the said instrument of requisitioune quherwpoun he obtenit the said decreet, be the quhilke he wes ordenit to reteine the saides moneyes consigned and the samene ordenit to be allowed to me in pairt of payment of the said soum of sevine thousand merkes conteind in the said wodset, as the saids thrie haill decreites also heir present to shaw to your lords will testifie. And sua be payment of the said soume of thrie thousand, tua hundreth thriescoire merkes and annualrentes therof (of the said soume of sevine thowsand merkes) since the dait of the said consignatione, extending to [...] money foirsaid, and als be the mailles and dewtyes of my landes quhilke does now only properlie belong to me be the said wodset, he being my vassell, the landes being only haldine be him of my umqhile father and successour to whom I am air, and as air infeft in the saides landes and throw the said Androw his being yeir and day at the horne, as the said contract of wodset and horneing deulie regisrat conforme to the act of parliament also heirwith produced will testifie, not only the said soume of sevine thousand merkes will be exhausted, bot the mailles and dewties and portioun of my saides landes does now properlie belong to me in maner foirsaid, and I ought in justice to be put in possessioune therof. Notwithstanding quherof, the said Andro Grahame still reteines the possessione of my saides landes, houss, orchyairdes and parkes, destroyes the plantinge and daylie layes the land waist to my great hurt and prejudice of maire malice, he knoweing how that in thir troublesome tymes I cannot have the benefit of the law, the ordinar judges not sitting for the tyme. Heirfore I most humbly beseike your honors to have consideratioune of the premiss and that your honors would be pleased to grant me ane warrand in thir troublesome tymes to entir to the possessioune of the saides landes, houss and otheres foirsaid, which in equity and justice perteines to myselfe for the reassones and causs abovespecified, and quhilke eftir compt and reckoneing will be fund fullie outquit and redeemed fra the said Andro Grahame. And I am content to make my selfe to be comptable to the said Andro at quhat soumes of money shall be fund due to the said Andro, and your lords ansuer most humbly I beseike, as the said supplicatioun proportes. Quhilk supplicatioune being wpoun the ellevinth day of Julii lastbypast red and the desyre therof considdered be the committie appoynted be the parliament, that committie ordeined the said Andro Grahame to be warned by ane maisser or messinger of armes to have compeired and ansuered to the desyre of the foirsaid supplicatione, quhilke wes accordinglie done, and the said Andro Grahame sommond, personallie apprehendit be Johne Mitchell, messinger, to have compeired befor the parliament the nyntenth day of Junii or ther committy, as the delyverance of the committie for the billes and the executione of the citatione conforme to that delyverance respective more fully proportes; and now the foirsaid supplicatioune being this day red in audience of the parliament and the samene, with the desyre therof, hard and considdered be the severall bodies of the estates apairt, the saides estates of parliament hes remitted and remitts the foirsaid supplicatioune and desyre therof abovewrittin to the committy of estates reseiding at Edinburgh, and recommendes the same to the said committie to doe theranent as they shall thinke fitting and expedient.

Anent the supplicatione givine in to the estates of parliament, presently convenit by vertue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, quherof the tennor fallowes: Supplicatioune James Hammiltoune of Boiges and James Stewart: Quhairas your lords did appoynt us ane thousand pund sterline in pairt [payment] of this last ten thousand bolles meill to be allowed of such money as should be barrowed from ony to whom we are due betuixt and the first of August, the tyme now allmost prescryved, we are not hopfull to get it by that meanes. Therfore our humble desyre to your lords is that it be appoynted out of the first money that shall be barrowed for the publict out of the shireffdome of Renfrew. Anent the supplicatione givine in to the estates of parliament, presently convenit by vertue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, haveing hard and considdered the petitioune of Alexander Maxwell and Samuell Lockhart craveing payment of the soume of fyve hundreth thirtie tuo pundes, sexteine shillings, eight pennies sterling, assigned to them be James Bosuell, merchand in Edinburgh, and awand to him be the estates for meale furnished be him for the use of the Scotts army in Ireland, and quherof the petitioneres, by act of the committie of estates in Februar last, wer appoynted to be payed with the annualrentes therof since Mertimes 1643 out of the reddiest money that should have comed from England for the use of the Scotts army in Ireland, findes the desyre just and reasounable and ordeanes the said Alexander Maxwell and Samuell Lockhart, petitioneres, to be payed of the said soume of fyve hundreth threttie tuo pundes, sexteine shillings, eight pennyes sterling with the bypast annualrents therof since Mertimes 1643 out of the first and reddiest of the