Anent the supplicatione givine in to the estates of parliament, presentlie conveind by vertew of the last act of the last parliament haldine be his matie and thrie estates in anno 1641, be Sir Johne Dallzell of Newtoun, desyreing the estates to repone the supplicant aganes ane declaratione emitted be him that the dispositioun of the landis of Newbigging acquyred be him from Mr George Douglas wes to the behove and for the use of the erle of Carnewath, his brother, and that the sowme of tuentie thousand merkes adebted be the erle of Southeske to the erle of Carnewath wes tane wp and payed to the said Mr George for that dispositioune; as also that the saides estates would declaire be ther act the said Sir Johne to be frie of the foirsaid declaratione, and that he notwithstanding therof may peaceablie bruike and enjoy the foirsaides landes of Newbigging, with the pertinentes, and posses the same heritably and irredeimably as his owne proper landes and heritadges; and alse desyreing the estates to give warrand for the supplicantes liberatione and friedome out of the castell of Edinburgh quher he remaines imprisoned by order of the estates of parliament, as the said supplicatione at mair lenth beires. Quhilke supplicatione being red in audience of the parliament and the samene, with the desyre therof, hard and considdered be the estates of parliament, the saides estates repones the said Sir Johne Dalzell, supplicant, aganes ane declaratione emitted be him concerneing the mater abovementionat conteyned in the said supplicatione and declaires him frie of ony declaratione emitted be him theranent and that he may peaceablie enjoy the possessioune of the foirsaides lands of Newbigging, with the pertinentes, heritablie and irredeimably as his owne proper landes and heritadges, conforme to the right and dispositioune made and granted to him therof, and ordeanes the said Sir Johne Dallzell to be put to libertie furth of the said castell of Edinburgh, notwithstanding of his incarceratioun therin foirsaid by warrand of the estates of parliament as said is, wheranent thir presentes shall be ane sufficient warrand to the captane, constable and otheres commanderes and wndir officeres of the said castell of Edinburgh.