thertie thousand pund sterling first payable to the Scotts army that is in Irland be the parliament of England; and for the saides petitioneres, there more reddie payment, the saides estates be thir presentes grantes precept and warrand to Mr Herring and Maister Warring, thesaureres of Goldsmyth house at Londoun, wpoun sight heirof, to make payment to Alexander Maxwell and Samuell Lockhart, or any haveand there power and warrand for there use, of the said soume of fyve hundreth threttie tuo punds, sexteine shillings, eight pennyes sterling money with the bypast annualrent and interest therofe since Mertimes last 1643 yeeres out of the reddiest of the foirsaid therttie thousand pund sterling first payable to the Scotts armie in Ireland, quhairanent the estates declaires that thir presentes, with the saides Alexander Maxwell and Samuell Lockhart, or any haveand ther ordour and warrant, there receptes of the said soume of fyve hundreth threttie tuo punds, sexteine shillings, eight pennyes sterling with the bypast annualrent therof since Mertimes 1643, shall be ane sufficient dischairge and exonoratione to the parliament of Ingland and all otheres whom it effeires of the samene soume; and in respect heirof, the saides [estates] ordeines the said Alexander Maxwell and Samuell Lockhart, as assigneyes and haveand right from the said James Boiswell, to dischairge simply Archbald, marques of Argill, Johne, erle of Lauderdaill and sicke otheres as are obleist to the said James Boiswell for payment of the meale furnished be him to the army in Ireland, and wherwnto the saides Alexander Maxwell and Samuell Lockhart hes right from the said James Boiswell be assignatioune or otherwayes off the saides Archbald, marques of Argile, Johne, erle of Lauderdaill and otheres foirsaides then obleist to the said James Boiswell.

Anent the supplicatione givine in to the estates of parliament, now presentlie convenit by vertue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, quherof the tennor fallowes: Right honorable my noble lords, please your lords humble supplicant and servitor, Collonell Frances Sinclaire, that where it pleased the lords of the committie to give command some sevine or eight weikes agoe to arrest and decerne me within the bounds of sex miles or therby to Edinburgh, for obedience wherof I remained heir and does as yit remane with my wyffe, famelie and falloweres to my extrem great chairge and expenss without your lords provyde remeid therto. Heirfore I beseike your lords, in consideratioune of the promeiss, to give warrand for my enlargement and freedome from the said areist wherin I am put and does remaine, that I may pas and repas to the kingdome of Suedene to doe my laufull bussines with the croune and counsell ther or els, if it pleas your lords to deteine me ony longer heir, that it would please your lords to lay doune some course wherby I may live in ane honest estate and conditioune, and your lords ansuer humblie I crave. Quhilke supplicatioune being this day red in audience of the parliament and the samene, with the desyre therof, hard and considdered be the parliament, the saides estates relives the said Collonell Frances Sinclair, supplicant, of his restraint foirsaid and grantes him enlargement and freedome that he may pas and repas in maner and to the effect before desyred.

Anent the supplicatione givine in to the estates of parliament, now presentlie convenit by vertue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, quherof the tennour fallowes: My lordes and otheres of the estates of this honourable and highe court of parliament, wnto your lords humblie meanes and shewes I, your servitor, Mr Alexander Collvill, professor of divinity in the New Colledge of St Androes, that quher ther wes allowed to me be the commissioneres of his maties exchekker the soume of tuo hundreth pund sterling for my chairges of tuo voyages in my transportatioune from the wniversity of Sedane in France to the said wniversitie in St Androis, to have bene payed out of the first and reddiest of the rentes of the excommunicat papists, as the act of excheqher granted therwpoun, with the precept drawne upon Sir Williame Lockhart and Adame Blair, receiveres of his maties rentes, for payment to me, therof beires; notwithstanding wherof, I have nevir received any payment of the said tua hundreth pund sterling. Heirfore I humbly beseike your lords to give order and warrand to ony persone or persones who are or shall be appoynted to medle or intromet with the saids escheits to make payment to me (out of the first and reddiest therof) of the said soume of tua hundreth pund sterling, to whom thir presentes, with my note of recept therof, shall be ane sufficient acquittance and dischairge; and your lords ansuer humbly I beseeke, as the said supplicatioune proport. Anent the supplicatioune givine in to the estates of parliament, presently convenit by vertue of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, quherof the tennour fallowes: My lordes and otheres of the committy for bills, wnto your lords humbly means and shewes your servitours Geilles Kellie, relict and executrix confirmed to umqhile Johne Ramsay of Edingtoune, George, Williame, Martine, Jeane and Eleizabeth Ramsayes, his laufull bairnes procreat betuixt us, for ourselves and in name and behalfe of the tennentes and otheres of the lands of Edingtoune and otheres, that quher be warrand and commissioune of the committie of estates Generall Major Monro, William Home of Ayttoune, Sir Alexander Suyntoune of that ilke, knyght, and Johne Rentoun of Lambertoun wer appoynted to take exact tryell of the skaith and loss susteined be the said umqhile Johne Ramsay and his tennentes throw the excursioune of the garisoun in Berwicke; and eftir tryell and notice takine be them of everie particulare persone, there loss susteind in maner foirsaid, they fand the samene loss and pryces therof to extend to the soume of sex thousand, nyne hundreth and ellevine pundes, 16 s. 4 d., as the apprysing subscribed be the foirnamed persones wpoun ther credit and consience at lenth beires; and that by and attor the skaith and loise susteend be the said umqhile Johne Ramsay in the houss of Edingtoune be the said garisone, conforme to ane particulare inventor givine in be him to the said committie and subcryved with ane oath anent the veritie therof, which entendis to the soume of thrie thousand, sex hundreth and ten pundis, 10 s. 8 d., and quhilkes tua soumes extendis to the soume of ten thousand, fyve hundreth tuentie tuo pundes, 7 s. Scots money. Off the quhilke soume of 1[0],522 lib. 7 s. the said committie, be ther act the 24 December 1640 yeeres, band and obleist the estates of this kingdome to make payment to the said umqhile Johne Ramsay himselfe and in name and behalfe of his saides tennentes and otheres contenit in the said apprysing, and that in satisfactioune to them of the haill loss susteind be theme in maner foirsaid betuixt the dait foirsaid of the said act and the feist and terme of Whitsonday than nixtocome in anno 1641, togidder with annualrent for the samene ay and sua lang as the samene should remaine unpayed eftir the said terme. And he haveing onlie received therof the soume of tua thousand pundes money foirsaid, with sex hundreth fourscoir ten pundes, 13 s. 4 d. received be Mr George Rule, minister of Mordingtoun, ane of the persones contenit in the said apprysing, conforme to ane precept granted be the committy for the commoune burdenes to him theranent, the said umqhile Johne Ramsay of Edingtoune menit himselfe to the lords and otheres commissionares appoynted for the commoun burdenes for payment of the superplus of the said soume, extending to sevine thousand, eight hundreth thertie tua pundis, 13 s. money foirsaid, with the annualrent therof fra the terme of Whitsonday 1641 yeeres. Quhilke supplicatioune being hard be the committie of the commoune burdenes and they haveing considdered the samene, declaired be the delyverance wpoun the bake of the said supplicatioune that the[y] would cause pay the said umqhile Johne of the foirsaid soume with the haill byrune annualrentes of the samene, be the quhilke excursioune, skaith and loss and his chairg and imployment in the publict at home and in Ingland he hes contracted great soumes of money and burdened his landes and estate, so that he cannot both satisfie his creditours and provyde us, his bairnes. Notwithstanding quherof, trewe it is and of veritie that the said umqhile Johne Ramsay, my husband, at no tyme before his deceis (who deceised in the moneth of October 1642) received ony pay or satisfactione of the said soume of 7,832 lib. 13 s. restand awand of the foirsaid soume of ten thousand, fyve hundreth tuentie tuo punds, 7 s., nor of the annualrent of the samene. Heirfore we beseike your lords to have consideratioune of the premiss and heirby to grant warrand to your commissarie or take some other course as your honorable wisdomes shall thinke expedient for payment makeing to us, for our selfes and in name and behalfe foirsaid, of the said soume of sevine thousand eight hundreth threttie tuo pundes, therteine shill[ings], 4 d. yit restand awchtand of the said soume of 10,522 lib. 7 s. contenit in the said comprysing and act of committy, with the annualrent therof restand auchtand since the said terme of Whitsonday 1641, in respect it is pairtlie minores geir and the poore people to whom ane other pairt restes are alltogidder depauperat and nether hes any thing to interteine themselves and ther severall famelies, nor to pay the creditoures fra whom they have barrowed money for laboring and plenishing of the ground untill they receive payment of their skaith and loss, and your lords ansuer. Quhilke supplicatioune, with certane other supplicationes, being reported in audience of the parliament fra the said committy for the billes, and tane in generall consideratioune by the estates of parliament, they not haveing tyme to take particulare notice and consideratioune of ilke ane of ther saides supplicationes and desyres therof, the saides estates remitted and recommendit and heirby remitts and recommendes the supplicantes abovenamed and ther supplicatioune abovewrittin and desyre therof foirsaid to the committie of estates who are to be nominat and appointed be the estates of parliament to reside at Edinburgh, to be considdered and determined be them or remittit to the committie for the commoune burdings as the said committie of estats shall thinke expedient.
